This applicant files this application for a building line
variance for purposes of creating a more buildable lot size
around the cul-de-sac at the end of this street. Several of the
lots in the area of this cul-de-sac have unique boundaries with
compound turns on the sides and rear. This creates a problem
with respect to buildability on the lot for a house.
STAFF COMMENT/RECOMMENDATION:
Staff has reviewed this proposal and agrees with the developer
that these lots are somewhat shallow and have erratic property
lines, which warrant the reduction of the building line to
15 feet. They will maintain the minimum side yard spacing.
Planning staff has recommended to the engineer on the project
that the building lines not be parallel to the arc of the
cul-de-sac right-of-way, but placed in a straight line across the
lots with the nearer point to the street being 15 feet. This
will provide a better alignment for placement of the front of the
structure and for location by the building contractor.
SUBDIVISION COMMITTEE COMMENT: (JANUARY 7, 1993)
Mr. Ron Tyne and Mr. Joe White were present representing this
request. There was a brief discussion of the issues. The
developer indicated that he could make the adjustment on the
plan. Mr. White indicated that it would be no problem to have a
straight building setback line on these lots, and that he would
provide a revised drawing.
After a brief discussion, the Committee forwarded this item to
the full Commission for resolution.

PLANNING COMMISSION ACTION: (JANUARY 26, 1993)
The staff presented its recommendation of approval stating there
were no continuing issues associated with this request. After a
brief discussion, the Commission determined to place this item on
the Consent Agenda for approval. A motion to that effect was
made. The motion passed by a vote of 10 ayes, 0 nays and
1 absent.

AN ORDINANCE AMENDING CHAPTER 31 OF THE
CODE OF ORDINANCES OF THE CITY OF LITTLE
ROCK, ARKANSAS PROVIDING FOR A VARIANCE OF
BUILDING SETBACK LINE REQUIREMENTS FOR ST.
CHARLES SUBDIVISION AT THE NORTH END OF
CHALMETTE COURT (S-65-pp)
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That Chapter 31, Section 31-314 of the Code
of Ordinances be amended to provide for a variance of
certain requirements within the Subdivision Regulations of
the City of Little Rock for St. Charles Subdivision, Lots
259-263 as follows:
Subsection a. That Chapter 31, Section 31-314 be
amended for purposes of reducing the 25 foot front building
line from 25 feet to 15 feet beginning at the NE corner of
Lot 259 and running around the cul-de-sac to Lot 263.
SECTION 2. This ordinance shall take effect thirty
(30) days from and after its passage.
