PLANNING DISTRICT: 12 CENSUS TRACT: 24.05 VARIANCES REQUESTED: None STATEMENT ❑F PROPOSAL: The applicant proposes the platting and subdivision of his property in order to sell the south Lot 1 tract for development of a mini -storage facility. The larger "Tract A° is proposed to be retained for future development. A. PROPOSAL RE UEST: Approval of the Planning Commission is requested for the proposed Buie Subdivision preliminary plat. The larger "Tract All consists of 8.061 acres and is to be retained by the applicant for future development; the smaller Lot 1, a 3.359 acre tract, is proposed to be sold for development as a mini -storage facility. No variances are requested. B. EXISTING CONDITIONS: The entire tract is currently being used as a junk yard. It is unfenced and is an eyesore. Car, truck, and bus shells and parts litter the site. The site is overgrown with weeds. There are a great many trees on the site. Immediately to the north and west are "R-211 zoned parcels. To the north is also 11I-2,, land; to the ease and south is all 111-211. C. ENGINEERING UTILITY COMMENTS: Little Rock Engineering comments that the Master Street Plan will require the dedication of 30 feet for right-of-way on Colonel Glenn Road and 5 feet on Shackleford Road. Street improvements will be required along both streets for Final Plat approval. Engineering also notes that the location of the PAGIS monuments is required to be shown on the plat. Water Works reports that a pro-rata charge for water service will be applicable. Charges are $15.00 per foot for Lot 1; $2.50 per foot for property that has frontage exclusively on Colonel Glenn Road. Tract "A" charges for property with frontage on Shackleford or Colonel Glenn are $2.50, $9.00, and/or $15.00 per foot. On -site fire protection will be required. Wastewater Utility relates that the 8" sewer main shown on the plat is not part of the Little Rock Wastewater System and cannot be used for sewer service. A sewer main extension will be required with easements. Arkansas Power and Light Co. reports that additional easements are required. Southwestern Bell Telephone Co., ARKLA, and the Fire Department have approved the submittal without comment. D. ISSUES/LEGAL/TECHNICAL/DESIGN: The preliminary plat, as submitted, is incomplete. The border of the designated "Tract All is not indicated with the required heavy bold line. Ownership information of the adjacent land, or, where appropriate, any platted subdivisions which adjoin the parcel, along with the book and page number of their recording, are not shown. The existing zoning classification of the tract is not shown. The location of the edge of the existing street pavement is not shown. E. ANALYSIS: The junk yard and storage of wrecked vehicles and parts is a non -conforming use which was in existence when the area was annexed. zoning Enforcement has been seeking to abate the unsightly conditions. The subdivision is made necessary in order to sell the property along Shackleford Road for development as a mini -storage facility. F. STAFF RECOMMENDATIONS: Staff recommends approval of the application. Staff is eager to have this property developed and cleaned up. SUBDIVISION COMMITTEE COMMENT: (June 24, 1993) Mr. Bob McFarlane, the owner's representative, and Mr. Pat McGetrick, the engineer of this project, were present. Staff presented the item and Mr. McFarlane and Mr. McGetrick presented the owner's proposal. Mr. McFarlane indicated that he had met with Wastewater Utility personnel at the site and they had investigated the sewer which Wastewater Utility indicates is not theirs. Mr. McFarlane reported that, indeed, the sewer main and manhole are in place and that Wastewater Utility has acknowledged that the sewer will be accepted. The Committee reviewed the plat and the discussion outline comments and questioned the applicant's representatives. The Committee then forwarded the item to the Commission for final resolution. PLANNING COMMISSION ACTION: (JULY 13, 1993) This item was included on the Consent Agenda for deferral to the August 24, 1993 hearing date. The applicant had submitted a letter asking for the deferral, and this letter had been receive by staff in sufficient time to meet the Bylaws requirement for inclusion on the Consent Agenda for deferral. NEW STREET: ill (For the Lot 2 frontage on Shackleford Rd. only) ZONING R-2 and PCD PLANNING DISTRICT: 12 CENSUS TRACT: 24.05 VARIANCES REQUESTED: TATEMENT F PROPOSAL: PROPOSED USES: None The Existing non- conforming salvage yard use is to remain on Tract 1. A PCD for a mini -storage facility was approved for Lot 2 A preliminary plat was approved by the Planning Commission for the Buie Subdivision on July 13, 1993. The proposal, at that time, was for a Tract A, which was to remain in preliminary plat status and was to retain its non -conforming salvage yard use. No dedication of right-of-way or improvements to Colonel Glenn Rd. or Shackleford Rd. along the Tract A frontage were proposed. Lot 2 was to be platted as a PCD, and Shackleford Rd. right-of-way dedication and street improvements were included. The applicant proposes a one-year time extension on this approval, saying that it has taken longer than expected to work out financing for the mini -storage facility which is to occupy Lot 2 of the subdivision____ The- PCD_for_the_mini.-storage ..facility -was approved by the Planning Commission on August 24, 1993, then by the Board of Directors on September 21, 1993, in Ordinance No. 16,491. October 18, 1994 SUBDIVISION ITEM 1 n in FILE NQ.: S-9a4 A. PROPOSAW REOUE$ : Planning Commission approval of a one-year time extension of the approval of the Buie Subdivision preliminary plat is requested. B. EXISTING CONDITIONS: The bulk of the site, designated as Tract A, is the location of the applicant's non -conforming salvage yard operation. The area designated as Lot 2, the area of the PCD on which the mini -storage facility has been approved, has been mostly cleared of salvage materials. C. ENGINEERINGIUTILITY COMMENTS: There are no comments requested with the proposal for the time extension. D. ISSUES/LEGALITECHNICAL/DESIGN: Section 31-94(e) of the Subdivision Regulations states: "A preliminary plat ... shall be effective and binding upon the commission for twelve (12) months, or as long as work is actively progressing, at the end of which time the final plat application for the subdivision must have been submitted to the planning staff. Any plat not receiving final approval within the period of time set forth herein or otherwise conforming to the requirements of this chapter shall be null and void, and the developer shall be required to submit a new plat of the property for preliminary approval...." Section 36-454 of the Zoning Regulations provides that a developer: ..shall have three (3) years from the date of preliminary plan approval to submit the final development plan/plat." E. ANALYSIS• The preliminary plat was approved on July 13, 1993; the PCD on September 21, 1993. Work was initiated to clean the property of the salvage vehicles and of undergrowth within the twelve (12) month time period, but was interrupted when financing was delayed. Although a final plat has not been submitted -to staff -within -the..one-year__time-limit, clearing work was begun. Additionally, the applicant has three (3) years to begin work on the PCD. There would be no new requirements imposed on the development if a new preliminary plat review were required, so there is no reason not to approve the requested time extension. 2 October 18, 1994 SUBDIVISION ITEM N 1 n in FILE NQ.: S-984 F. STAFF RECOMMENDATIONS: Staff recommends approval of the one-year time extension. SUBDIVISION COMMITTEE COMMENT: (SEPTEMBER 29, 1994) Mr. Bob McFarlane, the applicant's representative, was present. Staff outlined the request. The Subdivision Committee members reviewed the proposal, and, with minimal discussion, referred the item to the Commission for the public hearing. PLANNING COMMISSION ACTION: (OCTOBER 18, 1994) Staff reported that there were no issues to be resolved, and recommended approval of the time extension. The item was included on the Consent Agenda for approval of the time extension. The time extension was approved with the approval of the Consent Agenda with the vote of 9 ayes, 0 nays, 1 absent, and 1 abstention (Putnam). 3
