NOW, THEREFORE WITNESSETH:
THAT, the said ORLEY O. FEAGINS AND RHODA A. FEAGINS
hereinafter termed gran-tor(s) has caused said tract to be
surveyed by, BEN KITTLER, JR. PLS # 568, and a plat thereof made
which is identified by the title ORLEY FEAGINS SUBDIVISION
Pulaski County, Arkansas, and bears a certificate of approval by
the Pulaski County Planning Board and is of record in the office
of the Circuit Clerk and Ex-Officio Recorder of Pulaski County,
Arkansas, in plat book Page , and the grantor does
hereby make this Declaration of Restrictions.
AND, the grantor does hereby certify that he has laid off,
platted and subdivided, and does hereby lay off, plat and
subdivide said real estate in accordance with said plat. The
lands embraced in said plat shall be forever known as
ORLEY FEAGINS SUBDIVISION, Pulaski County, Arkansas.
The grantor hereby dedicated to the public forever an
easement of way on and over the streets as shown by said plat, to
be used as public streets.
There are strips of ground shown and dimensioned on said
plat marked "10' (foot) Easement" reserved for the use of public
utilities and/or for drainage purposes, subject at all times to
the property authorities and to the easement herein reserved.
Owners of Lots in this subdivision shall take their titles
subject to the rights of public utilities and the public. No
building, fence, incinerator, or any other permanent structure or
improvement of any kind, whether herein specifically enumerated
or not, shall be built or maintained within the area of the
easements shown on the plat, and in the event any such
obstruction is placed thereon in violation of this restriction
and reservation, no utility will be liable for destruction of ---
same in maintaining or -repairing its lines, located within the
area of said easement.
A R T I C L E II.
GENERAL RESTRI CT I ONS
WHEREAS, ORLEY FEAGINS SUBDIVISION desires to create
a development with restrictions, covenants, impositions,
easements charges and liens, as hereinafter set forth for the
preservation of the property values for the owners herein.
NOW, THEREFORE, O_RLEY O. FEAGINS AND RHODA A. FEAGINS_,
declares that the property described in SAID
PLAT is and shall be held, transferred, sold conveyed and
occupied subject to the restrictions, covenants, impositions,
easements, charges and liens hereafter set forth.
1. USE RESTRICTIONS, the property shall be used for single
family dwellings, manufactured homes, and mobile homes, together
with a private garage and any other out building incidental to
the residential use of said land.
A. No building or improvements of any kind shall be erected on
any lot nearer than 25 feet to the front line, nor nearer then 10
feet to any side lot line.
B. Replacing or subdividing any lot shall be in accordance with
rules and relations of Pulaski County and the State of Arkansas
and all the restrictions herein shall apply to each lot resulting
from re -subdividing in the same manner as applicable to lots.
C. All buildings or structures erected or maintained on any lot
in this subdivision must have the exterior completed within
twelve (12) months after the start of construction. Manufactured
Homes should have not less than 720 square feet. Modern Self -
Contained Trailers are allowed, reasonable time not to exceed 180
days before and during construction of a permanent residence on
premises. All Manufactured Homes and structures must be
underpinned (A partition form the bottom of the structure to
ground level concealing the area under the structure), within
ninety (90) days of placement on any lot. The age of Manufacture
Homes shall not be older than seven (7) years upon placement
unless approved by the majority of then existing property owners.
D. Dogs, Cats, and other domestic household pets may be limited
to a total of three (3) animals or pets per each lot, and
maintained by any property owner. All dogs must be confined
unless accompanied by owner. No Commercial poultry or wine
operations or cattle feed lots allowed. Major animals such as
horses, cattle or goats not to exceed more than one for each acre
owned. No more than 20 heads of poultry allowed per acre.
E. No temporary structures. No structure of a temporary
character, basement, tent, shack, garage, barn or other
outbuilding shall be used on any lot at any time as a residence
either temporarily or permanently.
F. No signs, billboards, posters, or advertising devices shall
