BILL OF ASSURANCE
WHEREAS, SARAH C. LEE & JO BRENDA LEE, hereafter known as
OWNERS#1, and JO BRENDA LEE, hereafter known as OWNER#2, are the sole
owners of the following described property:
• OWNERS#1 own 487 Ridgeway, described as Lot 35, Block 12, Midland Hills
Addition, and
• OWNER#2 owns 483/481 Ridgeway, described as Lot 34, Block 12, Midland
Hills Addition,
Addition to the City of Little Rock, Arkansas, and desire to replat said lots:
NOW, THEREFORE, WITHESSETH:
That We, the said OWNERS#1 AND OWNER#2, hereafter termed GRANTORS,
have caused said tract of land to be surveyed by Donald W. Brooks, Inc., located at
20820 Arch Street, Hensley, AR 72065, Registered Professional Engineer/Land
Surveyor, and a plat thereof made which is identified by the title: LOTS 34R & 35R,
BLOCK 12, MIDLAND HILLS ADDITION, BEING A REPLAT OF LOTS 34 & 35, BLOCK
12, MIDLAND HILLS ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY,
ARKANSAS and the date August 25, 1999 and by the signature of the said
engineer/surveyor and the said GRANTORS, and bears a Certificate of Approval

executed by the Little Rock Planning Commission, and is on record in the Office of the
Circuit Clerk and ex-officio Recorder of Pulaski County, Arkansas, in Plat
Book Page 700 and the GRANTORS do hereby make this Bill
of Assurance.
The GRANTORS do hereby certify that they have replatted said estates in
accordance with said plat. The lands embraced in said plat shall be forever known as
designed on said plat; and every deed of conveyance for said property shall use this
designation.
The filing of this Bill of Assurance and plat for record in the Office of the Circuit
Clerk and ex-officio Recorder of Pulaski County shall be a valid and complete delivery
and dedication of the streets and easements shown on the said plat.
All buildings constructed on said lots shall be constructed no nearer to the street
than the building line shown on the plat, and all buildings shall be constructed in
conformance with the Building Code and Zoning Ordinance of the City of Little rock,
Arkansas.
The purposes of the replat are (1) to create an access easement down the
common driveway that exists between Lots 34R and 35R, and (2) to move the property
line where the Lot 34R existing garage encroaches onto Lot 35R. Moving the property
line will also allow OWNER#2 (a) to reconstruct the garage in order to correct a major
drainage problem is flooding the garage when it rains, (b) to enlarge the garage to
provide additional space in which to park OWNER#2's vehicle, and (c) to provide the
capability for OWNER#2 to eventually attach the garage to the house located on Lot
34R.
The GRANTORS have granted an access easement down the property line,
currently a common driveway, between Lots 35R & 34R, Block 12, Midland Hills
Addition. The access easement is to allow both property owners to use as a driveway
and to temporary park their cars, beginning at the street property line of Ridgeway and
extending approximately 64 feet N89 ° 51'E from where the iron pins are located near
the street.

The access easement beginning at the street will be 16 feet wide, with 14 feet
being located on Lot 35R and 2 feet being located on Lot 34R. At 53 feet from where
the pins are located near the street, the access easement decreases to 8 feet for Lot
35R and increases to 8 feet for Lot 34R. Refer to the replat for the specific details of all
locations.
The GRANTORS have also designated that neither owner can place any
structure, signs, fixtures, barriers, or any kind of obstacle that will restrict either owner
from using the access easement as a joint driveway and temporary parking spaces.
The GRANTORS also permit OWNER#2 to build an addition to the structure
located on Lot 34R and to revise the property line between Lots 35R & 34R, beginning
53 feet from where the pins are located near the street. The revision adjusts the
property line at the alley to 54 feet wide for Lot 34R and 46 feet wide for L of 35R.
Refer to the replat for the specific details.
The GRANTORS agree to maintain the access easement in good working
condition as a paved driveway. The maintenance costs will be shared equally from the
street extending to approximately 72 feet from where the pins are located near the alley.
All other maintenance will be the responsibility of each respective owner. Should either
owner cause the access easement to become in disrepair, then it will be the
responsibility of the owner causing the defect to timely correct the defect and pay all
costs for the repairs.

The GRANTORS agree that the access easement can not be changed without
the written approval by the owners of Lots 34R & 35R and the lots surveyed, replatted,
approved by the City of Little Rock and recorded in the Office of the Circuit Clerk and
ex-officio Recorder of Pulaski County.
