3 AN ORDINANCE TO WAIVE COMPETITIVE BIDS AND
4 AUTHORIZE THE CITY MANAGER TO RENEW THE SERVICE
5 AGREEMENT WITH MOTOROLA, INC., IN THE AMOUNT OF
6 $554,907.00, AS A SOLE SOURCE PROVIDER OF MAINTENANCE FOR
7 CITY'S RADIO INFRASTRUCTURE; AND FOR OTHER PURPOSES.
9 WHEREAS, Motorola, Inc. has provided the maintenance for the City's 800 MHZ
10 system infrastructure for over 13 years under a contract that includes maintenance on
11 system infrastructure, portable and mobile radios; and
12 WHEREAS, the Motorola radio system has proprietary design features that are
13 very important when it comes to considering maintenance; and
14 WHEREAS, Grace Communications Company of North Little Rock is the only
15 communications company in the central Arkansas area which has the trained personnel,
16 proprietary software and test equipment available to properly maintain the City's radio
17 network infrastructure and is the service provider for Motorola, Inc.
18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
19 OF THE CITY OF LITTLE ROCK, ARKANSAS:
20 Section 1. The City Manager is authorized to enter into a service agreement
21 with Motorola in the amount of $554,907.00 to provide maintenance on the City's 800
22 MHZ radio system.
23 Section 2. The City Manager is authorized to waive competitive bidding and
24 declare Motorola as a sole source provider of maintenance for the City's 800 MHZ radio
25 system in order to ensure proper maintenance of the City's system.

I Section 3. Funds are available in the 911 Fund.
2 Section 4. Severability. In the event any title, section, subsection, subdivision,
3 paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance is
4 declared or adjudged to be invalid or unconstitutional, such declaration or adjudication
5 shall not affect the remaining portions of the ordinance which shall remain in full force
6 and effect as if the portion so declared or adjudged invalid or unconstitutional was not
7 originally a part of the ordinance.
8 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same,
9 that are inconsistent with the provisions of this ordinance are hereby repealed to the
10 extent of such inconsistency.
1 l Section 6. Emergency Clause. The City's ability to communicate by radio is
12 deemed essential to the preservation of the public health, safety and welfare; an
13 emergency is, therefore, declared to exist and this ordinance shall be in full force and
14 effect from and after the date of its passage.
