HomeMy WebLinkAboutS-1084 ApplicationAMENDED BILL OF ASSURANCE #2 LOTS 1-8, TURLEY'S REPLAT OF TRACTS 5 & 6 CRYSTAL VALLEY GLENS SUBDIVISION LITTLE ROCK, PULASKI COUNTY, ARKANSAS KNOW ALL MEN BY THESE PRESENTS: THAT WHEREAS, John B. Boyd and Nita Boyd, hereinafter called GRANTORS are the Owners of the following described property: Lots 1 thru 7 of Turley's Replat of Tracts 5 and 6, Crystal Valley Glens Subdivision, Little Rock, Pulaski County, Arkansas, as amended and recorded in Deed Record Book 1267 at page 169 of the records of the Circuit County Clerk of Pulaski County, Arkansas. AND WHEREAS, the GRANTORS are desirous of amending the Bill of Assurance thereof, recorded in Deed Record Book 1267 on pages 167 and 168 of the records of the Circuit County Clerk of Pulaski County, Arkansas. NOW, THEREFORE, the Grantors do hereby amend the above described Bill of Assurance as follows: 1. THE AMENDED PLAT The amended plat of Turley's Replat of Lots 1-8 of Tracts 5 and 6 of Crystal Valley Glens Subdivision of Little Rock, Arkansas shall remain the same as the Plat recorded in Deed Record Book 1267 at Page 169 of the records of the Cir- cuit County Clerk of Pulaski County, Arkansas, together with the Easements, Building Lines, and Rights -of -Way recorded therein. Description of the Lots by the numbers shown thereon shall be deemed to be a sufficient and complete description thereof. 2. LAND USE AND BUILDING SETBACKS No lot in Turley's Replat shall be used for any purpose other than one single-family residence. No struc- ture shall be placed on any Lot nearer the front property line than the building line shown on the recorded plat thereof. The side yard requirement shall be ten percent (10%) of the average width of the lot. The rear yard shall be a minimum of twenty-five feet (25' ) from the rear prop- erty line. 3. MINIMUM DWELLING SIZE CONSTRUCTION No residence/building shall be constructed on any lot with less than nineteen hundred square feet (1,900 sq. ft..) of heated/cooled living space. No residence shall be more than two and one-half stories (2 1/2) in height when viewed from the front or principal facade of the residence. For the purposes of this requirement, eaves, open porches, patios and decks shall not be considered part of the build- ing. An accessory building, garage, storage, servants quar- ters, etc. will be allowed if constructed in accordance with sideline and rear yard setback requirements. All building codes of the City of Little Rock, Arkansas shall be applica- ble. 4. MOBILE HOMES TEMPORARY STRUCTURES No mobile home/manufactured housing building or any other structure of a temporary nature shall be placed on any lot and used as a habitable residence. 5. NOXIOUS ACTIVITIES/LIVESTOCK No noxious activities of any sort will be allowed upon any lot. No livestock may be kept on any lot, except for pets and no animals may be kept for breeding or commer- cial purposes. Any animals kept on any lot shall be subject to any and all animal control ordinances of the City of Lit- tle Rock, Arkansas. 6. SUBDIVISION ❑F LOTS No lot shall be further subdivided without the prior approval of the Little Rock Planning Commission and in no case shall lot be replatted being less than 75' wide at the building line. 7. APPLICATION OF COVENANTS The covenants expressed in this Amended Bill of Assurance shall apply ONLY to Lots 1-7 as shown on the recorded plat thereof and shall not apply to Lot 8. The original Amended Bill of Assurance recorded in Deed Record Book 1267 at Pages 167 and 168 of the records of the Circuit County Clerk of Pulaski County, Arkansas, shall remain in full force and effect for Lot 8. These covenants shall apply only to Lots 1 thru 7 inclusive. Reviewed only for inclusion of minimum standards required by the City of Lit- tle Rock Subdivision Regulations. Bill of Assurance provi- sions established by the developer may exceed minimum regu- lations of the Little Rock subdivision and zoning ordinances. CHURCH, PRELIMINARY PLAT AT 9400 BLOCK OF STAGECOACH ROAD (S-1084). BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Chapter 31 of the Code of Ordinances be amended to provide for waiver of certain requirements within the Subdivision Regulations of the City of Little Rock for Calvary Apostolic, U.P.C. Preliminary Plat (S-1084) as follows: Subsection a. That Chapter 31, Section 31.201 be amended to provide for a deferral for a period of two years, of required sidewalk, curb and gutter, street pavement and underground drainage for Stagecoach Road, (Arkansas Highway No. 5) along the west boundary of the plat.
