Whereas ER PARK AVENUE APARTMENTS SPE, LLC, a Delaware limited liability
company, and HELCO LOFTS, LLC, a Delaware limited liability company (collectively, the
"Grantors"), are the sole owners of the real property described as Lot 9, Strode Addition to the
City of Little Rock Arkansas as shown on the Plat of record as Instrument No. 2013051704 in
the records of Pulaski County, Arkansas, and Grantors desire to replat said lot.
NOW, THEREFORE, WITNESSETH:
That Grantors have caused said tract of land to be surveyed by Daniel W. Havner of White
Daters & Associates, Inc., Registered Land Surveyor No. 1542, and a plat thereof made which is
identified by the title Plat of Lot 9A and Lot 9B, Strode Addition, an addition the City of
Little Rock, Arkansas and the date , 2018, and by the signatures of the
said surveyor and the said Grantors and bears a Certificate of Final Approval executed by the
Little Rock Planning Commission, and is on record in the Office of the Circuit Clerk and ex-
ofcio Recorder of Pulaski County, Arkansas, as Instrument No.

The Grantors do hereby certify that they have replatted said real estate in accordance with said
plat. The lands embraced in said plat shall be forever known as designated on said plat; and
every deed of conveyance for said property shall use this designation.
This Bill of Assurance shall run for a period of ten (10) years and thereafter shall automatically
renew itself every ten (10) years unless amended or terminated by a majority of the property
owners of the lots in the subdivision.
All buildings constructed on said lots shall be constructed no nearer to the street than the
building line shown on the plat, and all buildings shall be constructed in conformance with the
Building Code and Zoning Ordinances of the City of Little Rock, Arkansas.

The filing of this Bill of Assurance and plat for record in the office of the Circuit Clerk and ex-
officio Recorder of Pulaski County shall be a valid and complete delivery and dedication of any
public streets and easement shown on the said plat and identified as being dedicated by said plat.
This Bill of Assurance shall supplement the Plat and Bill of Assurance of Final Plat for Lots 1 —
9, Strode Addition of record as Instrument No. 2013051703 in the records of Pulaski County,
Arkansas (the "Original BOA") to the extent the same is applicable to the real property herein
described, and nothing contained herein shall be deemed to have terminated or amended the
Original BOA in any respect.
