REPLAT OF LOT 2A TO LOT 2 AND LOT 3
WHEREAS, RJ Properties, LLC ("Grantor"), an Arkansas limited liability company, is the sole owner
of the property located in Little Rock, Pulaski County, Arkansas described on Exhibit "A" attached
hereto;
WHEREAS, Grantor desires to REplat said property as Lots 1, and 2 and 3 of the Summerwood
Addition to the City of Little Rock, Arkansas, as shown and represented on the plat attached as Exhibit
"All:
NOW, THEREFORE, WITNESSETH:
That Grantor has caused said tract of land to be surveyed by Raymond Hickey, Registered Professional
Land Surveyor, No. 1401 and Registered Professional Engineer, No. 7730, and a plat thereof made;
which is identified by the title Summerwood Addition to the City of Little Rock, Arkansas (the
"Summer -wood Addition") and the date Feb 10 2011, and by the signature of the said surveyor/engineer
and the said Grantor, and bears a Certificate of Final Approval executed by the Little Rock Planning
Commission. and is on record in the Office of the Circuit Clerk and Ex-Officio Recorder of Pulaski -
County, Arkansas, in Plat Book Page (the 'Plat"), and Grantor does hereby make this Bill of
Assurance.S
Grantor does hereby certify that it has laid off, platted, and subdivided said property in accordance with
said Plat. The property embraced. in said Plat -shall be forever known as designated on said Plat; and
every deed of conveyance for said property shall use this designation.
The filing of this Bill of Assurance and Plat for record:in the office,of the Circuit Clerk and ex-officio
Recorder of Pulaski County shall be a valid and -complete: delivery and dedication of the
easements shown on said Plat.
The lots designated in the Summerwood Addition shall be sold by Grantor and shall be
purchased by the buyers thereof subject to the following covenants and restrictions:
(1) USE OF THE PROPERTY
The property shall be used in compliance with all ordinances of the City of Little Rock
including, but not limited to zoning ordinances, building permits, building codes, health codes,
subdivision regulations, and in compliance with all laws of the state of Arkansas and the United
States of America.
(2) EASEMENTS
There are strips of ground shown and dimensioned on the Plat marked "drainage
easement" or "utility easement" that are reserved for the use of drainage purposes or public
utilities, subject at all times to the proper authorities and to the easement therein described. All
grantees of the property shall take their title subject to the rights of public utilities and the public.
(3) POLLUTION
No industry or other business shall be established, maintained, or permitted on the
property which produces and discharges objectionable effluent, smoke, dust, noise, odor, glare,
or vibration. Determination of whether something is objectionable will be made by reference to
applicable city, state, and federal laws and regulations.
(4) ACCESSORY BUILDINGS
All accessory buildings shall be -located within applicable setback lines and must be of
the same material or compliment the dwelling on the lot.
(5) PARKING
The property owner shall provide appropriate parking space for its employees, customers,
and visitors, and the public streets and adjacent lots shall not be used for parking for said lot
owner. The surface of all driveways -and permanent parking areas shall be of concrete, asphalt,
or other bituminous material.
(6) UPKEEP OF PREMISES
Grass; -weeds, and -vegetation shall -be kept -mowed--and � cleared at regular intervals on
each lot by the owner thereof so as to maintain the same in a neat and attractive manner. No
garbage, trash, rubbish, tree limbs, leaves, cuttings, ashes, or other refuse shall be thrown,
placed, dumped, or deposited on any lot, street, or road., unless placed in a container suitable for
waste disposal. The owner of said property shall keep the premises, buildings, and
improvements in a safe, clean, and presentable condition at all times and shall comply in all
respects with all government health and police requirements pertaining thereto.
(7) ENFORCEMENT OF RESTRICTIONS
Grantor herein, its successors and assigns, or other property owners in the Summerwood
Addition subject to these covenants, may enforce these restrictions either by restraining order or
may prosecute at law or in equity a suit for damages or any other remedy which they may have.
Invalidation of any of the foregoing conditions, restrictions, or covenants by a court of competent
jurisdiction in no way affects any of the other provisions which shall remain in full force and
affect.
(8) TERM AND AIMENDMENT
(a) The restrictions, conditions, covenants, and provisions set forth herein shall be
deemed covenants running with the land and shall remain in -full force and effect as herein
expressed until December 31, 2035 (the "Initial Term"), unless an instrument signed by the
owners of at least sixty percent (60%) of the area of the land in the Summerwood Addition has
been recorded which modifies or cancels said restrictions, conditions, covenants, and provisions,
in whole or in part.
(b) After the Initial Term, the restrictions, conditions, covenants, and provisions set forth
in this Bill of Assurance shall automatically renew for successive periods of twenty-five (25) -'
years each (the "renewal terms" ); unless an instrument signed by the owners of at least sixty =
percent (60%) of the area of -the land.in the Summer -wood Addition has been recorded which �=
modifies or cancels saidsestricti_ons,-conditions, covenants, and provisions, in whole or in part. 7 c
