A. Existing Conditions
Property is heavily wooded with slopes of 20% to
the south, 9-11% to the north, and 30-50% in the
east and southeast. Crest of a hill is located at
the center of the tract.
Treasure Hill Road intersects Reservoir Road
approximately 125' to the south of the proposed
cul-de-sac.
All streets and utilities have been extended to the
site. Existing zoning is "E-l" Office. The
property to the immediate north is zoned "MF-24".
B. Development Proposal
There will be the usual clearing and grading for
proposed street and building construction.
Developers propose construction of 40 apartment
units on Lot 2 and an office building on Lot 1.
The number of apartment units proposed amounts to
10.7 units per acre on Lot 2.
Approximately 134 total parking spaces are
proposed for both developments, 89 for the
apartments and 50 for the office building.
The proposed street configuration is characterized
by a cul-de-sac, a 25 foot pavement with 50 foot
right-of-way and a 50 foot radius. This proposed
street, Prestige Circle, stands 370 feet eastward
into the property from Reservoir Road.
No development is presently proposed for the
southern portion of the property.
In addition to the cul-de-sac an access easement to
parking spaces on Lots 1 and 2 is proposed for
Prestige Circle.
The minimum 10 foot requirement between two
structures apparently will be violated, once on lot
proposal if developed according to plat design.
Reservoir Road requires a minimum 80 foot
1 10W right-of-way.which should be verified and tied to
Town Park Addition.

Lot 2 as shown in the -development plan will be
enforceable for building permit purposes. Setbacks
should be platted where they vary from minimums.
Drives should be platted as service easement.
C. Analysis
This plat lies directly east of Town Park. It should
also contribute cash to a public project to build
Reservoir Road at a new grade.
The cul-de-sac is longer than necessary to serve Lot 2
and 3, and could be shortened.
On Lot 2 some side setbacks are less than minimum
and should be platted.
D. Staff Recommendation
i Approval subject to the following:
1. Raintree Lane and unimproved right-of-way on
the east be closed.
2. Improvements to Reservoir Road replaced by
cash contributions.
3. Access easement and exits to be clarified
and platted.
4. Cul-de-sac should be shortened.
5. Lot 2 be down zoned to "MF-18".
6. Plat side setbacks on Lot 2.
7. Maintain minimum 10 foot separation
between buildings.
E. Subdivision Committee Recommendation
The Committee conveys this item to the Planning
Commission without any recommendation.

PLANNING COMMISSION ACTION:
The applicant was present and stated that he agreed with the
staff's recommendation except Item No. 2 and Item No. 5.
The applicant stated that he did not have the authority to
down zone the lot, but is willing to do so as soon as he takes
title. He agreed to notify the Planning staff when it can be
accomplished if the staff will handle the filing. In regard to
waiver of improvements, he felt it was inconsistent and perhaps
arbitrary to require him to participate in construction when all
previous developments have required waivers. After discussing
the issues, the Commission voted to approve the plat as
recommended by the staff with the deletion of Item No. 2 and No.
5 to be deferred until title changes. The vote was: 7 ayes, 0
noes, 4 absent.
Note: Bob Nash made a motion directing the staff to prepare
a resolution with the Board of Directors outlining streets
with waivers and those where no past action has occurred.
The purpose of the resolution would be to provide a
basis for dealing with boundary street improvements and
acquiring escrow contributions. This motion passed by
a vote of 7 ayes, 0 noes, 4 absent.
