Royal Oaks Subdivision
Dear Donna:
Submitted herewith is the application forms and eighteen (18) copies of the revised
preliminary plat for the above referenced project. The purpose of the proposed revision is to
change the location of the sidewalk along Royal Oaks Drive from what was indicated on the
previously approved preliminary plat. As you may recall, the preliminary plat for the project
was approved on May 11, 2006, by the planning commission and the project was final platted
on May 18, 2007.
During the construction of the project, the Developer, JCS Construction, requested a deferral
of construction for the concrete sidewalks. Public Works granted the Developer a 60-day
deferral of the sidewalks but required them to post a letter of credit for the amount of the
estimated construction of the sidewalks. After all the paper work was approved and the
remainder of the construction was completed, the Developer was allowed to file the final plat
for the project.
The approved preliminary plat showed the sidewalk along Royal Oaks Drive to be located at
the right-of-way line. As shown in the attached photographs, the transformer pads and
telephone pedestals have been installed just inside the right-of-way line in the intended path of
the sidewalk. After discussing the matter with the City of Little Rock's Construction Inspector,
the Developer decided to switch to a five-foot wide sidewalk and place it at the back of curb.
The Developer asked for the construction details for such a situation and preceded the
excavation and forming of the sidewalks at the revised location. After the excavation was
completed, the Construction Inspector contacted our office and stated that Public Works was
not going to allow the sidewalks to be placed at the back of curb even though the matter had
been discussed between the Developer and Inspector previously.
After a few attempts to mediate the situation between Public Works and the Developer, Public
Works stated that they simply could not approve the revised location and the matter would
have to be taken back before the Planning Commission. Public Works contends that the
sidewalk must maintain a distance of at least two -feet off the back of curb but can meander as
needed to avoid any obstructions. The attached pictures show that at the lot corners this will
impossible to accommodate due to the location of the transformer pads and the telephone
risers. Therefore the Developer has asked our firm to prepare an application to the Planning
Commission to revise the location of the sidewalks. Since the matter has been placed back
before the planning commission, the Developer is also asking the Commission to consider
waiving the sidewalk between Shady Grove and Ponderosa Drive. The Developer points out
that there are no sidewalks along Ponderosa so no connection should be required.
