WHEREAS, the Declarant is the owner of the lands now known as:
Proposed Lot 1 Barrett Subdivision lying in the Southeast Quarter of the Southeast Quarter of
Section 2, Township 1 South, Range 13 West, Little Rock, Pulaski County, Arkansas, more
particularly described as follows:
Commencing at a Found cotton picker spindle at the Southeast Corner of the Southeast Quarter
of the Southeast Quarter of said Section 2 thence along the South line of the said Southeast
Quarter of the Southeast Quarter North 88 degrees 21 minutes 18 seconds West 138.84 feet;
thence leaving said South line North 01 degrees 38 minutes 42 seconds East 45.08 feet to a point
on the North Right of Way of Mabelvale Cut-off; which is also the point of beginning; thence
along said Right of Way North 88 degrees 15 minutes 42 seconds West 34.85 feet; thence South
89 degrees 19 minutes 15 seconds West 94.94 feet; thence leaving said Right of Way North 02
degrees 07 minutes 56 seconds East 295.01 feet; thence South 88 degrees 30 minutes 05 seconds
East 95.08 feet; thence South 88 degrees 28 minutes 02 seconds East 132.67 feet to a point on
the West Right of Way of Chicot road; thence along said Right of Way South 02 degrees 26
minutes 48 seconds West 205.21 feet; thence South 23 degrees 27 minutes 38 seconds West
40.65 feet; thence along a curve to the right 41.24 feet having a radius of 50.00 feet and a chord
bearing and distance of South 47 degrees 05 minutes 12 seconds West 40.08 feet; thence South
70 degrees 42 minutes 46 seconds West 57.83 feet to the point of beginning containing 1.467
Acres more or less.
all of which said property lies in the County of Pulaski, State of Arkansas, and it is deemed
desirable that said property be now divided into one lot as shown on the attached Plat, and that
said property be held, owned and conveyed subject to the covenants and easements herein

NOW THEREFORE, the Declarant, for and in consideration of the benefits to accrue to them,
which benefits it acknowledges to be of value, has caused to be made a Plat of Barrett
Subdivision, Little Rock, Pulaski County, Arkansas, hereto attached, signed by Robert D.
Holloway, Registered Land Surveyor, and said Declarant, and bearing a certificate of approval
executed by the Little Rock Planning Commission, and recorded simultaneously herewith at Plat
Book , Page , of the records of the Recorder of Pulaski County, Arkansas, said Plat
being fully incorporated herein by reference (as now or hereafter amended, the "Plat") and
showing the boundaries and dimensions of the property now being subdivided into lots and
easements; There are shown on the Plat certain easements for utilities, and certain easements
solely for drainage, which Declarant hereby expressly reserves to Declarant, its designees,
successors and assigns, for the erection, installation, construction and maintenance of poles,
wires, lines and conduits, and the necessary or proper attachments in connection with the
transmission of electricity, telephone, community antenna television cables and other utilities
and other similar facilities; and storm -water drains, land drains, public and private sewers,
pipelines for supplying gas, water and heat, and for any other public or quasi -public utility
facility, service or function, whether above ground or underground and for slope control
purposes, including the right to grade and plant slopes and prevent the doing of any activity
which might interfere with slope ratios approved by Declarant, its successors and assigns, or
which might create erosion or sliding problems, or change, obstruct, or retard drainage flow.
The utility easements shall also be subject to use by the owners of abutting tracts for the sole
purpose of installing and maintaining such underground electric and telephone service
conductors as may be necessary to connect the service line of the owners to the service pedestals
installed by the utilities.
The filing of this Plat and Bill of Assurance for record in the office of the Circuit Clerk and Ex-
Officio Recorder of Pulaski County, Arkansas, will be a valid and complete delivery and
dedication of the easements subject to the limitations herein set out.
All of the lands embraced in the Plat shall be forever knows as "Barrett Subdivision, Little Rock,
Pulaski County, Arkansas" and any and every deed of conveyance describing the same by the
letter of the alphabet and numerals shown on the Plat of Barrett Subdivision, Little Rock, Pulaski
County, Arkansas, shall always be deemed sufficient description thereof.
The land herein platted and any interest therein shall be held, owned and conveyed subject to and
in conformity with the following covenants which, subject to being amended or cancelled as
hereinafter provided, with the exception of paragraph two (2) which shall be perpetual, shall be
and remain in full force and effect for a period of Thirty (30) years from the date of recordation
hereof, to wit:
1. Land Use and Building Type. The tract herein platted shall be held, owned and
used only of commercial purposes. However, nothing contained herein shall prohibit any
occupation or activity in any building, which is otherwise permitted by the zoning regulations or
the Ordinances of the City of Little Rock, Arkansas.
2. Utility Easement Area. Easements are hereby expressly reserved to Declarant, its
designees, successors and assigns, is, on, over and under the Utility Easement Area, as
hereinafter defined, or each lot or tract for the following purposes: for the erection, installation,
construction and maintenance of poles, lines and conduits, and the necessary or proper
attachments in connection with the transmission of electricity, telephone, community antenna
television cable and other utilities and other similar facilities; and storm -water drains, land
drains, public and private sewers, pipe lines for supplying gas, water and hear, and for any other
public or Quasi -public utility, service or function, whether above ground or underground; and for
slope control purposes, including the right to grade and plant slopes and prevent the doing of any
activity which might interfere with slope ratios approved by Declarant, its successors and
assigns, or which might create erosion or sliding problems, or change, obstruct, or retard
drainage flow. Declarant and its agents, successors and assigns, after reasonable notice has been
given, shall have the right at reasonable times to enter upon all parts of the easement areas of
each lot for any of the purposes for which the easements are reserved. The term "Utility
Easement Area" as used herein, shall mean and refer to those areas on each lot or tract with
respect to which easements are shown for utility easement, sewer easements or water line
easement. No trees, incinerators, structures, buildings, pavement, or similar improvements, shall
be grown, built or maintained within the area of Utility Easement Area. No excavations within
the Utility Easement Area for the erection of any fences (wood, wire, stone or brick) of for any
other purposes shall be made which would interfere with the installation, maintenance, repair and
replacement of any utility service. In the event any such trees, incinerators, structures, buildings,
fences, pavement or similar improvements shall be grown, built or maintained with the Utility
Easement Area, not utility will be liable for the destruction of the same in the installation,
maintenance, repair or replacement of any utility service located within the Utility Easement
Area.
3. Nuisance. No lot or tract shall be used for any purpose or business which is
dangerous or unsafe, or which constitutes a nuisance.
4. Building Lines. No building shall be constructed other than within the building lines
as designated on the Plat or the zoning regulations of the City of Little Rock, Arkansas.
All provisions of the previous Bills of Assurance and property related documents will be adhered
to as they apply to this Platted property.
IN WITNESS WHEREOF, Max Alley Investments, LLC does hereby set his hand and seal on
this Bill of Assurance.
