Irwin and Robert E. McCarley, hereinafter called "Owners," have caused certain lands owned by them to be platted into an addition known as Fairview Park (the "Addition") to the City of Little Rock, Pulaski County, Arkansas, described as follows: See Exhibit 'A' Attached A copy of said plat appears of record in the office of the Recorder of Pulaski County, Arkansas, in Plat Book , at Page ; and WHEREAS, it is the desire and intent of Owners that commercial buildings, signs, and other appurtenances placed within said subdivision be designated and placed in such a manner their location, orientation on the lot, architecture, landscaping, method of identification (signs), are in harmony with the other buildings in the subdivision and are individually and collectively useful and attractive; NOW, THEREFORE, Owners hereby adopt the Restrictive Covenants stated herein and agree the stated covenants shall apply to all of the property now platted as the Addition to the City of Little Rock, Pulaski County, Arkansas, as covenants running with the Land: I. SCOPE OF APPLICATION These covenants shall apply in their entirety to the area now known and described as the Addition to the City of Little Rock, Pulaski County, Arkansas, as shown in the recorded plat thereof. II. PURPOSE OF COVENANTS The purpose of these Restrictive Covenants is to: (A) Provide an architecturally pleasing and compatible plan of development for the property; (B) Protect the owners and tenants of building sites against improper development and use of surrounding building sites which will depreciate the value and/or adversely affect the use of their building sites; (C) Prevent the erection or maintenance on the Addition to the City of Little Rock, Pulaski County, Arkansas lots of structures constructed of improper or unsuitable quality of construction; (D) Ensure adequate, consistent and reasonable development of the Addition to the City of Little Rock, Pulaski County, Arkansas lots as high -quality commercial environment; (E) Encourage and ensure the erection of the attractively designed improvements appropriately located within the Addition to the City of Little Rock, Pulaski County, Arkansas in order to achieve harmonious appearance and function; (F) Provide minimum maintenance standards to promote a uniform, neat and clean appearance throughout Addition to the City of Little Rock, Pulaski County, Arkansas; and (G) Guide the development of the Addition to the City of Little Rock, Pulaski County, Arkansas. III. DEVELOPMENT STANDARDS AND PROTECTIVE COVENANTS 1. Materials and/or methods of construction for all proposed structures (office buildings) within the Addition to the City of Little Rock, Pulaski County, Arkansas Office Development shall be as follows: (A) Foundation systems shall be either concrete footings, continuous and pad type, or drilled pier and grade beams, subject to recommendations from a soils investigation consultant. (B) Perimeter walls shall be framed using structural (load - bearing) wood or steel studs, with interior steel columns and beams as required for resulting roof loads and spans. Roof structure shall be steel trusses. (C) Exterior wall finishes shall be face brick, with a synthetic stucco system used as a secondary or accent finish. Gable ends and soffits shall be synthetic stucco or refinished/perforated metal panels. windows shall be wood or aluminum, and entry glazing systems (doors & fixed glass) will be anodized aluminum frames with tinted, insulated glass. Roofing shall be metal. 2. In order to insure that all buildings located on any Addition to the City of Little Rock, Pulaski County, Arkansas lot shall be compatible with other improvements within the addition, no buildings shall be erected, placed or altered on any lot in the addition until the construction plans and specifications have been submitted to, and approved by, the Architectural Control Committee. for such time as the Owners shall own one or more of the lots in the addition, the Architectural Control Committee shall be made up of James S. Irwin and Robert E. McCarley. At such time as the Owners shall own none of the lots in the addition, or at such earlier time as the Owners may elect to resign from membership on ;bs\im-� 2.bm the Architectural Control Committee, the Committee shall be made up of such persons as the Association may designate from time to time. 3. After construction has commenced on a lot, or if any improvement is damaged or destroyed, the improvement must be completed, maintained, or restored promptly in order to avoid any unsafe or unsightly condition. the Owners shall have the right to have any completion, maintenance, or restoration of improvements done and charge any expenses associated with this action to the property owner if the property owner fails to comply with this provision. IV. SCOPE OF AGREEMENT 1. Run with the Land. These covenants and restrictions shall run with the land and shall be binding on all parties, their heirs and assigns, for a period of twenty-five (25) years from the date and covenants by filing said amendments in writing in the land records of Pulaski County, Arkansas. If no such action, these covenants shall continue for successive five (5) year increments and any five-year period may be terminated in accordance with the terms of the original termination. A majority of the land owners may amend these covenants at any time after all lots are sold by the Owners, said amendments to be in writing and by recording in the land records of Pulaski County, Arkansas. 2. Violations. If any party or lot owner violates or attempts to violate these covenants or restrictions it shall be lawful for any person or persons owning any interest in any lot to prosecute any proceeding at law or in equity against the person or persons violating or attempting to violate any such covenants or restrictions, either to prevent them from doing so or to recover damages or other penalties for such violation. 3. Invalidation. Invalidation of any one of these covenants by judgement or court order shall, in no way, affect any of the other provisions herein contained.
