WHEREAS, Calvin Hagan and Betsy Hagan, his wife, are the owners of the following
described real property situated in Pulaski County, Arkansas, to -wit:
Part of the Northwest Quarter of the Northwest Quarter (NW'/4 NW'/4) and part of
the Southwest Quarter of the Northwest Quarter (SW'/4 NW'/4) of Section One (1),
Township One (1) North, Range Fourteen (14) West, Pulaski County, Arkansas, and
more particularly described as follows: Commencing at the Northwest corner of
said Section One (1); thence South 01' 30' 51" West 1004.03 feet to the POINT
OF BEGINNING; Thence South 89' 07' 00" East for 401.25 feet to a point on the
West right-of-way line of Edswood Road; thence South 01' 40' 53" West along said
West right-of-way line 344.16 feet to a point on the South line of said Northwest
Quarter of the Northwest Quarter (NW'/4 NW%4); thence South 01' 56' 58" West for
218.46 feet; thence North 89' 15' 26" West for 398.80 feet to a point on the West
line of said Section One (1); thence North 01' 37' 49" East along said West line for
218.47 feet to the Northwest corner of said Southwest Quarter of the Northwest
Quarter (SW'/4 NW'/a); thence North 01' 28' 27" East continuing along said West
line for 345.09 feet to the POINT OF BEGINNING, containing 5.1721 acres, more
or less.
WHEREAS, Calvin Hagan and Betsy Hagan, his wife, have caused the above described
real property to be surveyed and a plat made dividing said property into lots and streets for the
purpose of making said property into a subdivision to be known as HAGAN ADDITION. The
plat of said subdivision has been recorded in the Recorder's Office of Pulaski County, Arkansas
in Book , Page of the Pulaski County Deed Records.
NOW, THEREFORE, Calvin Hagan and Betsy Hagan, his wife, the owners of the above
described real property, hereby designate said property as shown by said plat as HAGAN
ADDITION to Pulaski County, Arkansas. Hereafter any conveyance by the owners of said land
shall reflect the Lot numbers as the legal description for the property being conveyed. The streets
as shown on said plat are hereby dedicated as public streets for the use and benefit of the public
as such.
The use of the property as shown on the plat and contained in said HAGAN ADDITION
shall hereafter be subject to the following covenants:
1. ARCHITECTURAL CONTROL: There is established an Architectural Control
Committee (hereafter referred to as the "Committee"), which shall be initially composed of
Calvin Hagan and Betsy Hagan, who by their signatures hereto accept appointment to the
committee. The number of Committee members may be amended by a vote of a majority of the
active committee members. The Committee members shall appoint a Chairman by a vote of a
majority of the active committee members. The Chairman shall call meetings of the Committee
when any proposed plans of a property owner are submitted to the committee for approval, or
when any property owner shall ask to be heard on an issue concerning the addition. The
Chairman shall notify members of the Committee of the time and place of any meetings no later
than ten (10) days prior to the meeting by mail sent to the residence address of the Committee
member. The Committee members shall serve until they resign or become inactive. A member is
considered inactive if he fails to attend two called meetings of the Committee. The remaining
members shall determine if a member is inactive, and may then vote to remove that member from
the Committee. The remaining members may then appoint a successor to serve on the Coirnnittee.
All floor plans, elevations, specifications, plot plan showing the orientation of any structure,
driveway and sidewalks, contractor, and proposed materials and colors must be submitted to and
approved by the Committee prior to starting construction. The Committee will have 10 business
days to approve the project or require modifications. The Committee again will have 10 business
days to respond each time documents, or revisions, are submitted. Once construction commences,
revisions are discouraged, and must be approved by the Committee. The Committee will keep in
its file the original plans and specs as reference material. Submitted documents will not be
returned to the applicant.
Post occupancy, any modification of the exterior of the home must be approved by the
Committee, including any color changes. Such plans and specifications shall include exterior
designs, height, building materials, color scheme, roofing and plot plan layout showing location
of all structures, drives, walks, etc.
The committee shall exercise its best judgment to see that all structures and
improvements conform to and harmonize with the original use and intent of the subdivision, and
with existing dwellings and structures in place in the subdivision. Protection of land use,
environmental concerns, and overall quality of the neighborhood development shall guide all
decisions. The decision of the committee concerning any issues contained herein shall be final.

