Box 5151 North Little Rock, AR 72119 PLAT M BILL OF ASSURANCE HOME DEPOT U.S.A., INC.; MABELVALE PLAZA PHASE II, LLC and MABELVALE PLAZA PROPERTY OWNERS' ASSOCIATION, LLC TO THE PUBLIC KNOW ALL MEN BY THESE PRESENTS: WHEREAS, Home Depot U.S.A., Inc., Mabelvale Plaza Phase II, LLC and Mabelvale Plaza Property Owners' Association, LLC (the "Grantors") respectively own the following described lands in lying in Pulaski County, Arkansas, to wit: Lot 14, Mabelvale Business Center, an Addition to the City of Little Rock, Pulaski County, Arkansas and ',: _o Part of the NE 1/4 of Section 3, T-1-S, R-13-W, Pulaski County, Arkansas more particularly described as: Beginning at the Northwest corner of Lot 14, Mabelvale Business Center, Little Rock, Arkansas; thence SO1°45'45"W along the West line of said Lot 14, 254.83 ft. to the Southwest corner of the NE 1/4 NE 1/4, said Section 3; thence S00°59'36"W continuing along said West line, 152.45 ft.; thence N84°18146"W, 186.33 ft. to a point on the East right-of-way line of Mabelvale Pike; thence Northeasterly along said East right-of-way line the following: (1) N08°46'00"E, 274.11 ft.; (2) N45027'42"E, 140.23 ft. and (3) N70°16'43"E, 57.54 ft. to the point of beginning, containing 1.3243 acres more or less. and Mabelvale Plaza Lane, Mabelvale Business Center, an Addition to the City of Little Rock, Pulaski County, Arkansas (the "Land") which is shown on the plat attached to and made a part of this instrument (the "Plat") as Lots 14R and 20 and Mabelvale Plaza Lane, Mabelvale Business Center, an Addition to the City of Little Rock, Arkansas in the City of Little Rock, Pulaski County, Arkansas; and WHEREAS, it is deemed desirable by the Grantors that the Land be platted as lots and a private street; and WI-IF-REAS, by this Plat and Bill of Assurance, the Grantors intend to create for their benefits, and for the mutual benefit of all future owners of the Land, certain rights, easements, covenants and conditions governing the use, enjoyment and maintenance of the Land; - 2 - NOW, THEREFORE, the Grantors for and in consideration of the benefits to accrue to them, which benefits they acknowledge to be of value, hereby plat the Land as Lots 14R and 20 and Mabelvale Plaza Lane, Mabelvale Business Center, an Addition to the City of Little Rock, Pulaski County, Arkansas. Henceforth, description and conveyance by such designation as shown and represented on the Plat shall be a proper and sufficient description for all purposes. The boundaries, size and dimensions of such lots and private street are as shown in the annexed copy of a plat thereof made by White-Daters & Associates, Inc., Civil Engineers, which plat is by reference incorporated in and made a part of this Bill of Assurance. Henceforth, for conveyancing and all other purposes, it shall constitute a lawful and sufficient description of said lands to describe the same as: Lots 14R & 20 and Mabelvale Plaza Lane, Mabelvale Business Center, an Addition to the City of Little Rock, Pulaski County, Arkansas. Permanent easements for access, ingress and egress, for drainage, for laying and maintaining pipes and mains, lines and cables, storm sewers, and for the installation and maintenance of water, sewer, gas, electric, telephone, cable television, fiber optic and other utilities are created, excepted and reserved over, under, across and through the Land as shown on the Plat. - 3 - The right to amend, modify, extend, change and/or cancel shall exist at all times before July 1, 2030, and shall also exist at all times during each and every one of the successive ten (10) year periods provided for hereinafter and shall become effective when each such instrument is filed for record in the office of the Recorder of Pulaski County, Arkansas. The covenants, restrictions, and provisions of this instrument shall be automatically extended for successive periods of ten (10) years each on and after July 1, 2030, unless and until amended or canceled as authorized hereinbefore then such automatic extensions for successive periods of ten (10) years each shall apply to this instrument as so changed. Invalidation of any restriction set forth herein or any part thereof by an order, judgment, or decree of any Court or otherwise shall not invalidate or affect any of the other restrictions or any part thereof as set forth herein but they shall remain in full force and effect.
