BILL OF ASSURANCE
KNOW ALL MEN BY THESE PRESENTS: �0 l--:� j _`3'2—
THAT, WHEREAS SCOTT LEWIS, JR. (hereinafter called "Owner"), is the owner of
that certain real property located in Pulaski County, Arkansas and being more particularly
described on Exhibit "A" attached hereto and incorporated herein by this reference (the
"Property");
WHEREAS, it is deemed advisable that all of the Property shown on the plat hereinafter
mentioned, be subdivided into building lots as shown on the plat filed herewith and that said
Property be held, owned and conveyed subject to the protective covenants herein contained in
order to enhance the value of the Addition.
NOW THEREFORE, Owner, for and in consideration of the benefits to accrue to it, its
successors and assigns, which benefits it acknowledges to be of value, has caused to be made a
plat, showing a survey made by Paul M. White, Registered Professional Land Surveyor dated
July Z 3 , 2010, and bearing a Certificate of Approval executed by the appropriate officials of
the City of Little Rock, Arkansas (the "City"), and showing the boundaries and dimensions of
the Property designated as Lot 34AR, Block 6, now being replatted to be forever known as Lot
34AR, Block 6, Westwood Addition (the "Plat").
No buildings, fences, incinerators, paved driveways, or any other permanent structure or
improvement of any kind, whether herein specifically enumerated or not, shall be built or
maintained within the area of any of the easements encumbering the Property and in the event
any such obstruction is placed thereon in violation of this restriction and reservation, no utility
and/or public agent will be liable for destruction of same in constructing and maintaining its
facilities located within the area of said easement.
The Property shall remain subject to the restrictions and covenants set forth in Bill of
Assurance or other declarations filed of record in connection with the original plat of the
Westwood Addition filed of record in Platbook 2 at Page 166 and any easements or restrictions
existing of record affecting the Property.
The types of uses permitted on the Property shall consistent with the zoning covering the
Property.
No obstruction shall be placed in the street or gutter. Curbs shall be broken at driveways,
and driveway aprons shall not extend past the face of the curb.
The restrictions imposed under this Bill of Assurance shall be a servitude upon Lot 34AR
and shall be binding upon any person acquiring said lot, whether in fee, by lease or otherwise.
The restrictions contained in herein may not be amended without written consent of the Owner
for so long as the Owner owns an interest in the Property, and thereafter the unanimous consent
of the owners of the Property as reflected on the Plat, as may be hereafter amended or modified.
These covenants and restrictions are to run with the land and shall be binding on all
parties and all persons claiming from the date these covenants and restrictions are recorded, after
which time said covenants and restrictions shall be automatically extended for successive periods
of twenty (20) years, unless an instrument signed by the Owner (if still an owner of any portion
of the Property) or, if not, the then owners of all of the Property shown on the Plat has been
recorded, agreeing to change said covenants and restrictions in whole or in part.
These covenants and restrictions shall not be amended, canceled or supplemented unless
an instrument signed by the Owner (if still an owner of any portion of the Property) or, if not, the
then owners of all of the Property shown on the Plat is placed on record agreeing to change the
covenants and restrictions in whole or in part, and any change must be approved by the Little
Rock Planning Commission.
In the event of any attempt to violate any of the covenants or restrictions herein, before
the expiration date hereof, it shall be lawful for any person or persons owning a lot or lots in said
addition to prosecute any proceedings at law or in equity against the person or persons violating
or attempting to violate any such covenant or restriction, and either to prevent him or them from
so doing or to recover damages or other dues for such violation.
The invalidation of any one of these covenants or restrictions by judgment or court order
shall in no wise affect any of the other provisions, which shall remain in full force and effect.
The filing of this Bill of Assurance and the Plat for record in the office of the Circuit
Clerk and Ex-Officio Recorder of Pulaski County, Arkansas shall be a valid and complete
delivery and dedication of the streets and easements subject to the limitations herein.

Basically, the existing home burned down. Builder went to get building permit, City of LR said he had to
re -plat it.
