By the signature of the said surveyor and the said grantors and bears a Certificate of Approval executed by the Little Rock Planning Commission and is on ecord in the Office of Circuit Clerk and ex-officio Recorder of Pulaski County, Arkansas as Instrument No. and the grantors do hereby make this Bill of Assurance. The grantors do hereby certify that they platted said real estate in accordance with said Plat. The lands embraced in said plat shall be forever known as designated on said plat and every deed of conveyance for said property shall use this designation. The purpose of this plat is to make one lot out of multiple lots. All Buildings and structures constructed on said property shall conform to the rules and regulations of the City of Little Rock, Arkansas. The filing of this Bill of Assurance and plat for record in the Office of the Circuit Clerk and ex-officio Recorder of Pulaski County shall be valid and complete delivery and dedication of the streets and easements shown on the said plat. Arch Street Little Rock, AR 72206 Dear Ms. Toro: Thank you for your inquiry regarding subdivision of the parcel of land located at the northwest comer of South Main Street and West Daisy Bates Drive, commonly known as 1318 and 1324 S. Main, into three new parcels: one encompassing the structure known as 1318 Main, another encompassing the structure known as1324 Main (and including the adjoining parking lot to the south), and the third encompassing the vacant parking area behind (west o fl 1324. As you may know, parking as a principle use is normally prohibited in the Capitol Zoning District's Mansion Area, though off- street parking associated with another principle use is usually required. In our conversation on January 31, you indicated a willingness to include a deed restriction with the third parcel designating it as a permanent parking area for approved uses at either 1318 or 1324 Main. It is our opinion that, contingent on the inclusion of such a deed restriction, the proposed re - platting will not serve to increase the non -conformity of any of the resulting new parcels. As you may also know, the Capitol Zoning District Commission has traditionally declined to exercise its authority over the subdivision and platting of land. In fact, our agency's Rule states in Section 2-104 (C): in areas where the Commission has chosen not to exercise its authority, such as platting and subdivision of property, the ordinances of the City of Little Rock are controlling. And again in Section 2-111, it states: ... unless specifically dealt with as provisions of this Master Plan, all other regulations, requirements and codes of the city of Little Rock shall continue to be in force in the Capitol Zoning District ... So while our agency does not object to your proposed subdivision, we must refer you to the City of Little Rock's Department of Planning and Development to obtain approval. Best Wishes, I Boyd I.