be permitted upon any of the lots in this subdivision except that
the grantor or owner it its subdividing and sales may place or
erect and maintain a sign not more than four (4) feet square in
size advertising the property for sale.
G. No noxious or offensive trade or activity shall be carried on
in the subdivision, nor shall anything be done therein which may
be or become a nuisance to the neighborhood. No noisy
entertainment or loud music, etc., will be permitted, especially
during the hours of 10:00 P.M. and 8:00 A.M., for the benefit of
the neighborhood.
H. Firearms - Firearms shall not be used or displayed in any
irresponsible or dangerous manner, nor shall firearms be
discharged within the subdivision.
I. Pending availability of public sewers, sewage disposal shall
be effected by means of individual septic tanks, the type of
tank, its construction, location on tracts and title disposal
field shall be approved ny local departments of health, and shall
be maintained at all times in accordance with State and County
sanitary laws. All plumbing and drains must be connected with
water tight septic tanks of approved construction. In no case
shall any portion of any sewage disposal system be installed
within ten (10) feet of main water lines. In any event however,
such disposal system shall meet all health regulations.
2. FENCES. No sheet metal fence or snow fence similar type shall
be erected.
3. NOTICE TO OWNER. Notice of any owner of the valuation or any
of these restrictions or any other notice therein required shall
be delivered or mailed to the owner at the address shown on the
tax roll of Pulaski County, Arkansas by Certified Registered
Mail.
4. NON -LIABILITY OF GRANTOR OR ASSOCIATION. The Grantor or
Association or their agent shall not in any way or manner be held
liable or responsible for any violation of these restrictions by
any person other than itself. In the event that either the
Grantor or Association shall deem it necessary to enforce these
restrictions against any property owner, said property owner
shall be required to pay reasonable attorney fees and court
costs, if the Grantee or the Association shall prevail in said
litigation.
5. DECLARATION OF RESTRICTIONS RUN WITH THE LAND.
The herein contained restrictions shall constitute an easement
and imposition in and upon the property and every part thereof,
and they shall run with the land and shall insure to the benefit
of and are binding upon the enforceable the grantor, association,
or property owner for a period of ten (10) years from the date
these restrictions are recorded. After said date, the
restrictions shall be automatically extended for successive
periods of Ten (10) years unless by a vote of sixty (60) Percent
or more of the association, It is agreed to amend said convents
in whole or in part, and said change or changes are submitted to
the Pulaski County Planning Board for review/approval and are
duly recorded in the office of the Circuit Clerks, the Ex-Officio
recorder of Deeds of Pulaski County. Arkansas.
6. OWNERS COMPLIANCE The covenants, restrictions, and
servitudes imposed by the Declaration of Restrictions shall not
only apply to owners, but also to any person or persons, entity
or entitles, occupying the property by permission or invitation
of the property owner or his tenants, expressed or implied.
Failure of the owner to notify said persons or occupants of the
existence of said restrictions shall not in any act to limit or
divest the right of the grantor, association, or other owners of
enforcement of these restrictions, and in addition, the violating
property owner shall be responsible for all violations of these
restrictions by his tenants, licenses, invitees or guest,
licenses or invites of his tenants at any time.
7. ENFORCEMENT. Enforcement of these covenants and restrictions
shall be by any procedure at law or in equity against any person
or persons violation or attempting to violate any covenant or
restrictions either to restrain violation or to require certain
performance or to recover damages or to enforce any lien created
by these covenants. Any costs of collection, including
reasonable attorney fees incurred in the enforcement of these
covenants, restrictions, or liens shall be paid by the violating
property owner.
B. SEVERAHILITY CLAUSE. Invalidation of any of these
restrictions in whole or in part, by a court of competent
jurisdiction shall be in effect of any of the other restrictions.

