We have received all the Utility comments back, with the exception of the Waste Water

I cannot approve any plat in our service area unless it contains PAGIS coordinates. If you
have any questions let me know.

Mr. Aunspaugh,
Entergy has no objection to the re -plat of the 2 lots into 1 lot per the drawings you
attached.
It does appear that Entergy's service line to the house serves the house from the east
side. The SW corner of the tennis court fence near the road appears to be fairly close to
the existing service line. Please use caution if this is a new fence to be installed at a
later date so that NESC clearance is maintained from the overhead wires.
Let me know if you have additional questions about this re -plat as it pertains to
Entergy's facilities.

I'm sorry I meant to send this email yesterday but got tied up in other things.
CenterPoint has no objection to combining the Lots. Our gas main is currently on the
south side of the road in the street right of way so we should not require any easements.
If you need a more formal letter expressing this please let me know and I will draft one
for you. If you require more information please let me know.

Please accept this email as AT&T's concurrence in releasing our interest in the utility
easement that separates Lots E and F in Block 1 of the East Palisades Addition to the City
of Little Rock.
We have no facilities within this easement and have no plans to use it in the future.

WHEREAS, TEN EAST PALISADES REALTY, LLC, an Arkansas limited liability
company ("Grantor"), is the owner of the following described land lying in the City of Little
Rock, Pulaski County, Arkansas:
Lot E and F, Block 1, East Palisades Addition to the City of Little Rock, Pulaski
County, Arkansas, as recoded in Plat Beek #4, Page-#277 (the "Property")
Grantor has caused the Property to be surveyed and a re -plat (the "Replat") thereof made,
which is identified by the title of "Lot EF1, Block 1, East Palisades Addition, an Addition to the
City of Little Rock, -Pulaski County, Arkansas Being a Replat of Lots E and F, Block 1, East
Palisades Addition, the City of Little Rock, Pulaski County, Arkansas". This Bill of Assurance
and the Replat have been signed by said Grantor and is recorded in the office of the Circuit Clerk
and Ex-Officio Recorder of Pulaski County, Arkansas, in Plat Book Page
Grantor does hereby make this Bill of Assurance to govern and control the land described in the
Replat.
HEREAFTER, the Property shall be known as and conveyances and the foregoing
description of the Property shall be a proper and sufficient description thereof, to wit:
Lot EF1, Block 1, East Palisades Addition to the City of Little Rock, Pulaski
County, Arkansas
Lot EF1, Block 1, East Palisades Addition to the City of Little Rock, Pulaski County,
Arkansas, shall be conveyed by the Grantor and shall be acquired by the grantees thereof, subject
to the covenants contained herein and the Replat.
RIGHTS OF WAY: With the filing of this Bill of Assurance and Replat in the office
of the Circuit Clerk of Pulaski County, Arkansas, the rights -of -
way shown on said Replat (if any) are hereby dedicated to the
City of Little Rock. The utility easements shown thereon on
dedicated to the appropriate public utilities. The Existing 10'
Easement shown to be relocated by the Replat is hereby
relocated to the new location shown on the Replat.
TERMIAMENDMENT:
This Bill of Assurance shall be in full force and effect in
perpetuity subject to the following amendment and termination
rights of the owners of the Property. This Bill of Assurance may
be amended or terminated at any time from the date hereof by
the unanimous written agreement of the owners of Lot EF 1. The
parties are mindful of the decision in Rausch Coleman Homes,
LLC v. Brech, 2009 Ark. App. 225 (the 'Decision") and do not
wish for the Decision to limit the ability of the parties to amend
this Bill of Assurance at any time and from time -to -time. The
parties intend that this Bill of Assurance may be amended at any
time from the date hereof throughout the term of this Bill of
Assurance and expressly intend and agree that this Bill of
Assurance may be amended prior to any expiration or
termination date set forth herein.
RESTRICTIONS: Grantor and all future grantees of the property described
in this Bill of Assurance and the Replat specifically agree all
ordinances of the City of Little Rock shall be strictly adhered to
and followed and, should the Replat or this Bill of Assurance be
contrary, in any way, to the ordinances adopted by the City of
Little Rock, from time to time, such ordinances shall have
precedence.
All buildings constructed on said lots shall be constructed no
nearer the street than the building line shown on the Replat, and
all buildings shall be constructed in conformance with the
Building Code and Zoning Ordinance of the City of Little Rock,
Arkansas.
