Since Commission staff does not routinely review requests to subdivide parcels that are already developed, staff referred this proposal to the Commission for additional guidance. The Capitol Zoning District Commission discussed this item at its meeting on May 25, 2017. In its discussion, the Commission members noted that the parcel in question includes three existing principal structures, each of which was built as a dwelling unit. They also noted that the existing parcel is non -conforming, owing to the diminished setbacks created by the three structures, but determined the proposed replat would not serve to substantially increase this non -conformity. The Commission instructed staff that the proposed replat is appropriate for this property, and that it does not require any variance, waiver, or further review from our agency.
