HomeMy WebLinkAbout16540 1 RESOLUTION NO. 16,540 2 3 A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A 4 CONTRACT WITH MARK R. STIVERS AND STIVERS AND STIVERS, 5 INC. FOR THE PURCHASE OF APPROXIMATELY FORTY-NINE (49) 6 ACRES OF LAND, FOR USE BY THE LITTLE ROCK PORT 7 AUTHORITY; AND FOR OTHER PURPOSES. 8 9 WHEREAS,the Little Rock Port Authority has been actively exploring opportunities for expansion, 10 including the development of a 2008 Master Real Estate Acquisition Plan;and, 11 WHEREAS,the Little Rock Port Authority Staff has worked with the Greater Little Rock Regional 12 Chamber of Commerce,and other interested parties,to explore viable options for real estate expansion and 13 determined that this particular parcel will meet the future needs of the Little Rock Port Authority for 14 economic prospect recruitment purposes,and, 15 WHEREAS,the Little Rock Port Authority Staff has extended a preliminary offer,based upon a third- 16 party appraisal,for the property in question and the offer has been accepted by the owner. 17 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 18 OF LITTLE ROCK: 19 Section 1. The City of Little Rock Board of Directors authorizes the Mayor to purchase approximately 20 forty-nine (49) acres of land for a purchase price of seven-hundred and thirty-six thousand, five hundred 21 dollars($736,500),plus associated closing cost,and is contingent upon positive findings of the Phase One 22 Environmental Study and determination of clear title. The property is defined as: 23 THE SW 1/4 OF THE SE 1/4 AND ALL THAT PART OF THE SOUTH 1/2 OF 24 THE SW 1/4 LYING EAST OF BAYOU, SECTION 19, TOWNSHIP 1 NORTH, 25 RANGE 11 WEST,IN PULASKI COUNTY,ARKANSAS. 26 MEASURED LEGAL 27 BEING A PORTION OF'ME SW1/4 SE1/4 AND SE1/4 SW1/4 OF SECTION 19, 28 T-1-N, R-11-W, PULASKI COUNTY, ARKANSAS; MORE PARTICULARLY 29 DESCRIBED AS FOLLOWS: 30 COMMENCING AT THE SOUTHEAST CORNER OF SAID SECTION 19; 31 THENCE N88°37'14"W,ALONG THE SOUTHERN LINE OF SAID SECTION 32 19, A DISTANCE 1319.54' TO A POINT LOCATED AT THE SOUTHEAST 33 CORNER OF SAID SW1/4 SE1/4, SECTION 19, SAID POINT BEING THE [PAGE 1 of 2] 1 POINT OF BEGINNING;THENCE CONTINUING ALONG SAID SOUTH LINE 2 N88°37'16"W*-1937.11' TO A POINT LOCATED IN THE CENTER OF 3 FOURCHE BAYOU;THENCE NORTHERLY ALONG THE CENTER OF SAID 4 FOURCHE BAYOU THE FOLLOWING: (1) N24°17'43"E-112.49', (2) 5 N32°49'52"E-451.75', (3) N21°15'24"E-370.29', (4) N27°30'54"E-374.54', (5) 6 N34°08'35"E-186.67'TO A POINT ON THE NORTHERN LINE OF SAID SW1/4 7 SE1/4, SECTION 19; THENCE ALONG SAID NORTH LINE S87°56'04"E- 8 1293.09' TO THE NORTHEAST CORNER OF SAID SW1/4 SE1/4,SECTION 19; 9 THENCE ALONG THE EAST LINE OF SAID SW1/4 SE1/4, SECTION 19 10 S02°34'09"W-1315.22'BACK TO THE POINT OF BEGINNING. CONTAINING 11 49.132 ACRES(MORE OR LESS) 12 Section 2. Funding for this acquisition will come from the 2022 Bond Issue and the 2024 Bond Issue 13 that established funds for land acquisition at the Port of Little Rock. 14 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 15 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 16 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 17 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 18 resolution. 19 Section 4.
