WHEREAS, Arvest Bank, an Arkansas state chartered bank, is the owner of following described
land lying in Pulaski County, State of Arkansas, to -wit:
Property Description
Part of Lots 1 to 16, inclusive, Block 35, Josephine Pankey's Extension to her Third Addition to
the City of Little Rock, Pulaski County, Arkansas as filed for record in plat book 2, page 111, and
that portion of what was formerly Arnold Street lying adjacent to Lots 1 and 16, Block 35 and the
W1/2 of what was formerly Conner Street lying adjacent to Lots 1, 2 and 3, Block 35 and that
portion of what was formerly an alley, lying adjacent to Lots 1, 2, 15 and 16 and adjacent to Lots
2 through 15, all in Josephine Pankey's Extension to her Third Addition to the City of Little Rock,
Pulaski County, Arkansas which said street and alleys have been closed, vacated and
abandoned by the City of Little Rock, Arkansas by Ordinance No. 19,385 and filed for record as
Instrument No. 2005072170 in the records of Pulaski County, Arkansas being more particularly
described as follows:
BEGINNING on the north line of what was formerly Arnold Street and what is now the NE corner
of said Block 35; thence S 00°44'39" W along the east line of said Block 35, also being the
centerline of what was Conner Street, a distance of 297.07 feet to the north right-of-way line of
Arkansas Hwy. 10; thence N 66'49'27" W along said north right-of-way line, a distance of 21.64
feet; thence N 71 °08'22" W along said north right-of-way line, a distance of 211.75 feet; thence N
80'13'21" W along said north right-of-way line, a distance of 88.91 feet to the west line of said
Block 35, also being the east right-of-way line of Townsend Street; thence N 00026'13" W along
said east right-of-way line, a distance of 218.70 feet to the north line of what was formerly Arnold
Street and what in now the NW corner of said Block 35; thence S 87°29'45" E along what is now
the north line of said Block 35, a distance of 313.72 feet to the POINT OF BEGINNING,
containing 1.80 Acres (78,285 sq. ft.) more or less.
And it is deemed desirable, for convenience in description, that the above described property be
now platted as a building lot as shown on the attached plat and that said property be held, owned
and conveyed by the description hereinafter set forth;
NOW THEREFORE, Arvest Bank, for and in consideration of the benefits to accrue to it,
which benefits it acknowledges to be of value, has caused a plat to be made of the above
described property, which plat is attached hereto, showing a survey made April 17, 2007 by
Development Consultants, Inc., Registered Professional Engineers and Land Surveyors, and
baring a Certificate of Approval executed by the Little Rock Planning Commission, and showing
dimensions of the above described property, now being platted.

There are two areas on said plat of the above described property, both of which are
labeled "Right -of -Way To Be Dedicated This Plat, " and said areas are hereby donated and
dedicated to the public for use as additional street right-of-way for Highland Street and Arkansas
State Highway No. 10.
Further, there are areas labeled and "Utility Easement To Be Dedicated This Plat" shown
on said plat of the above described property and Arvest Bank hereby donates and dedicates to
and for the use of public utilities, the same being, without limiting the generality of foregoing,
electric power, gas, telephone, water and sewer, with the right hereby granted to the persons,
firms or corporations engaged in the supplying of such utility services, for use of said easements
for utility purposes, said utilities to have free ingress and egress therefrom for the installation,
maintenance, repair and replacement of such utility services.
Finally, there is an area shown on the plat, located at the southeast corner of the above
described property, which is labeled "Cross Access Easement To Be Dedicated This Plat". It is
not the intent of Arvest Bank to bestow rights upon any other third parties nor upon the public
generally with respect to the "Cross Access Easement". Rather, except for use by utilities, use of
said easement area is limited to Arvest Bank and to the Pankey Community Improvement
Association, Inc., the latter being a property owner adjacent to the east of the above described
and platted property and to the respective successors in title, tenants, and invitees of Arvest Bank
and Pankey Community Improvement Association, Inc. Arvest Bank and Pankey Community
Improvement Association Inc. shall have the right, by mutual agreement, to rescind and terminate
the "Cross Access and Easement."
The filing of this Bill of Assurance, and associated plat, for record in the Office of the
Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, will be a valid and complete
delivery and dedication of the right-of-way and easements depicted on said plat, subject to the
limitations hereinabove set out.

The lands embraced in said plat shall be forever known as "Lot 1, Arvest — Cantrell
Addition to the City of Little Rock, Pulaski County, Arkansas" and any and every deed of
conveyance of the above described property describing the same by said title shall always be
deemed to be an adequate, complete and sufficient description thereof.
IN WITNESS WHEREOF, Arvest Bank has hereinto affixed its corporate seal and caused
these presents to be executed by its duly authorized officer of officers, there undersigned, on this

Lot 1, Arvest-Cantrell Addition, city of Little Rock
Dear Mr. Carpenter:
Little Rock Wastewater Utility has reviewed the proposed final plat submitted by your firm on
the above referenced property. Little Rock Wastewater will require an easement be added at the
southwest corner of this property. The easement must be 10 foot in width and be five feet on all
sides of the existing sewer main and sewer manhole located on this parcel of property. If this
easement is added the Utility will have no problems with signing off on the Final Plat.
