4 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO
5 ENTER INTO A CONTRACT WITH POSITIVE RESULTS LAWN
6 SERVICES, INC. IN AN AMOUNT NOT TO EXCEED TWO
7 HUNDRED EIGHTY-FOUR THOUSAND, TWO HUNDRED
8 FORTY-FIVE DOLLARS AND 20/100, ($284,245.20), FOR
9 DURWOOD ROAD DRAINAGE IMPROVEMENT PROJECT; AND
10 FOR OTHER PURPOSES.

12 WHEREAS, it has been deemed appropriate and necessary to analyze and design roadway
13 improvements to address street deficiencies in the vicinity of Brownwood Road and Durwood Road
14 to capture storm runoff to prevent street flooding and damage to residential properties; and,
15 WHEREAS, project improvements include construction and installation of new curb inlets
16 and underground storm drainage;and,
17 WHEREAS,pursuant to Bid Event No. 2692, Positive Results Lawn Services, Inc. was the
18 lowest responsive, responsible bid meeting the requested bid requirements out of two (2) bids
19 received; and,
20 WHEREAS,the total cost of the project shall not exceed Two Hundred Eighty-Four Thousand,
21 Two Hundred Forty-Five and 20/100, ($284,245.20),which includes the base bid amount of Two
22 Hundred Thirty-Six Thousand, Eight Hundred Seventy-One 00/100 Dollars ($236,871.00) and a
23 20% contingency of Forty-Seven Thousand, Three Hundred Seventy-One and 20/100 Dollars
24 ($47,374.20), if needed; and,
25 WHEREAS, funding for the project is from the Limited Tax General Obligation Capital
26 Improvement Bonds as authorized by Little Rock, Ark., Resolution 15,968 as authorized by
27 Resolution 15,968(May 2,2023)with funds from Account Activity B3D024D;
28 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
29 CITY OF LITTLE ROCK,ARKANSAS:
30 Section 1. The Board of Directors authorize the City Manager to execute an agreement with
31 Positive Results Lawn Services, Inc. in an amount not to exceed Two Hundred Eighty-Four
32 Thousand, Two Hundred Forty-Five Dollars and 20/100, ($284,245.20), which includes a 20%
33 contingency of Forty-Seven Thousand, Three Hundred Seventy-One and 20/100 Dollars
34 ($47,374.20),for the Durwood Road Drainage project.

1 Section 2. Funding for this project is from the Limited Tax General Obligation Capital
2 Improvement Bonds as authorized by Little Rock,Ark.,Resolution 15,968(May 2,2023).Account
3 Activity B3D024D.
4 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
5 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such
6 declaration or adjudication shall not affect the remaining portions of the resolution which shall
7 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional
8 was not originally a part of the resolution,
9 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
10 inconsistent with the provisions of this resolution, are hereby repealed to the extent of such
11 inconsistency.
