STATEMENT OF PROPOSAL:
The applicant proposes a one -lot subdivision in order to
construct a residence on land he purchased in March, 1993. No
improvements to the street or construction of a sidewalk along
the Sussie Lane frontage are proposed. Approval of the Board of
Directors for a waiver of street improvements and sidewalk
construction on Sussie Lane is sought.
A. PROPOSAL/REQUEST:
Approval by the Planning Commission is requested for a
one -lot subdivision in order for the applicant to construct
a residence. Approval of the Board of Directors for a
waiver of street improvements and sidewalk construction of
Sussie Lane is requested.
B. EXISTING CONDITIQNS:
The existing site is undeveloped and overgrown with trees
and natural vegetation. The site is currently zoned "R-211,
as is all the surrounding area. Sussie Lane is an open
ditch rural -type "chip seal" street which dead -ends at the
west edge of the subject property.

C. ENGINEERING UTILITY COMMENTS:
The Engineering Division comments that the right-of-way for
Sussie Lane needs to be dedicated. One half of Sussie Lane
needs to be improved to standard, and a sidewalk needs to be
constructed.
Water Works reports that a water main extension will be
required with an acreage charge of $150.00 per acre being
applicable.
Wastewater Utility reports that sewer is available.
Southwestern Bell Telephone Co. and the Fire Department have
approved the submittal without comment.
D. ISSUES/LEGAL/TECHNICALLDESIGN:
The tract represented by the application was created by a
sale which took place in March of 1993. This division of
the property constituted an illegal subdivision. The one
lot subdivision as submitted, then, is not appropriate. The
larger tract from which this tract was derived is to be
included in a plat, with the property shown in the current
application being one of the lots.
The plat, as submitted, is incomplete: the Preliminary
Certificate of Surveying Accuracy is incomplete; the
Vicinity Map is insufficient; adjacent subdivisions, with
the book and page number of their recording, or, when the
property has not been subdivided, the names of adjacent
property owners must be shown on the plat; the width of the
street right-of-way and width of the pavement are to be
shown; and, the zoning classification of the site is to be
shown.
E. ANALYSIS:
The item has major deficiencies. The applicant is the owner
of the one lot. The person from whom this applicant brought
the tract needs to correct the matter of the illegal
subdivision of his property prior to action being taken on
the subject tract.
Sussie Lane is a dead-end short section of street. It is
reasonable, then, to give the requested relief from the
requirement to construct the street and build a sidewalk.

F. STAFF RECOMMENDATIONS:
Staff recommends deferral of this item pending an
application for a preliminary plat on the entire tract from
which this item was taken. Staff recommends approval of the
waiver from the requirements to construct the street and the
sidewalk.
SUBDIVISION COMMITTEE COMMENT:
(June 24, 1993)
Mr. Charlie Miller, the project engineer, was present. Staff
outlined the concerns regarding the illegal subdivision of land
which occurred and which produced the subject property.
Mr. Miller responded that he had met with the owner of the
original tract, and that he would attempt to complete documents
to amend the application by the date of the Commission hearing.
The Committee reviewed the deficiencies noted in the discussion
outline, and Mr. Miller indicated that he would make the needed
corrections. The Committee forwarded the item to the Planning
Commission for final resolution with the understanding that
amended drawings and an amended application would be furnished at
that time.
PLANNING COMMISSION ACTION:
(JULY 13, 1993)
Mr. Charles Miller, the engineer for this item, was
present. Staff indicated that there had been no
resolution of the deficiencies noted in paragraph IUD",
"ISSUES/LEGAL/TECHNICAL/DESIGN", AND "Ell, "ANALYSIS" above,
and discussed at the Subdivision Committee meeting. Mr. Miller
reported that he had gained approval to include the tract from
which the single lot had been derived in the subdivision plat,
and would present a revised plat as required. Mr. Miller asked
that the item be deferred to allow him time to complete the
drawings. The deferral was approved by the commission with
10 ayes and no nays.

The applicant has amended the request to include the tract from
which the originally submitted lot was derived, and has changed
the name from the "Bailey's Addition" to the "Burch and Railey
Addition". The lot on Stagecoach Road, owned by Mr. Burch, will
require the dedication of an additional 15 feet of right-of-way
for Stagecoach and making an "in -lieu" payment for future
improvements to Stagecoach. Mr. Burch requests a waiver from the
requirement to dedicate right-of-way and the imposition of the

"in -lieu" payment, since, he reports, the State is planning to
buy the right-of-way and reconstruct Stagecoach Road in the near
future.
PLANNING COMMISSION ACTION: (AUGUST 24, 1993)
This item was included in the Consent Agenda for approval of the
Preliminary Plat. Staff reported that the applicant had
submitted all exhibit requirements, but has indicated that he is
unwilling to dedicate right-of-way on Shackleford Road or to make
an "in -lieu" payment for future Shackleford Road improvements.
Staff also reported that approval of the Preliminary Plat would
need to be contingent on approval by the Board of Directors of a
waiver of the requirements for street improvements and sidewalk
construction on Susie Lane and a waiver of the requirements for
right-of-way dedication, street improvements, and sidewalk
construction on Shackleford Road. Commissioners wanted to verify
that an affirmative vote for the Preliminary Plat did not
constitute a recommendation of approval of the waivers; Staff
indicated that it did not. The Preliminary Plat was approved in
the approval of the Consent Agenda with the vote of it ayes and
no nays.
