Provide notification of all property owners located within 200 feet of the site, complete with the certified abstract list, notice form with affidavit executed and proof of mailing. The notice must be mailed no later than July 8, 2009. The Office of Planning and Development must receive the proof of notice no later than July 17, 2009. 2. How long will the portable classroom buildings be in use? Provide a time line for permanent construction or removal of the portable buildings. Also provide the time frame proposed for the addition of the third and fourth buildings. 3. Once the two (2) additional portable buildings are located on the site how will drop- off function? How will parking be addressed? 4. The rear yard setback for the C-3, General Commercial Zoning District is twenty-five (25) feet. The site plan indicates the buildings set at sixteen (16) feet. This will require a variance. 5. Provide the floor area and building coverage proposed for each of the buildings in the general notes section of the site plan. 6. Provide details of any proposed signage including building signage and ground mounted signage. 7. Provide the enrolled and anticipated enrollment of the school. The students are to be broken down by grade, classrooms and number of students per classroom. Also provide the number of faculty and staff currently and anticipated for the school. Provide the number of vehicles/buses, if applicable. 8. Provide details of the use of the remainder of the site. 9. With the site development additional landscaping will be required. 10.The existing dumpster located adjacent to West 83rd Street must be screened per the current City ordinances. Variance[Waivers: A variance to allow a reduced rear yard setback. Section 36- 301(e)(3) Public Works Conditions: 1. Geyer Springs Road is classified on the Master Street Plan as a minor arterial. A dedication of right-of-way 45 feet from centerline will be required. Provide the centerline of Geyer Springs Road for determination of existing right-of-way. 2. Due to the proposed use of the property, the Master Street Plan specifies that 83rd Street for the frontage of this property must meet commercial street standards. Dedicate right-of-way to 30 feet from centerline. Provide the centerline of the right- of-way to determine the existing right-of-way. 3. A 20 foot radial dedication of right-of-way is required at the intersection of Geyer Item # 4. Springs Rd and 83d Street. 4. Sidewalks with appropriate handicap ramps are required to be constructed along 83d Street in accordance with Section 31-175 of the Little Rock Code and the Master Street Plan. 5. Repair or replace any curb and gutter or sidewalk that is damaged in the public right- of-way prior to occupancy. 6. Driveway and widths do not meet the traffic access and circulation requirements of Sections 30-43 and 31-210. The width of driveway must not exceed 36 feet. The driveway spacing requirement on Geyer Springs Road is 300 feet. The existing north driveway on Geyer Springs Road should be removed and curb installed due to its distance from the intersection. The two south driveways should be combined into one driveway. 7. Obtain a franchise agreement from Public Works (Bennie Nicolo, 371-4818) for the private improvements located in the right-of-way. Utilities and Fire Department/County Planning: Wastewater: Sewer available to this project. Entergy: No comment received. Center -Point Energy: No comment received. AT & T: No comment received. Central Arkansas Water: water meter(s) are required. Contact Central Arkansas Water if larger and/or additional Fire Department: Place fire hydrants per code. Contact the Little Rock Fire Department for additional information. County Planning: No comment. CATA: CATA Bus Routes 17 — the Mabelvale-Downtown and 17A — the Mabelvale- UALR routes are located adjacent to the site. Planning Division: No comment. Landscape: 1. All vehicular use areas will require landscaping at the time a building permit is issued to rehabilitate the site if the rehabilitation on the property exceeding fifty (50) percent of the current replacement cost. At such time fifty (50) percent of the existing vehicular use area must be brought into compliance with the landscape ordinance requirements and must continue to full compliance on a graduated scale based upon the percentage of rehabilitation cost. Any new paved area and/or vehicular use areas are required to comply with the typical landscape ordinance requirements. 2. Office uses must provide land use buffers only where abutting multifamily, duplex or single-family usage or zoning. All sites developed, modified or enlarged must Item # 4. provide a land use buffer(s) as follows: Side property lines at six (6) percent of the average width of the lot on both sides; Rear property lines at six (6) percent of the average depth of the lot; The minimum dimension is nine (9) feet in all instances; The maximum dimension required is fifty (50) feet in all instances. A land use buffer of 14.97 feet is required along the western perimeter. 3. Street buffers are required in all instances. All sites developed, modified or enlarged must provide street buffers as follows: All street property lines at six (6) percent of the average depth of the lot; The minimum dimension is one-half (1/2) the full width requirement but in no case less than nine (9) feet. The maximum dimension required is fifty (50) feet. A street buffer of 14.97 feet is required along Geyer Springs Road. Revised plat/plan: Submit four (4) copies of a revised preliminary plat/plan (to include the additional information as noted above) to staff on Wednesday, July 8, 2009. Item # 4. The applicant failed to provide proper notification to property owners as required by the Commission's By-laws. Staff recommends this item be deferred to the September 3, 2009, public hearing. PLANNING COMMISSION ACTION: (JULY 23, 2009) The applicant was present. There were no registered objectors present. Staff presented the item stating the applicant had failed to provide proper notification to property owners as required by the Commission's By-laws.
