BILL OF ASSURANCE
TO: The Public RE: Bennett-Heavner Addition )
WHEREAS, Gary Bennett, Pam Bennett and Action Process Services of
Arkansas, LLC, Loretta Foster Heavner, President are the sole owners of the following
described property to -wit:
Lot 31 Archview Terrance, Section "A", and part of the S W 1 /4 of the S W 1 /4, of
Section 9, T-1-S, R-12-W, Pulaski County, Arkansas, more particularly described as
follows: Commencing at the SW corner of said SW1/4, SW1/4, Section 9, thence S 89
deg 06 min 17 sec E 253.08 ft to the Northwest comer of said Lot 31, thence S 88 deg 54
min 30 sec E 234.82 ft to the West right-of-way of Arch Street Pike, thence N 29 deg 12
min 52 sec E along said right-of-way 158.77 ft, thence N 88 deg 51 min 01 sec W 140.33
ft, thence N 02 deg 03 min 30 sec E 208.66 ft, thence N 88 deg 51 min 33 sec W 419.20
ft to the West line of said SWIM, SW1/4, thence S 02 deg 11 min 36 sec W 350.09 ft
along said West line to the point of beginning, containing 4.286 acres more or less
AND WHEREAS, it is desirable that all of the above described property be
platted into two lots.
NOW, THEREFORE, WITNESSETH:
That, Gary Bennett, Pam Bennett and Action Process Services of Arkansas, LLC,
Loretta Foster Heavner, President said owners, hereinafter termed grantors, has caused
said tract of land to be surveyed by Edward Lofton, Registered Professional Land
Surveyor, and a plat thereof made which is identified by the title, Bennett-Heavner
Addition, Pulaski County, Arkansas and the date November 2010 and by the signature of
the said surveyor, Gary Bennett, Pam Bennett and Loretta Foster Heavner said grantors,
and bears a Certificate of Approval executed by the Pulaski County Planning
Commission, and is on record in the Office of the Circuit Clerk and ex-officio Recorder
of Pulaski County, Arkansas, in Plat Book Page_ _ _and grantors do
hereby make this Bill of Assurance.
The grantors do hereby certify that they have platted said real estate in accordance
with said plat. The lands embraced in said plat shall be forever known as designated on
said plat, and every deed of conveyance for said property shall use this designation.
The filing of this Bill of Assurance and plat for record in the Office of the Circuit
Clerk and ex-offico Recorder of Pulaski County shall be valid and complete delivery and
dedication of the streets and easements shown on the said plat
The lots in said Addition shall be sold by the grantors and shall be purchased by
the buyers thereof subject to the following covenants, to -wit:
1. All buildings constructed on said lots shall be constructed no nearer to the
street than the building line shown on the plat.
2. All easements shown on plat shall be for utilities.
3. Right -of -Ways shown on Plat shall be considered conveyed to Pulaski County,
Arkansas by the filing of this Plat
These covenants and restrictions shall not be amended, cancelled or supplemented
unless an instrument signed by a majority of the owners of the aforesaid land is placed on
record agreeing to change the covenants and restrictions in whole or in part and any
change must be approved by the Pulaski County Planning Board
