TRACT 9-A-1 AND TRACT 9-A-2, LITTLE ROCK INDUSTRIAL DISTRICT
(BEING A REPLAT OF TRACT 9-A, LITTLE ROCK INDUSTRIAL DISTRICT,
AN ADDTION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS)
JCG INVESTMENTS, LLC and INDUSTRIAL PROPERTIES LIMITED PARTNERSHIP
KNOW ALL PERSONS BY THESE PRESENTS:
WHEREAS, JCG Investments, an Arkansas limited liability company, and Industrial
Properties Limited Partnership, an Arkansas limited partnership ("Grantors"), are the owners of
certain real property in City of Little Rock, Pulaski County, Arkansas ("the Property"), more
particularly described as follows:
SEE EXHIBIT A ATTACHED HERETO AND MADE A PART HEREOF FOR ALL
PURPOSES
WHEREAS, Grantors wish to replat the Property into two lots, eliminate any easements
and other platted setbacks on the original plat and any related bills of assurance, as amended, and

after replatting own and hold such replatted lot subject only to the easements, setbacks,
dedications, restrictions and other matters set forth on the Plat referenced in Paragraph 1 hereof,
NOW, THEREFORE, for and in consideration of the benefits to accrue to Grantors, their
successors and assigns, the receipt and sufficiency of such consideration being hereby
acknowledged, Grantors hereby make this Plat and Bill of Assurance, and hereby establish the
covenants, restrictions and conditions pursuant to which the Property shall be owned and used,
which covenants and restrictions shall run with the Property as set forth below.
1. TRACT 9-A-1 AND TRACT 9-A-2, LITTLE ROCK INDUSTRIAL DISTRICT, AN
ADDITION TO THE CITY OF LITTLE ROCK PULASKI COUNTY. ARKANSAS. Grantors
have caused the Property to be surveyed and a plat ("the Plat") made thereof by Joe White &
Associates, Inc., which Plat bears the signature of the surveyor and engineer and is recorded in the
office of the Circuit Clerk and Recorder of Pulaski County, Arkansas as Instrument
No. . The Property shall henceforth be subdivided into two tracts,
respectively referred to as Tract 9-A-1 and Tract 9-A-2, Little Rock Industrial District, an Addition
to the City of Little Rock, Pulaski County, Arkansas ("the Tracts"), which descriptions shall be
sufficient in all respects and for all purposes. All persons or entities who are or become the fee
owner of either of the Tracts shall take title to such tract and hold it according the terms of this
Plat and Bill of Assurance and to the monuments and pins located on the ground.
2. Building Setbacks and Easements. All prior utility easements, drainage easements, setback
lines, rights of ingress and egress, or other encumbrances or limitations on the use of the Property
are extinguished, and the building setback lines, rights of way, utility easements and other matters
as shown on the Plat are now the sole and only setback lines, rights of ingress and egress, rights of
way, easements and other encumbrances or limitations which apply to and bind the Tracts.

3. Duration. The terms, conditions and restrictions of this declaration shall remain in full force
and effect for a period of twenty-five (25) years from the date of filing, and shall be extended for
consecutive periods of ten (10) years thereafter unless Grantors, their successors and assigns, file
an instrument of record which modifies or terminates these covenants.
4. Severabilit . Invalidation of any restriction set forth herein, or any part hereof for any reason
shall not invalidate or affect any of the other restrictions, which shall remain in full force and
effect.
