BILL OF ASSURANCE;
KANIS/SHACKLEFORD SUBDIVISION OF
THE CITY OF LITTLE ROCK
WHEREAS, BancorpSouth Bank, a Mississippi State Bank authorized to do business in
Arkansas, is the sole owner of the real property described in Exhibit "A" attached hereto, and
desires to plat said property into lots:
NOW, THEREFORE, WITNESSETH:
That the said BancorpSouth Bank, hereinafter termed grantor, has caused said tract of
land to be surveyed by WHITE-DATERS & ASSOCIATES, INC., Registered Professional
Engineer/Land Surveyor, and a plat thereof made which is identified by the title
"Kanis/Shackleford Subdivision the City of Little Rock, Pulaski County, Arkansas" and the date
October, 2007 and by the signature of the said engineer/surveyor and the said grantor and the
grantor does hereby make this Bill of Assurance, on the following terms: �
1. The grantor does hereby certify that it has platted said real estate in accordance with
said plat. The lands embraced in said plat shall be forever known as designed on said plat; and
every deed of conveyance for said property shall use this designation.
2. The filing of this Bill of Assurance and plat for record in the Office of the Circuit
Clerk and exofficio Recorder of Pulaski County shall be a valid and complete delivery and
dedication of any streets and easements shown on the said plat.
3. All buildings constructed on said lots shall be constructed no nearer to the street than
the building line shown on the plat, and all buildings shall be constructed in conformance with
the Building Code and Zoning Ordinance of the City of Little Rock, Arkansas.
4. No lot may be utilized for any purpose inconsistent with its zoning or for any noxious
or unwholesome activity. No part of Lot 2 may be used directly or indirectly for any form of

financial institution facility, including but not limited to an automated teller machine or similar
device, a branch bank, or a loan or mortgage production office.
5. There is shown on Lot 1 a "25' common access esmt.," which shall constitute a non-
exclusive easement for the use of the owners, customers and occupants of Lot 2, for purposes of
ingress and egress, to be used in common with the owners, customers and occupants of Lot 1.
This easement shall be maintained by the owner of Lot 1 at its expense. The owner of Lot 1 may
also take reasonable measures to minimize traffic conflicts at the eastern terminus of this
easement among eastbound, westbound and turning vehicles.
6. There is shown at the common boundary of Lots 1 and 2 a "30' common access &
utility easement," which shall constitute a non-exclusive easement for the joint use of the
owners, customers and occupants of Lots 1 and 2, for purposes of ingress and egress, and for
utilities (which shall be placed underground). This easement shall be maintained by the owner of
Lot 1 at the joint expense of the owners of both Lots; provided, that each owner shall bear the
entire cost of repairing damage associated with utilities installation and repairs on either Lot.
7. There is shown adjacent to the foregoing easement a "10' Utility Easement," which
shall constitute a non-exclusive utility easement for the use only of the owners of Lots 1 and 2.
8. There is shown in the southwesterly quadrant of Lot 1 a "sign easement," which shall
be appurtenant to Lot 2, to be used solely for a single sign advertising access to a business
located on Lot 2. This easement shall also include a ten -foot area surrounding the easement for
installation and maintenance of a single sign. Any such sign or alteration or replacement thereof
shall be subject to the reasonable prior approval of the owner of Lot 1, for visual compatibility
with any signs of that owner. Any such sign shall be approved by the necessary governmental
authority prior to installation.

9. No easement granted hereby may be used for construction access other than
installation of utilities. The owner of Lot 1 shall be entitled to maintain a single sewer line, in
the nature of an easement across Lot 2, which the owner of Lot 2 may relocate wholly to a utility
easement described herein on a reasonable notice to the owner of Lot 1, after which relocation
this previous easement shall expire.
10. Because of the shared vehicular access described herein, it is to the benefit of both
Lots that construction and improvements of all kinds be coordinated. To this end, the owner of
Lot 2 shall submit to the owner of Lot 1, for its reasonable prior approval, any and all plans for
improvements to be effected on Lot 2, including but not limited to grading, leveling, signage,
parking lot construction and striping, utilities, retaining walls, landscaping and building
construction.
11. The terms hereof and the plat may be amended at any time by vote of a majority of
the ownership within the subdivision, calculated on the basis of square footage, subject to the
approval of the City of Little Rock, as applicable, and provided further that no easement
described herein may be altered without unanimous approval of the Lot owners. Otherwise, the
plat and bill of assurance shall have perpetual force and duration.
