The site includes two (2) buildings, a one-story building approximately 2,360 sq.ft. on the south end of the site and a two-story building on the north end. The larger north building will primarily operate on the 5100 sq.ft. first level with only 900 sq.ft. of area operational on the second level. The second level mezzanine will be physically closed to the general public and will only be accessible by the owner and staff. The site includes two (2) buildings, a one-story building approximately 2,360 sq.ft. on the south end of the site and a two-story building on the north end. The larger north building will operate on the first level only; which is approximately 5,100 sq.ft. The second level including the mezzanine will be physically closed to the general public and will only be accessible by the owner and staff. Mr. Broadway agrees to limit the operation of the two (2) facilities located at this location to staggered hours of operation. There are forty-nine (49) on -site parking spaces available for use. The staggered use of these facilities would require fifty-one (51) parking spaces to satisfy code requirements. We are requesting variance on two (2) spaces. If this is considered to be in the residential part of the City outside the fire zone, and I am assuming that is the case, and if there is a church located within 300 feet of the building where alcohol would be sold, measured from the nearest points of the two buildings (which may or may not be the case - has anyone measured?) then the part of the application for a restaurant and a lounge could go forward but the owners/operators would not be able to sell light wines or beer of 5% or less alcohol content. If their application depends on them selling light wine and beer of 5% alcohol content or less within 300 feet of a church, their application should not go forward because it will be contrary to the City code. If more clarification is needed, just let me know. Arkansas Code Annotated § 3-5-213 gives cities the right to impose additional restrictions, such as fixing zones and providing hours of opening and closing of businesses selling alcoholic beverages and such other rules and regulations that will promote public health, morals, and safety. The City Board, by ordinance, determined that beer under 5% alcohol content and light wines should not be sold within 300 feet of a church located in the residential section of the city. While the title to LRC § 4-93 states that sale near churches and schools is prohibited, the language of the code provision itself only addresses sales within 300 feet of churches that are in the residential section of the City. This ordinance also does not address the sale of hard liquors or beers of alcoholic content in excess of 5%. I am unsure who enforces this particular provision, but in my opinion the Planning and Development staff and the Commission will have to follow the law and not allow an application contrary to an ordinance. This item is on tomorrows agenda and it is possible the opposition will bring up this issue once again. The opposition indicated the City had in place ordinance which prohibited the sale of alcohol near a church or school. I'm not sure who enforces this ordinance. Can the Commission consider an application that is in direct conflict with other ordinances? Sec. 4-93. Sale near churches and schools prohibited. (a) It shall be unlawful to sell beer or light wines within three hundred (300) feet of any church in the residential section of the city. The residential section of the city shall be any part thereof that is outside of the fire zone, as now or hereafter be fixed by the board of directors. The business section of the city is that part of the city within the fire zone. (b) The distance shall be measured from the nearest point of the church or school to the nearest point of the building or place where beer or light wine is sold. City of Little Rock .