The committee members shall serve without compensation, and shall not be liable in damages to
anyone for any actions taken or for failure to act in any way.
With the exception of the initial dwelling and plot plans, if building plans submitted to
the committee are not approved or disapproved in writing within 30 days following the date on
which the plans are submitted to the committee for approval, or if no injunction or other legal
action shall have been commenced prior to completion of the work, then proper approval of the
plans and specifications and plot plans shall be conclusively presumed to have been obtained.
Any proposed modification to these covenants shall be submitted in writing to all
property owners for review. A meeting of the property owners shall then be held within 30 days,
at which time a vote may be taken on the modifications. These covenants may only be modified
by a written consent of the majority of the property owners at the time such modifications are
proposed. Any modification will then be placed on record in the Office of the Recorder of Pulaski
County, Arkansas. For purposes of determining a majority of the property owners, the owners
shall have one vote for each lot they own.
2. DWELLING: The real property described herein shall be used exclusively for
single-family residential purposes. Construction shall be limited to one detached single-family
unit containing at least 2,500 square feet of living area under roof, not including porches and
garages. The dwelling shall contain, and shall have at least a double carport that shall be attached
to the dwelling and shall have dimensions of at least twenty (20) feet by twenty (20) feet.
3. BUILDING MATERIALS: The dwelling shall be constructed of predominately
brick, stone, masonry or stucco, but may contain vinyl siding for the eaves, windows and trim. No
wood shall be used for the exterior parts of the house. Whichever material is used on the front of
a building must wrap all exposed sides of the building. Where stucco type materials are used, they
shall have a background color and a complementary trim color to include banding and windows.
Stucco shall have full trim detailing, raised a minimum of 1" from the background. Sand, smooth,
or scratch finishes are acceptable.
All structures constructed on the property must use tile, wood shake or 30-year
composition architectural shingles for the roof, and must have a minimum of a 4/12 pitch.
Acceptable or prohibited materials for the roof are as follows:

• Standing seam metal
• Copper
• Slate or approved synthetic slate
• Membrane or built-up (for flat roof)

