HomeMy WebLinkAbout19654I 2 ORDINANCE NO. 19,654 3 AN ORDINANCE TO AMEND SECTIONS 3 -15 AND 3 -20 (a) OF THE CODE 4 OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS, PERTAINING 5 TO FIRE FALSE ALARMS AT HOSPITALS; AND FOR OTHER PURPOSES. 0 7 WHEREAS, the False Alarm Ordinance of 2005 eliminated previous exemptions 8 for hospitals; and 9 WHEREAS, the exemption should be restored for facilities that provide direct 10 patient care. 11 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 12 OF LITTLE ROCK, ARKANSAS: 13 Section 1. Section 3-15 of the Code of Ordinances of the City of Little Rock, 14 Arkansas is hereby amended by adding a new subsection (f): 15 (f) Hospitals may agree with their alarm installation company to go through a 16 "grace period" for the first sixty (60) days after installation of an alarm system during 17 which time neither the alarm installation company nor the monitoring company will 18 have any obligation to respond to any alarm signal from the alarm site. If the alarm 19 signal is the result of an actual alarm event, the alarm installation company or the 20 monitoring company shall send an alarm dispatch request to an emergency service 21 agency. 22 23 Section 2. Subsection 3 -30(a) is hereby amended: 24 (a) An alarm user shall be subject to civil penalties, depending on the number of 25 false alarms within a calendar year based upon the following schedule: [PAGE 1 OF 3] To amend False Alarm Ordinance I False Alarm Civil Penalties 2 # of False 3 Alarms Civil Penalty 4 5 1 None 6 2 None 7 3 None 8 4 $25.00 9 5 $ 50.00 10 6 or more Varies depending on the responding agency: 11 12 $200 for police response 13 14 $300 for fire response at a single family- residence 15 16 $500 for response to fire at multi - family, 17 commercial, school, or industrial complex 18 19 $450 for an emergency response by the Little Rock 20 ambulance authority 21 22 23 Section 3. Subsection 3 -20 is hereby amended to add: 24 (h) Hospital buildings used to provide direct patient care shall be exempt from 25 the assessment of civil penalties. Hospital buildings undergoing construction or 26 significant reconstruction shall be exempt from the assessment of civil penalties 27 during construction/ reconstruction. The hospital shall provide notice to the False 28 Alarm Coordinator when construction or reconstruction begins and ends. 29 30 Section 4. Severabi/ity. In the event any title, section, paragraph, 31 item, sentence, phrase or word of this ordinance is declared or adjudged to 32 be invalid or unconstitutional, such declaration or adjudication shall not [PAGE 2 OF 3] To amend False Alarm Ordinance 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this Ordinance, are hereby repealed to the extent of such inconsistency. All other provisions of Chapter 6 of the Code of Ordinances not in conflict herewith shall remain in full force and effect. PASSED: December 5, 2006 ATTEST: Nata i S.
