Dawson egal Deputy City Attorney RE: Access to Proposed Heights Addition DATE: 20 NOVEMBER 2009 Our office was asked by Planning and Development Department staff to interpret Section D107 of the International Fire Code to determine if the proposed Heights Addition subdivision will be allowed to take access to Southridge Drive. Facts A preliminary plat for the Heights Addition has been filed for the December 3, 2009 Planning Commission meeting. The plat is a single-family plat with no variance requests and is proposed with 30 residential lots on a new cul-de-sac street, Beau Rivage Drive. Beau Rivage Drive and the 30 dwelling units in the Heights Addition Subdivision are planned to connect to the City's street system through the public street of Southridge Drive, south of the Walton Heights Subdivision. Residents from the Walton Heights Neighborhood Association take the position that the new subdivision should not be allowed to access Southridge Drive since Southridge Drive is the access to the Walton Heights Subdivision, which consists of over 500 homes. One of the underlying general principles in the City's subdivision design standards is to ensure access to all property. Little Rock, Ark. Rev. Code "LRC" § 31-171(5) (1988). The City Code requires that "[t]he proposed street layout shall be appropriate for the type of development proposed and properly integrated with the street system in the area adjoining the subdivision." LRC § 31-201(b). In addition, the Code states: "All public streets within the subdivision shall be located, platted and dedicated to the city in accordance with the master street plan and the standards and procedures outlined in this chapter." LRC § 31-201(f). The City adopted the 2006 International Fire Code with 2006 Revisions and Appendices "A", "B", "C", "D", "E", "F", and "G" pursuant to Little Rock, Ark. Ord. No. 19,642 (November 21, OFFICE OF THE CITY ATTORNEY Memorandum to Tony Bozynski, Director, Planning & Development Department Re: Access to Proposed Heights Addition 20 NOVEMBER 2009: Page 2 of 3 2006), to be effective January 1, 2007. Section D102.1 of Appendix D of the 2006 International Fire Code, Fire Apparatus Access Roads, states that "[f]acilities, buildings or portions of buildings hereafter constructed shall be accessible to fire department apparatus by way of an approved fire apparatus access road with an asphalt, concrete or other approved driving surface capable of supporting the imposed load of fire apparatus weighing at least 75,000 pounds.... In addition, Section D107.1 states that, with certain specified exceptions, "[d]evelopments of one - or two-family dwellings where the number of dwelling units exceeds 30 shall be provided with separate and approved fire apparatus access roads and shall meet the requirements of Section D104.3. Section D104.3 provides for certain spacing of access roads, where two access roads are required. The Fire Department was asked to comment on the subdivision application and the departmental staff comment was only that fire hydrants will be required. Discussion The City Code clearly supports the provision of access to all property and the integration of new subdivisions with the street system in the area adjoining the subdivision. LRC § 31-171(5) and §31-201(b). The only public street that abuts the parcel to be developed is Southridge Drive, so at this point, the Heights Addition developer will have no choice, if the plat is approved, but to provide access from the lots in the subdivision to Southridge Drive. Appendix D of the 2006 International Fire Code mandates more than one access road for a development if it consists of more than 30 dwelling units, which the Heights Addition development does not. Fire apparatus access road is defined in the 2006 International Fire Code as: "A road that provides fire apparatus access from a fire station to a facility, building or portion thereof. This is a general term inclusive of all other terms such as fire lane, public street, private street, parking lot land and access roadway." There will be no more than 30 dwelling units on the cul-de-sac street of Beau Rivage Drive. The 2006 International Fire Code does not define "development" but the ordinary meaning of "development" applied to this situation indicates that it is the proposed subdivision of the Heights Addition that is at issue. Furthermore, the 2006 International Fire Code states that "[t]he construction and design provisions of this code shall apply to: 1. Structures, facilities and conditions arising after the adoption of the code. 2. Existing structures, facilities and conditions not legally in existence at the time of adoption of this code. Existing structures, facilities and conditions when identified in specific sections of this code. 4. Existing structures, facilities and conditions which, in the opinion of the fire code official, constitute a distinct hazard to life or property." (Emphasis supplied.) OFFICE OF THE CITY ATTORNEY Memorandum to Tony Bozynski, Director, Planning & Development Department Re: Access to Proposed Heights Addition 20 NOVEMBER 2009: Page 3 of 3 The Walton Heights Subdivision was in existence before the adoption of the 2006 International Fire Code, so the 2006 International Fire Code by its own terms precludes consideration of the Walton Heights Subdivision plus the Heights Addition as the development. The proposed Heights Addition subdivision conforms to the fire code requirement of having no more than 30 dwellings in the development on a single access road. The Fire Department correctly did not see the proposed Heights Addition development as contrary to the 2006 International Fire Code. All the buildings to be constructed in the development will be accessible to fire department apparatus by way of an approved fire apparatus access road and only one access road is required due to there being only 30 dwelling units in the development. This memorandum does not address any other subdivision issues that might be raised in connection with the Heights Addition preliminary plat. For the record, though, if the preliminary subdivision plat is within the use permitted by the zoning classification and the plat meets the minimum subdivision regulations of the City, according to the case of Richardson v. City of Little Rock, 295 Ark. 189, 747 S.W.2d 116 (Ark. 1988), the Planning Commission will have no discretion whatsoever but must approve the plat. The Planning Commission will be authorized and in fact required to determine whether the plat is in compliance with the City's established subdivision regulations, and once it complies, the Commission cannot substitute subjective thinking of its individual members in place of the objective requirements of the subdivision regulations. It is essentially no better than the one you rejected on September 3, 2009. There are too many lots, too small on very steep slopes. The entrance to the proposed development is at a hairpin curve where accidents are already all too common. The owner has every right to develop his property, but he must do so in a responsible manner. Fewer, larger lots with access to River Mountain Road would relieve the overburdened intersection at Cantrell and Southridge and would constitute "good" development. There are 464 homes in Walton Heights with only one way in or out. Since West Little Rock is Growing so fast, not only homes but businesses that also shopping centers According to a study conducted by the Arkansas Highway and Transportation Department, the traffic on Cantrell Road in the area of the exit from Walton Heights and the new Pleasant Ridge Shopping Center, the traffic grew 18% from 2003 to 2008. From 43,000 Average Daily to 51,000 Average Daily, In 2009, the number would be greater now.. There are 464 homes in Walton Heights at this time, and with the one entrance and exit it is difficult to enter Cantrell Road from Southridge Dr. when we receive a green light. Traffic is driving so fast, and many continue to drive through the RED light. If you are on Southridge and want to make a left turn onto Cantrell Road, it is not safe to move until you are sure that traffic on Cantrell will stop, even big trucks. They are so big and running so fast, that you must wait to keep from being hit. With the addition of the new subdivision that is planned, the problem will increase. I suggested that this new subdivision not make the problem greater than it is now, for the sake of the residents in Walton Heights and the residents in the new subdivision. I am not sure how many wrecks the Police work at this intersection, but it is plenty. I have seen the Fire Department several times out helping also. We have a great team at our Fire Department. For the SAFETY of the residents in Walton Heights and for the new residents that will occupy the new subdivision, that area should not exit on Southridge Drive, but exit on River Mountain Road. The traffic light at River Mountain and Rodney Parham Road would certainly make it safer for both subdivisions. The City of Little Rock and the State Highway Department should seriously consider this for the residents of both subdivisions.