• Terracotta or cement tile
• Cedar shakes
Prohibited Materials
• Corrugated metal.
• Agricultural grade metal
• Flat or rolled asphalt or fiberglass shingles
4. BUILDING LOCATION: The building front set back line shall be a minimum
of fifty (50) feet from the front property line.
5. OUTBUILDINGS: Two additional outbuildings or garages may be constructed.
Any detached outbuilding or garage shall meet all building line requirements, and shall be to the
rear of the dwelling. The additional structures shall be of the same appearance, type and style of
construction as the main dwelling.
6. TEMPORARY STRUCTURES: No trailer, tent, shacl<, garage, barn,
recreational vehicle, mobile home, or other outbuilding shall be placed, constructed, erected or
allowed to remain on a lot if it is being used for human habitation either temporarily or
permanently, except that trailers, recreational vehicles or other temporary type residences may be
moved onto the property to be used by the owners during construction of the residence.
7. ANIMALS: No animals, other than household pets, shall reside on the property.
Household pets may not be raised or bred for commercial purposes. Household pets shall not
include animals normally considered to be livestock, such as cows, horses, goats, sheep, chickens,
ducks, etc. Animals shall be kept in such a manner that they do not constitute a nuisance to other
lot owners.
8. LOT MAINTENANCE: Lots shall be maintained in a clean and sanitary
condition. Grass shall be mowed regularly, and the lawns and landscaping shall be maintained in
a neat and clean manner at all times. No trash, junk cars or other unsightly articles shall be
allowed to accumulate on the lot. All trash containers, boats, recreational vehicles, trailers and
other objects of such type shall not be located so as to be seen from the front. No signs of any
kind shall be displayed for public view except campaign signs during elections, and one sign of
not more than five (5) square feet advertising the property for sale. No noxious, loud or offensive
activity shall be carried on that may be, or become, an annoyance or nuisance to the
neighborhood. Trash containers may be placed on the street on trash pickup days only.
9. EASEMENTS: Easements for installation and maintenance of utilities and
drainage facilities are reserved as shown on the recorded plat and along the rights of way of the
public streets. No structures, planting or other materials shall be placed within these easements, or
permitted to remain, which may damage or interfere with the installation and maintenance of
al
utilities, or which obstruct or retard the flow of water through drainage channels in the easements.
Utility companies shall have the right to maintain the easements, including cutting grass, digging
out ditches, and cutting trees or limbs either in the easement or hanging over the easement.
10. PERMISSIBLE LOT USE: No part of any lot shall ever be used or caused to be
used or allowed or authorized in any way, directly or indirectly, for any commercial,
manufacturing, mercantile, storing, vending or other such nonresidential purpose. However,
working from home is acceptable so long as customers, employees, or other people associated
with the work do not visit the home except on an occasional basis.
11. STORAGE OF AUTOMOBILES BOATS TRAILERS OTHER VEHICLES
AND EQUIPMENT: No automobiles, boats, trailers, motor homes, campers, recreational
vehicles, motorcycles, buses, inoperative vehicles of any kind, cap rigs off trucks, or boat rigging
shall be parked or stored permanently or semi -permanently on any public street right-of-way,
yard area, or on driveways. For the purposes of these covenants, the phrase "semi -permanent"
shall be defined as remaining on or about the same lot without offsite relocation for forty-eight or
more consecutive hours. No eighteen wheel vehicles or any other vehicle requiring a commercial
driver's license may be parked on any public or private street or any portion of any lot except to
deliver merchandise or materials to residents or construction sites.
12. VISUAL SCREENING: All clotheslines, equipment, garbage cans, refuse
containers, storage piles, and household projects such as equipment repair shall be screened by
fencing, so as to conceal them from view of neighboring lots or streets. All rubbish, trash, and
garbage shall be kept in sanitary refuse containers with tightly fitting lids and shall be regularly
removed from the lot and not allowed to accumulate thereon. No above -ground swimming pools
shall be permitted. In -ground pools are permitted, however, the pool and deck design shall first be
approved by the Committee, and the pool must be completely fenced in a manner approved by the
Committee.
13. FENCES: Fencing of the front yard is prohibited, other than decorative fences
or landscape walls, not to exceed thirty-two inches above finished grade. No fence shall be
erected that is closer to the street than five feet behind the front main fagade. No fence shall be
erected on an adjoining side street that is closer to the street than two feet behind the interior edge
of the sidewalk. Wire fencing (including chainlink) is not permitted. Chain link may be used for
dog pens, but the pen must be contained within a fenced -in back yard. All wood privacy fences
shall have the good side turned toward the outside of the lot. That is, the framework that supports
the fence is to be facing inward toward the private yard. No privacy fencing shall exceed six feet
in height unless a variance is requested and granted by the Committee. Any fencing, walls, or

landscape walls located between the street and structure must be constructed of brick, stone, iron,
or wood (picket type); complementary of the structure, and must be approved by the Committee.
14. SATELLITE DISHES: All satellite dishes are limited to eighteen inches in
diameter and shall be placed to the rear of the residence, no closer to side yard than the rear of the
house.
15. HEATING AND COOLING DEVICES: No structure on any Lot shall be
permitted to have a heating or cooling device located in a window or any other opening which
can be viewed from a street, alley, adjoining Lots, or adjoining land owners. This restriction does
not apply during the construction of the structure. All other heating and cooling devices located
outdoors must be obscured by fencing, shrubbery, or other materials approved by the Committee.
16. CITY OF LITTLE ROCK REGULATIONS: The property within the addition is
within the extraterritorial jurisdiction of the City of Little Rock, Arkansas, and is thus subject to
the zoning and subdivision regulations of the City of Little Rock, Arkansas. If any of the
covenants contained herein shall be deemed to violate the zoning and subdivision regulations of
the City of Little Rock, Arkansas, then the City of Little Rock, Arkansas regulations shall govern.
Lot owners are on notice that the City of Little Rock, Arkansas may, at some point, elect to annex
this property into the city limits of the City. In this event, the lots and subdivision may be subject
to additional requirements of the City of Little Rock, Arkansas.
17. MALLARD POINT COVE: Lots One (1) and Two (2) of said Addition are
bordered on the south of the lot by Mallard Point Cove, a private drive that is shared with other
property owners to the West of this Addition, and which road is the access to these two lots. The
owners of Lots One (1) and Two (2) shall, in conjunction with the other property owners West of
the Addition, be responsible for the normal maintenance and upkeep to said road as needed and as
agreed to by all property owners. In addition, any person constructing a home or other
improvements to their property that requires heavy trucks and equipment to use Mallard Point
Cove to access their property shall be solely responsible to repair any damages caused to Mallard
Point Cove by any such trucks or equipment. Any such damage shall be repaired within 30 days
after construction requiring the use of heavy trucks and equipment on said road is completed.
18. EDSWOOD ROAD: The City of Little Rock, Arkansas required Calvin and
Betsty Hagan to deposit with the City the sum of $40,000.00, which sums may be used by the
City if the City elects to widen Edswood Road, otherwise to be returned to them if the widening
project is not commenced within ten years. Upon purchasing any lot in this addition, each owner
shall pay to Calvin Hagan and Betsy Hagan the sum of $8,000.00, representing their pro-rata
share of the $40,000.00 deposited with the City by Calvin Hagan and Betsy Hagan. If the City of

