3 AN ORDINANCE TO ABANDON THE NORTH /SOUTH 20 -FOOT-
4 WIDE ALLEY RIGHT -OF -WAY LOCATED WITHIN BLOCK 202,
5 ORIGINAL CITY OF LITTLE ROCK (BLOCK BORDERED BY WEST
6 16th, WEST 17TH, BROADWAY AND SPRING STREETS, AS A
7 PUBLIC RIGHT -OF -WAY; AND FOR OTHER PURPOSES.

9 WHEREAS, a request was made to abandon the alley right -of -way located in
10 Block 202, Original City of Little Rock, (block bordered by West 16th, West 171h
11 Broadway and Spring Streets, pursuant to the City's general police power authority
12 under Ark. Code Ann. § 14 -54 -104;
13 WHEREAS, the Board has determined that the abandoning of this public right-
14 of -way will not have an adverse impact on the adjacent property owners nor the local
15 traffic, and therefore, the right -of -way abandoned by this ordinance is no longer needed
16 for corporate purposes, except as otherwise noted below.
17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
18 OF THE CITY OF LITTLE ROCK, ARKANSAS:
19 Section 1. The Board of Directors hereby releases, vacates, and abandons the
20 alley located in Block 202, Original City of Little Rock (block bordered by W. 1611,, W.
21 17th, Broadway and Springs Streets), together with the right of public in general, in the
22 City of Little Rock, Pulaski County, Arkansas.
23 Section 2. The City specifically reserves the public utility easements within the
24 former right -of -way.

I Section 3. A copy of this ordinance duly certified by the City Clerk, shall be
2 filed in the real estate records of the recorder of the Circuit Clerk in ex officio recorder
3 of Pulaski County, Arkansas.
4 Section 4. Severability. In the event any title, section, paragraph, item,
5 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
6 or unconstitutional, such declaration or adjudication shall not affect the remaining
7 portions of the ordinance which shall remain in full force and effect as if the portion so
8 declared or adjudged to be invalid or unconstitutional was not originally a part of the
9 ordinance.
10 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same
11 that are inconsistent with the provisions of this ordinance are hereby repealed to the
12 extent of such inconsistency.
