3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH GENE SUMMERS CONSTRUCTION, INC.,
5 IN AN AMOUNT NOT TO EXCEED TWO HUNDRED SEVENTY-FOUR
6 THOUSAND, FOUR HUNDRED FORTY-EIGHT DOLLARS AND 40/100
7 ($274,448.40), FOR THE WEST 13TH STREET RECONSTRUCTION
8 IMPROVEMENT PROJECT; AND FOR OTHER PURPOSES

10 WHEREAS,it has been deemed appropriate and necessary to analyze and design street improvements
11 to West 13th Street from Fillmore Street to Fair Park Boulevard; and
12 WHEREAS, project improvements include reconstruction of the roadway with appurtenant concrete
13 curb and gutters and driveway aprons; and,
14 WHEREAS,bids were solicited for West 13th Street Reconstruction,Bid#2725; and,
15 WHEREAS,the total cost of the project shall not exceed Two Hundred Seventy-Four Thousand,Four
16 Hundred Forty-Eight dollars and 40/100($274,448.40),which includes a 20%contingency.
17 WHEREAS, funding for this project is from the 2022 Capital Improvement Bonds as authorized by
18 Resolution 15,968(May 2,2023)with funds available from Account Activity B1D007S;
19 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
20 OF LITTLE ROCK,ARKANSAS:
21 Section 1. The Board of Directors authorizes the City Manager to execute an agreement with Gene
22 Summers Construction, Inc., in an amount not to exceed Two Hundred Seventy-Four Thousand, Four
23 Hundred Forty-Eight dollars and 40/100 ($274,448.40), which includes a 20% contingency, for the West
24 13th Street Reconstruction Project.
25 Section 2. Funding for this project is from the 2022 Capital Improvement Bonds as authorized by
26 Resolution 15,968 (May 2,2023). Account Activity BID007S.
27 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
28 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
29 adjudication shall not affect the remaining portions of the resolution,which shall remain in full force and
30 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
31 resolution.
32 Section 4. Repealer. All laws,ordinances,resolutions,or parts of the same,that are inconsistent with
33 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