Little Rock, Arkansas does not begin the widening project within this ten year period, and if the
City of Little Rock agrees to return the money according to the agreement that Calvin Hagan and
Betsy Hagan have with the City of Little Rock, then each lot owner shall be reimbursed their
$8,000.00 deposit, plus the pro-rata share of any interest that the City may pay on this money. If
the City pays interest on this money, then the pro-rata share of the interest shall be attributable to
each lot owner for tax purposes.
17. COVENANTS RUNNING WITH LAND: These covenants are to run with the
land and shall be binding on all parties and all claiming under them. Enforcement shall be by
proceedings in law or in equity against any person violating or attempting to violate any covenant
either to restrain violation or recover damages, and shall be binding upon all parties and all
persons claiming under them for twenty-five (25) years, at which time said covenants and
restrictions shall automatically be extended for successive periods of ten (10) years from each
termination, unless 70% of the then owners of the lots agree in writing to amend said covenants
and restrictions, either in a whole or in part.
18. SEVERABILITY: If any of the covenants contained herein shall be determined
to be invalid by any judgment or court order, the remaining covenants shall remain in full force
and effect.

Thank you for your letter dated August 29, 2011, which I received yesterday.
Please do not misunderstand what I stated in my first letter to you. While we are
not authorized to provide legal opinions to private citizens, that fact does not mean that it
is inappropriate for any citizen to ask for help from our office or for a board member to
ask us to respond to a letter.
As to the question you raised about not seeing any signs posted on the Hagan
property before the Planning Commission's consideration of the Hagan Addition
preliminary plat, there was and is no requirement for the posting of signage. Your letter
referred to the matter as a rezoning, but it was not a rezoning but a preliminary plat that
was applied for by Mr. Hagan and that was considered by the Planning Commission.
Signage is not required to be posted for plats under consideration, given that a plat, unlike
a rezoning, is not a change in the use of the property. I hope this clarifies the matter for
you.

I recently received your letter of August 11, 2011, along with a copy of a letter
dated July 15, 2011 that you sent to J.T. Ferstl, chair of the Little Rock Planning
Commission. Both letters address your concern with the approval of the preliminary plat
to the Hagan Addition to the City of Little Rock. The preliminary plat was approved at
the Planning Commission's meeting of January 27, 2011.
You state in your letter that you were not given notice of the January 27 hearing
and ask whether you have a legal right to a second hearing on the application for the
preliminary plat. I understand that you believe a second hearing is appropriate because
you did not receive a certified letter notifying you of the hearing. You also say that you
did not see a notice of the hearing published in the newspaper or a sign posted on the
property.
I must first advise you that our office is not authorized to issue legal opinions to
private citizens. We are charged with issuing opinions to members of the City Board of
Directors and to City departments when authorized by City Manager Bruce Moore. In an
effort to be helpful, I have consulted with the Department of Planning and Development
and determined that the applicant in this matter followed all the applicable notice
provisions required by Arkansas law and the bylaws of the Planning Commission. In
view of this fact, as the attorney who represents the Planning Commission, I have
concluded that the Commission acted properly in accord with the law and its own bylaws
when it approved the preliminary plat of Mr. Hagan's property.
At this point, the application has been acted on, a final plat approved and the
matter is concluded. I do not believe that a second Planning Commission hearing on the
subdivision of the Hagar property is required, or even possible, at this point.
