WHEREAS, on or about March 25, 2011, Montagne Development
LLC, an Arkansas Limited Liability Company ("Developer'), caused to be
filed in the Real Estate Records of Pulaski County, Arkansas, as
Instrument Number 2011018358, a Declaration of Covenants, Conditions,
and Restrictions for Valley View Court, the "Original Declaration," and in
conjunction therewith filed a Plat as Instrument No. 20110183598, laying
out Lots 1 — 7 and 24 — 30 of Valley View Court (the "Original Plat");
WHEREAS, on or about April 20, 2011, Montagne Development
LLC, an Arkansas Limited Liability Company ("Developer"), caused to be
filed in the Real Estate Records of Pulaski County, Arkansas, as
Instrument No. 2011023277, a Declaration of Covenants, Conditions, and
Restrictions for Valley View Court, the "Amended and Restated
Declaration";
WHEREAS, the Original Declaration attached as a property
description of the entire subdivision (the "Subdivision") intended by the
Developer to be governed by the covenants, conditions, and restrictions,

WHEREAS, the Amended and Restated Declaration attached as its
property description only the portion of the Subdivision covered by the
Original Plat being platted in the First Phase of the property description of
which was attached thereto ("Phase I");
WHEREAS, the filing of both the Original Declaration and the
Amended and Restated Declaration had created confusion as to the
Developer's intention, which intention the Developer wished to clarify,
and also to replat Lots 5, 6, and 7 into Lots 5R, 6R, 7R, 24R, 25R, 26R,
which caused him to file a Clarification and Amended Declaration as
Instrument No. 2011048316, including as Exhibit "A" a description of the
entire subdivision and Exhibit "B" a description of Phase I.
WHEREAS, the Developer now wishes to plat Lots 8 - 23 and 35 -
42 as Phase 11 of the Subdivision and to reaffirm that those lots in Phase 1I
are subject to the Restrictions and Covenants noted above and to make the
dedications called for in the Plat filed herewith.
NOW THEREFORE, Developer states and affirms that his intention
is to develop a residential neighborhood governed by a common scheme
of development, as set forth in the covenants, conditions, and restrictions
set out in Instrument Nos. 2011018358, 2011023277, and 2011048316 over
the entire Subdivision described on Exhibit 'A" and in furtherance
thereof, has now platted Phase II, a portion of the Subdivision as Lots 8 --
20 and 35-42, covering the property described on Exhibit "B"; and
NOW THEREFORE, Developer also warrants and represents that it
has filed in conjunction with This Declaration a PIat as Instrument No.

in the real estate records of Pulaski County, platting
Lots 8-20 and 35-42 (the "Phase II Plat").
The lands described on the Phase II Plat and embraced in the Plat
shall be forever known as Lots 8 — 23 and 35 — 42, Valley View Court, an

and every deed of conveyance of each respective Lot describing the same
by such numerical character as shown on the Plat shall always be deemed
