ORDINANCE NO. 19,459 (DECEMBER 13, 2005), TO ADJUST THE FISCAL YEAR 2006 BUDGET ORDINANCE TO NOTE EXPENDITURE ADJUSTMENTS FOR STREET COSTS, FRANCHISE FEE REVENUES, PERSONNEL COSTS, PERSONNEL SAVINGS, AND OTHER ADJUSTMENTS; TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, the City approved a comprehensive budget for the City of Little Rock, Arkansas, in Little Rock, Ark., Ordinance No. 19,459 (December 13, 2005), and WHEREAS, it is appropriate to adjust the ordinance to reflect operational changes in the General, Street, Concessions, RiverMarket, Golf, War Memorial Fitness Center, Solid Waste, Zoo, Fleet, and Vehicle Storage Facility Funds, and where necessary to authorize the increase in the fiscal year 2006 line items for these and other matters, and WHEREAS, the City Manager and the Director of Finance & Treasurer, in compliance with City budget and financial reporting policies, have reviewed these adjustments and recommend them to the Board of Directors for approval, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. General Fund Section 4 of Little Rock, Ark., Ordinance No. 19,459 (December 13, 2005) is hereby amended so the General Fund amount will increase by one million one hundred ninety -eight thousand four hundred and ninety -six dollars ($1,198,496), to reflect additions in operating budgets for General fund departments, to the amount of one hundred twenty - two million nine hundred fifty -eight thousand and seventeen dollars ($122,958,017.00). Section 2. Street Fund Section 4 of Little Rock, Ark., Ordinance No. 19,459 (December 13, 2005) is hereby amended so the Street Fund amount will increase by forty -nine thousand five hundred and sixty -four dollars ($49,564), to reflect additions in operating budgets for Street fund departments, to the amount of fifteen million eighty -six thousand seven hundred and seventy -eight dollars ($15,086,778.00). Section 3. Concessions Fund. Section 4 of Little Rock, Ark., Ordinance No. 19,459 (December 13, 2005) is hereby amended so the Concessions Fund amount will increase by two thousand nine hundred and five dollars ($2,905), to reflect additions in operating budgets for the Concession fund departments, to the amount of one hundred twenty -four thousand seven hundred and sixty -seven dollars ($124,767.00). Section 4. Zoo Fund Section 4 of Little Rock, Ark., Ordinance No. 19,459 (December 13, 2005) is hereby amended so the Zoo Fund amount will increase by eighty -eight dollars ($88), to reflect additions in operating budgets for the Zoo fund departments, to the amount of four million, two hundred seventy -four thousand and fifty -three dollars ($4,274,053.00). Section 5. War Memorial Fitness Center Fund. Section 4 of Little Rock, Ark., Ordinance No. 19,459 (December 13, 2005) is hereby amended so the War Memorial Fitness Center Fund amount will increase by thirty -eight thousand two hundred and forty -eight dollars ($38,248), to reflect additions in operating budgets for War Memorial Fitness Center fund departments, to the amount of one million one hundred sixty -six thousand nine hundred and ninety -two dollars ($1,166,992.00). Section 6. RiverMarket Fund. Section 4 of Little Rock, Ark., Ordinance No. 19,459 (December 13, 2005) is hereby amended so the RiverMarket Fund amount will increase by seventy -nine dollars ($79), to reflect additions in operating budgets for RiverMarket departments, to the amount of eight hundred forty -two thousand seven hundred and twenty -seven dollars ($842,727.00). Section 7. Golf Fund Section 4 of Little Rock, Ark., Ordinance No. 19,459 (December 13, 2005) is hereby amended so the Golf Fund amount will decrease by nine thousand three hundred and sixty -two dollars ($9,362), to reflect reductions in operating budgets for Golf fund departments, to the amount of two million seven hundred fifty thousand five hundred and fifty -nine dollars ($2,750,559.00). Section 8. Solid Waste Fund. Section 4 of Little Rock, Ark., Ordinance No. 19,459 (December 13, 2005) is hereby amended so the Solid Waste Fund amount will increase by two hundred eighteen thousand two hundred and thirty -one dollars ($218,231), to reflect additions in operating budgets for Solid Waste fund departments, to the amount of seventeen million one hundred two thousand seven hundred and four dollars ($17,102,704.00). Section 9. Vehicle Storage Facility Fund. Section 4 of Little Rock, Ark., Ordinance No. 19,459 (December 13, 2005) is hereby amended so the Vehicle Storage Facility Fund amount will decrease by one hundred fifty -seven thousand nine hundred and forty -nine dollars ($157,949), to reflect reductions in operating budgets for Vehicle Storage Facility fund departments, to the amount of one million four hundred twenty -two thousand four hundred and fifty -five dollars ($1,422,455.00). Section 10. Fleet Fund. Section 4 of Little Rock, Ark., Ordinance No. 19,459 (December 13, 2005) is hereby amended so the Fleet Fund amount will increase by two hundred eighty -six thousand and eighty dollars ($218,231), to reflect reductions in operating budgets for Fleet fund departments, to the amount of eight million six hundred sixty -eight thousand one hundred and forty dollars ($8,668,140.00). Section 11. Use of 2005 Increased Fund Balance in the General Fund. Based upon the 2005 audited financial statements which reflected a $2,571,291 increase in fund balance for the General Fund, and the available cash balance of $3,532,160, the Director of Finance & Treasurer is directed to: • Transfer $3,000,000 from the General Fund to the General Fund Restricted Reserve, and • Transfer $467,924 to a special project in the General Fund Special Project Fund for LRNN capital equipment. Section 12. Records. The Director of Finance & Treasurer is directed to maintain appropriate records which provide greater detail for the adjustments set forth in this ordinance as reflected in the materials provided to the Board of Directors for the November 21, 2006, meeting. Section 13. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. Section 14. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this ordinance are hereby repealed to the extent of such inconsistency. Section 15. Emergency. The City's ability to properly maintain its budgets and to account for its funds is essential to maintain the public health, safety and welfare; an emergency is, therefore, declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
