This will not affect our telephone plant and we do not have any objection to the replat which will only show the smaller easement. Sincerely yours, Network Supervisor Outside Plant Engineer AMENDMENT TO BILL OF ASSURANCE KNOW ALL MEN BY THESE PRESENTS: THAT, WHEREAS, Jett Ricks and his wife George Ann, (hereinafter called "Allotter") are the owners of Lot 79, ST. CHARLES ADDITION to the City of Little Rock, Arkansas, as reflected by the plat for said subdivision appearing as plat A-254 and A-255 in the office of the Recorder for Pulaski County, Arkansas, and as subjected to restrictions and covenants contained in a Bill of Assurance dated June 12, 1979, bearing instrument number 79-24454 in said Recorder's office; and, WHEREAS, it is advisable that said Lot 79, ST. CHARLES ADDITION to the City of Little Rock, Arkansas, be now replatted and resubdivided as shown on the attached plat filed herewith, in order to enhance the value of said property; NOW, THEREFORE, the Allotter, for and in consideration of the benefits to accrue to it, its successors and assigns, has caused to be made a plat, filed herewith, showing a survey made by Edward G. Smith, dated May 27, 1980, and bear- ing a Certificate of Approval executed by the Little Rock Planning Commission, and showing the bounds and dimensions of the property now being replatted and re - subdivided. The lands embraced in said plat filed herewith shall be forever known as: "Lot 79R, ST. CHARLES ADDITION being a replat of Lot 79, ST. CHARLES ADDITION to the City of Little Rock, Arkansas; and any and every deed or conveyance of said Lot 79R describing the same by the number and letter shown on said plat filed herewith shall always be deemed a sufficient description thereof. Said Lot 79R shall be held, owned and conveyed subject to,•and in confor- mity with, all of the restrictions and covenants contained in the aforesaid Bill of Assurance dated June 12, 1979, except that the West utility easement set forth in said Bill of Assurance and plat filed in conjunction therewith is hereby cancel- led and hereby substituted therefor is the West utility easement shown on the plat filed herewith.
