HomeMy WebLinkAbout19639ORDINANCE NO. 19,639 AN ORDINANCE AMENDING CHAPTER 8 OF THE 1988 LITTLE ROCK CODE OF ORDINANCES, PROVIDING FOR THE ADOPTION BY REFERENCE OF THE 2006 INTERNATIONAL FUEL GAS CODE AND 2006 REVISIONS, AND FOR OTHER PURPOSES. WHEREAS, Little Rock, Ark. Rev. Code 8 -474 (B) adopts by reference the 2006 Edition of the International Fuel Gas Code with 2006 Revisions and Appendices "A ", `B ", "C" and "D ", published by the International Code Council, Falls Church, Virginia; and WHEREAS, the City has complied with Ark. Code Ann. X 14 -55 -207 (1987) by publishing a notice of intent to adopt these technical codes by reference in a paper of general circulation within the municipality and three copies of codes have been available for inspection in the City Clerk's office by the public prior to their adoption; and WHEREAS, the City will accept and enforce the AR State Amendments and Revisions to the 2006 International Fuel Gas Code if officially adopted by the State; and WHEREAS, this Ordinance amendment is necessary to update the City Code and authorize the use of the 2006 Edition within the City. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. Section 8 -474 of Little Rock, Arkansas Revised Code is hereby amended to read as follows: Section 8 -474 Codes Adopted. (A) The following publications are adopted by reference. (B) The 2006 International Fuel Gas Code with 2006 Revisions and Appendices "A ", `B ", "C ", and "D ". (1) All regulations or references to liquefied petroleum gas or LPG (LP- Gas) are not adopted in any form whatsoever in the 2006 International Fuel Gas Code. (2) Sections 302, 406.4.1, 614.2, 614.3, 614.4, 614.5, 614.6, 614.6.1 and 614.6.2 in the 2006 International Fuel Gas Code shall be deleted in its entirety. (3) Method of Testing Low pressure (not in excess of 1 PSI) gas piping shall withstand a pressure of at least 25 PSI or binches of mercury (20.3KPA) for a period of not less than 15 minutes without showing any drop in pressure. (D) In the event of a conflict between the publications in subsections (A), (B) or (C), the most stringent provisions shall govern. (E) Notwithstanding the provisions of Sections (A), (B) and (C) above, the City, consistent with other provisions of state law, shall set the job qualification for its employees. No job qualifications contained in the 2003 AR Plumbing Code, 2006 International Fuel Gas Code or 2003 AR Mechanical Code are adopted in any form whatsoever. SECTION 2. All ordinances or parts of Ordinances in conflict with this provision are hereby repealed to the extent of the conflict. SECTION 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 4. Code Application. Permits obtained prior to the effective date of this ordinance will be enforced under the previous adopted code till final disposition of the permit. SECTION 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. SECTION 6.
