THAT, WHEREAS, NOLAND PROPERTIES, INC., a Virginia corporation, 2700 Washington WW
Avenue, Suite 400, Newport News, VA 23607, is the sole owner of certain lands lying in the Pulaski
County, State of Arkansas, described in Exhibit "A" attached hereto;
AND WHEREAS, it is desirable that all of the above described property be platted into two lots;
NOW THEREFORE WITNESSETH:
THAT the said Noland Properties, Inc. hereinafter termed "Grantor" has caused said tract of land
to be surveyed by White-Daters & Associates, Inc., Registered Professional Engineers and Land
Surveyors, and a plat thereof made which is identified by the title "LOTS 2 AND 3, FREEWAY
BUSINESS PARK, an Addition to the City of Little Rock, Arkansas", and the date of
.1 vl ZOO 3 and by the signature of the Circuit Clerk and ex-officio Recorder of Pulaski
County, Arkansas in Plat Book —a-- page7)-1 and the Grantor does hereby make this Bill of Assurance.
AND, the Grantor hereby certifies that it has laid off, platted, and subdivided, and does hereby
lay off, plat and subdivide said real estate in accordance with said plat. The land embraced in said plat
shall be forever known as LOTS 2 AND 3, FREEWAY BUSINESS PARK, an Addition to the City of
Little Rock, Arkansas.
There are strips of ground shown and dimensioned on said plat marked "Utility and/or Drainage
Easement" reserved for the use of public utilities and for drainage purposes, subject at all times to the
proper authorities and to the easement herein reserved. The purchaser of this lot shall take title subject to
the rights of public utilities and the public.
The filing of this Bill of Assurance and plat for record in The Office of The Circuit Clerk and ex-
officio Recorder of Pulaski County shall be a valid and complete delivery and dedication of the
easements and street rights of way shown on the said plat.
Hereafter, conveyance and description of said lands by lot number shown on said plat, shall be
proper and sufficient description thereof.
The lot in said subdivision shall be sold by the Grantor and shall be purchased by the purchaser
thereof, subject to the following covenants, to wit:

1. Said land within said Lot shall be held, owned, and used in compliance with the zoning,
subdivision, landscaping, and sign ordinances of the City of Little Rock as they applied to said land at
the time of recording hereof.
2. Any and all covenants, provisions and restrictions set forth in this Bill of Assurance may be
amended, modified, extended, changed or canceled, in whole or in part, by a written instrument signed
and acknowledged by the Owners in LOTS 2 AND 3, FREEWAY BUSINESS PARK and the
provisions of such instruments so executed shall be binding for and after the date such is duly filed for
record in Pulaski County, Arkansas. The covenants, restrictions, and provisions of this instrument shall
be deemed covenants running with the land and shall remain in full force and effect unless and until
amended or canceled as authorized hereinbefore. Provided, however, no amendment to the Bill of
Assurance which closes, alters, relocates, or in any -manner affects any such easement shall be effective
unless such amendment has been executed by each utility having facilities situated in such easement.
3. In the event of any attempt to violate any of the covenants or restrictions herein, it shall be
lawful for any person or persons owning land in LOTS 2 AND 3, FREEWAY BUSINESS PARK to
prosecute any proceedings at law or equity against the person or persons violating or attempting to
violate any such covenant or restriction, and either to prevent him or them from so doing or to recover
damages or other dues for such violation.
4. The invalidation of any of these covenants or restrictions by judgment or court order shall in
no way affect any of the other provisions which shall remain in full force and effect.

to execute this Bill of Assurance for Noland Properties, Inc., and further stated and acknowledged

and purposes therein mentioned and set forth.
