SUBDIVISIONS
(6) To establish reasonable standards of design
and procedures for subdivision and resub-
divisions, in order to further the orderly
layout and use of land; and to ensure proper
legal descriptions and monumenting of sub-
divided land.
(7) To encourage the wise use and management
of natural resources; to provide adequate
and safe recreational areas; to maintain
the natural beauty and topography of the
municipality and to ensure appropriate de-
velopment with regard to these natural fea.

provided with adequate public facilities and
improvements including streets, storm drain-

Sec. 31-5. Jurisdiction and application.
(a) It is the policy of the city to consider the
subdivision of land and the subsequent develop-
ment of the subdivided plat as subject to the con-
trol of the city pursuant to the municipal plan
and the master street plan for the orderly, planned,
efficient and economical development of the city.
(b) This chapter shall be applicable to all lands
with the city and its planning jurisdiction except
lots of record prior to December 19, 19 i 8. Lots
which were not in compliance with prior subdivi-
sion regulations shall be deemed to be in viola-
tion of this chapter. The planning area map is
hereby included in this chapter by reference and
is titled Map A-1.

(c) This chapter shall apply to the subdivision
of land as follows:
(1) All divisions or platting of a tract or parcel
of land into one (1) or more lots, building
sites or other divisions for the purpose,

whether immediate or future, for sale or
building development shall be considered a
subdivision and subject to this chapter.
(2) The dedication or vacation of any street or
alley through any tract of land, regardless
of the area involved as may be desired by
the owner or if necessary to achieve con-
formance with the master street plan, shall
be considered a subdivision and subject to
this chapter.
(3) The reduction in width or depth of a lot or
tract of land through public acquisition for
right-of-way, street or drainage purposes
shall not be deemed to create nonconfor-
mity, provided, that, the resultant land area
and configuration is sufficient to meet min-
imum bulk and area standards of the zoning
ordinance, chapter 36 of the Code of Ordi-
nance. (Code 1961, § 37-4; Ord. No. 16,116, 1§ 1(xx), 11_
19-91; Ord. No. 16,341, § 1(pp),
Sec. 31-6. Amendments.
This chapter may be amended at any time after,
the planning commission has held a public hear-
ing on the proposed amendments. At, on or after
such public hearing, the planning commission may
recommend to the board the adoption of such
amendments.

Sec. 31-7. Enforcement.
It shall be the duty of the planning director and
the planning commission to enforce this chapter
and to bring to the attention of the city attorney
any violations or lack of compliance herewith.
The planning director may delegate his adminis-
trative responsibilities under this chapter to the
subdivision administration or other designated
staff.

ORDINANCE WAIVER
Dear Mr. Caristianos:.
Enclosed is a copy of the agenda and the agenda write-up for the January 10, 1995 Planning
Commission. Your item, the Caristianos' Pride Valley Development -- Subdivision
Ordinance Waiver, will be heard by the Commission on that date. Planning Commission
meetings begin at 12:30 in the afternoon, and are held in the Board of Directors Assembly
Room, 2nd. floor, City Hall, at 500 W. Markham St. You or your representative are
encouraged to be present and to be prepared to present your request to the Commission.

Subject: 40 Acre Development on Pride Valley Rd.
Dear Mr. Caristianos:
This letter is to confirm my response by fax on the subject development.
This office has reviewed your proposal to dedicate a 50 ft. right of way to Pulaski
County as a subdivision access. The only provision of the Little Rock code applicable to
your project is the street dedication section 31-5, c, 2. The lots are in excess of the five acre
limit for plat filing and if the street were retained as a private roadway we would have no
involvement.
The resolution of this matter can take several courses. If you choose to continue
with the dedication then the Planning Commission must approve of the type of instrument
and improvements.
The earliest review by the commission through normal processes will be on February
21, 1995. If you should decide that time is critical to salvage your sale you could request
permission to be placed on the January 10, 1995 agenda. To do so would require a request
be presented at the subdivision committee meeting Thursday, December 22, 1994.
If you choose such a course it will be necessary for you to attend the Thursday
meeting at 1:00 p.mm in the City Board Room. If you choose to keep the road private no
further action is required.