does hereby execute this Declaration of Restrictions in its
name, by its undersigned managing partner.

Dear Mr. Feagins:
As you are aware, the Board of Directors approved the waiver of the requirements for
providing Master Street Plan improvements on Burlingame Rd., and for the proposed
pipestem lot design incorporated into the subdivision. In order for me to "close out" my file
on this project, I need to be furnished three (3) copies of the final version of the preliminary
plat, as approved by the Planning Commission, and which reflects the waivers approved by

The following are comments pertaining to the applications
for the September 6 Planning Commission meeting.
1. Ashley Hankins Subdivision - S-45-A-16
Prior to approval of preliminary plan show right-
of-way for additional lane on markham, show
location of proposed Pagis monuments (surveyor has
numbers), label pipe stem portion of Lot 3 as a
permanent access easement to Lots 1 and 2, also a
complete grading and drainage plan will be required
prior to issuing building permits on individual
lots. See notes for CUP case Z-5869.
2. The Hills Subdivision 5-45-A-16
Prior to approval of preliminary plat acquire pagis
monuments no.'s and show locations of proposed
monuments. Submit prior to beginning any work on
site, construction plans for right-of-way
improvements, complete grading and drainage plan as
well as stormwater detention plans.
NW Corner Chenal and Autumn Road 5-1035
Prior to approval revise the plans to eliminate the
curb cut on Chenal Parkway and eliminate 1 curb cut
on Autumn, provide additional dedication of right-
of-way on Autumn to match Master Street plan and
proposed improvements on the east side of Autumn
prior to issuance of building permit provide a
complete grading and drainage plan.
4. University at Hendrix Z-5862 Mad.igan's Replat.
All requirements made under building permit route
#94085 are applicable. Specifically address the
issue of the parking lot and drainage swale in the
floodway. These items must be satisfied before
issuance of the building permit. Prior to approval
the plan must be revised to show the access point
on University. Access will not be allowed on
Hendrix.

Provide, prior to approval a sketch grading and
drainage plan. Before issuance of building permit
engineers plans for right-of-way improvements,
stormwater detention and a complete grading and
drainage plan will be required.

The areas set aside for buffers along Chenal Parkway, Autumn Rd.,
and along the west site perimeter are below minimum ordinance
requirements. The northern land use buffer exceeds the ordinance
requirement of 16 f1. The full buffer requirement along Chenal
Parkway is 16 ft. (minimum required 10 1/2 ft.) The full buffer
requirement along Autumn Rd. is 13 ft. (minimum required 9 ft.) and
along the west site perimeter it is 15 1/2 ft. (minimum required 10 ft.).
Areas provided on the plan submitted average 5 ft. to 8 ft. in width,
with the exception of a 26 ft. wide section along Autumn Rd. adjacent
to the building.
A minimum of 60% of the land use buffers should remain in their
natural state. The method to be used to protect these buffers during
construction should be defined. A 6 ft. high opaque screen will be
required as a part of the land use buffers. This screen ran be a wooden
fence with its structural supports facing inward or dense evergreen
plantings.
A total of six percent of the interior of the vehicular use area must be
landscaped. The building landscaping requirement calls for an average 3
ft. wide landscape strip between the public parking areas and the building.
Curb and gutter or another approved border will be required to protect
landscaped areas from vehicular traffic.
12. Pro -Life Center (Z-5862)
Areas set aside for buffers and landscaping meet ordinance requirements.
A 6 ft. high opaque screen is required to screen this site from the
residential property to the east. This screen may be a wood fence with its
structural supports facing inward or dense evergreen plantings.

14. Pilgrim Rest Baptist Church (Z-5828-B)
A landscaping upgrade toward compliance with the landscape ordinance
equal to the building expansion proposed (82%) will be required or a
waiver by the City Beautiful Commission obtained. The landscape

vehicular use area must be landscaped.

23. Safelite Auto Glass (Z-5871)
The opaque dumpster enclosure height must be increased from 6 ft. to
8 ft. A total of 6% of the interior of the vehicular use area must be
landscaped. The proposal submitted is 96 sq. ft. short of this requirement.
