VARIANCES REOUESTED:
1) A waiver from the requirement to dedicate 20 feet of

STATEMENT OF PROPOSAL:
The applicants propose to divide their property in order for
their son to build a home at the rear of the acreage. Proposed
is a preliminary plat containing 2 lots configured to provide the
necessary frontage on Ironton road to meet the minimum
requirements of Water Utility for water service and contain the
individual septic systems for each residence. No dedication of
right-of-way or improvements to the existing streets, Ironton
Road and Timothy Lane, are proposed.
A. PROPOSAL/REOUEST:
Review by the Planning Commission is requested for a
preliminary plat containing 2 lots. Approval of the Board
of Directors is sought for waivers from the Subdivision
Regulations.

B. EXISTING CONDITIONS:
The site is outside the City Limits of Little Rock, in a
rural setting. There are residences scattered all around
the area, with a church immediately to the north. The site
presently has a home at the front of the property on the
Ironton Road frontage, with two out -buildings behind it.
Ironton Road is a paved county road with a 50 foot
dedication. Timothy Lane is a gravel county road, also with
a 50 foot dedication.
C. ENGINEERING UTILITY COMMENTS:
Engineering reports that the Master Street Plan designates
Ironton Road as a minor arterial road; consequently, Ironton
Road is required to have a right-of-way of 90 feet. The
applicant should dedicate right-of-way of 45 feet from the
Ironton Road center line. Timothy Lane is shown as a
residential street on the Master Street Plan. It should
have a right-of-way of 50 feet. The plat which has been
submitted indicates that the required right-of-way on
Timothy Lane has been dedicated. The Master Street Plan and
Subdivision Regulations will require improvements
(construction of one-half of the required roadway and
construction of sidewalks) on both Ironton Road and Timothy
Lane.
water works reports that execution of a "Pre -annexation
Agreement" and approval by the City will be required in
order to obtain water service. A pro-rata acreage charge of
$100/acre ($60 per lot minimum) will apply in addition to
the normal connection charges.
Wastewater reports that the proposed subdivision is outside
their service boundary.
Arkansas Power and Light approved the submittal without
comment.
ARKLA Gas approved the submittal without comment.
Southwestern Bell approved the submittal without comment.
The Fire Department approved the submittal without comment.
Pulaski County Planning approved the submittal without
comment.

D. ISSUES/LEGAL/T_EC_HNICAL/DESIGN:
The houses on both Tract 1 and on Tract 2 are required to
have 25 foot rear yards. The accessory buildings are to
have 3 foot rear yards. The line dividing the tract into
the two lots needs to be located so that setback
requirements are met, and the proposed house located so that
the rear yard is 25 feet, or setback lines as needed are to
be shown and platted.
E. ANALYSIS•
The required documentation is essentially complete, except
as noted above. This is a family homestead being divided so
that a family member can have a separate home on the land.
The site is in a rural area which is not anticipated to
change in character in the immediate future. Ironton Road
meets the county standards and serves the needs of the rural
area it serves. Timothy Lane is a dead-end street serving
only a few residences.
F. STAFF RECOMMENDATIONS:
Staff recommends approval of the application, with the
stipulation that the needed modifications be made. Staff
recommends that the required right-of-way on Ironton Road be
dedicated, but that improvements to Ironton Road and Timothy
Lane be waived.
SUBDIVISION COMMITTEE COMMENT: (October 28, 1993)
Mr. and Mrs. Jessie Burlison, the applicants, were present.
Mr. Ben Kittler, Jr., the surveyor, was present. Staff presented
the request. Mr. and Mrs. Burlison explained the rationale for
their request, and Mr. Kittler responded to the staff concerns
outlined in the discussion outline. There was a discussion on
the need for either relocating the proposed lot division line and
the proposed building so that non -conforming structures were not
created, or, alternatively, platting the building area in the
plat. Mr. Kittler indicated that he would make the changes.
There was also discussion on the needed right-of-way for future
Ironton Road expansion. Mr. Kittler indicated that waivers on
the improvements would be pursued to the Board of Directors. The
Committee referred the item to the Commission for the hearing.
PLANNING COMMISSION ACTION: (November 16, 1993)
Staff presented the item and reported that there are no
unresolved issues to be addressed. The item was included on the

consent agenda for approval and was approved with the vote of

AN ORDINANCE AMENDING CHAPTER 31 OF THE
CODE OF ORDINANCES OF THE CITY OF LITTLE
ROCK, ARKANSAS PROVIDING FOR A WAIVER OF
BOUNDARY STREET AND SIDEWALK REQUIREMENTS
FOR BURLISON SUBDIVISION (S-994) LOCATED
AT 13,522 IRONTON ROAD.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That Chapter 31 of the Code of Ordinances
be amended to provide for a waiver of certain requirements
within the Subdivision Regulations of the City of Little
Rock for Burlison Subdivision (S-994) as follows:
Subsection a. That Chapter 31, Section 31-201(h)
which requires one-half of Master Street Plan
specified improvements be provided on boundary
streets, and provide for a waiver of the
requirement that one-half of Ironton Road and a
sidewalk along the Ironton Road frontage be
constructed and a waiver of the requirement that
one-half of Timothy Lane along the Timothy Lane
frontage be constructed.
SECTION 2. This ordinance shall take effect thirty (30)
days from and after its passage.
