2 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO EXECUTE
3 A CONTRACT WITH J.A. RIGGS IN AN AMOUNT NOT TO EXCEED
4 FOUR HUNDRED NINETY THOUSAND, SIX HUNDRED SIXTY AND
5 51/100 DOLLARS ($490,660.51), PLUS APPLICABLE TAXES AND FEES
6 FOR THE PURCHASE OF ONE (1) CATERPILLAR MODEL 350-AK
7 EXCAVATOR FOR THE PUBLIC WORKS LANDFILL; AND FOR
8 OTHER PURPOSES.
9 WHEREAS, the Public Works. Department-Landfill Division has a need to purchase one (1)
10 Caterpillar Model 350-AK Excavator;and,
11 WHEREAS, the purchase will allow for the replacements of an older unit with high maintenance
12 costs;and,
13 WHEREAS,vendor selection was made through the Sourcewell Contract No. 011723-CAT; and,
14 WHEREAS, the total cost for the purchase will not exceed Four Hundred Ninety Thousand, Six
15 Hundred Sixty and 51/100 Dollars($490,660.51),plus applicable taxes and fees;
16 WHEREAS,funding is allocated in the Public Works Waste Disposal Account No. 603120-72300;
17 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
18 OF LITTLE ROCK,ARKANSAS:
19 Section 1. The City Manager is authorized to enter into an agreement with J.A. Riggs in an amount
20 not to exceed Four Hundred Ninety Thousand, Six Hundred Sixty and 51/100 Dollars ($490,660.51),plus
21 applicable taxes and fees, for the purchase of one(1)Caterpillar Model 350-AK Excavator to be used by
22 the Public Works Department-Landfill Division.
23 Section 2. Funds for this purchase are allocated in the Public Works Waste Disposal Account No.
24 603120-72300.
25 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
26 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
27 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
28 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
29 resolution.
30 Section 4. Repealer. All laws,ordinances,resolutions,or parts of the same,that are inconsistent with
31 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
