3 AN ORDINANCE TO ABANDON THE NORTH /SOUTH 12- FOOT -WIDE
4 ALLEY RIGHT -OF -WAY (12 FEET BY 300 FEET), LOCATED WITHIN BLOCK
5 169, ORIGINAL CITY OF LITTLE ROCK, BOUNDED BY WEST 12TH, WEST
6 13TH, CENTER AND LOUISIANA STREETS, IN THE CITY OF LITTLE ROCK;
7 AND FOR OTHER PURPOSES.

9 WHEREAS, a request was made to vacate and abandon the North /South 12-foot-
10 wide alley right -of -way (12 feet by 300 feet) located within Block 169, Original City of
11 Little Rock, bounded by West 12th, West 13th, Center and Louisiana Streets, pursuant to
12 the City's general police power authority under Ark. Code Ann. § 14 -54 -104; and
13 WHEREAS, the Board has determined that the abandoning of this public right -
14 of -way will not have an adverse impact on the adjacent property owners nor the local
15 traffic, and therefore, the right -of -way abandoned by this ordinance is no longer
16 needed for corporate purposes, except as otherwise noted below;
17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
18 OF LITTLE ROCK, ARKANSAS:
19 Section 1. The Board of Directors hereby releases, vacates, and abandons the
20 North /South 1 2- foot -wide alley right -of -way (12 feet by 300 feet) located within Block
21 169, Original City of Little Rock, bounded by West 12th, West 13th, Center and Louisiana
22 Streets.
23 Section 2. The City specifically reserves the public utility easements within the
24 former right -of -way.

I Section 3. A copy of this ordinance duly certified by the City Clerk, shall be
2 filed in the real estate records of the recorder of the Circuit Clerk in ex officio recorder
3 of Pulaski County, Arkansas.
4 Section 4. Severability. In the event any title, section, paragraph, item,
5 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be
6 invalid or unconstitutional, such declaration or adjudication shall not affect the
7 remaining portions of the ordinance which shall remain in full force and effect as if the
8 portion so declared or adjudged to be invalid or unconstitutional was not originally a
9 part of the ordinance.
10 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same
11 that are inconsistent with the provisions of this ordinance are hereby repealed to the
12 extent of such inconsistency.
