Alltel/Verizon campus in the Riverdale Addition. The following items are provided:

DEVELOPMENT

INCORPORATED
The majority of this property has been previously platted as several tracts in the Riverdale Addition. Our
proposal is to recombine these tracts into two new tracts as shown in the preliminary plat drawing. The
purpose of this replat is to create new lots/tracts so that the buildings are entirely within a lot of record
and lot lines no longer run through the buildings.
In conjunction with this application, we are requesting a variance to allow a zero side yard setback
between the proposed Tracts E-2-112 & D-2A-R, adjacent to the area of the buildings connected via the
canopy/covered walkways. We are also requesting a variance to allow on -site parking less than that
typically required, subject to a cross access and parking agreement being completed or additional
parking being constructed.

COVENANTS

County, Arkansas, as Instrument Number The Grantors do
hereby make this Bill of Assurance to govern and control the land described in the Plat. This is a
replat of the Property and is intended to amend and restate all prior plats of the Property so that
this Plat is the only plat of the Property.
HEREAFTER, conveyances and descriptions of the property as shown on the Plat shall
be a proper and sufficient description thereof.
Tract D-2A-R and Tract E-2-R2, Riverdale Addition, City of Little Rock, Pulaski
County, Arkansas, shall be conveyed by the Grantors and shall be acquired by the Grantees
thereof, subject to the covenants contained herein and the Plat.
RIGHTS OF WAY: With the filing of this Bill of Assurance and Plat in the office of
the Circuit Clerk of Pulaski County, Arkansas, the rights -of -way
shown on said Plat (if any) are hereby dedicated to the City of
Little Rock. The utility easements shown thereon on dedicated to
the appropriate public utilities.
TERM/AMENDMENT: This Bill of Assurance shall be in full force and effect in perpetuity

or terminated at any time from the date hereof by the unanimous

RESTRICTIONS: Grantors and all future grantees of the property described in this
Bill of Assurance and the Plat specifically agree all ordinances of
the City of Little Rock, subject to all permitted variances, shall be
strictly adhered to and followed and, should the Plat or this Bill of
Assurance be contrary, in any way, to the ordinances adopted by
the City of Little Rock, from time to time, such ordinances shall
have precedence.

Site plan must comply with the cities minimal landscape and buffer ordinance
requirements.
The zoning ordinance requires an average seventeen -foot (17') wide street buffer
along Markham Street, in front of the proposed restaurant. In no case can this
amount be less than nine foot (9') in width.
The zoning ordinance requires an average twenty-seven foot (27') wide street
buffer along the remainder of Markham Street, in front of the existing retail space.
In no case can this amount be less than thirteen foot (13') in width.
The landscape ordinance requires a minimum nine -foot (9') wide perimeter
landscape strip around the sites entirety. There are currently parking spaces,
driveways, backup areas, and perhaps dumpster pad areas within this area; revise.
These must be removed. A variance from this minimal city ordinance will
require a variance from the City Beautiful Commission prior to the issuance of a
building permit.
A small amount of building landscaping will be required.
The landscape ordinance requires a minimum of 8 % of the paved areas be
landscaped with interior islands of at least 7 1/2 feet in width and 300 square feet in
area. Proposed plan does not currently reflect this minimum. Interior islands are
to be evenly distributed throughout the property.
An automatic irrigation system is required.
Prior to the issuance of a building permit, it will be necessary to provide
landscape plans stamped with the seal of a Registered Landscape Architect.
The City Beautiful Commission recommends preserving as many existing trees as
feasible on this site. Credit toward fulfilling Landscape Ordinance requirements
can be given when preserving trees of six (6) inch caliper or larger.

The zoning ordinance requires a six foot nine inch (6'-9") wide street buffer along
Markham Street. The current proposal reflects parking within this area; revise.
The landscape ordinance requires a minimum nine -foot wide (9') landscape
perimeter around the sites entirety. A variance from this minimal amount will
require approval from the City Beautiful Commission prior to the issuance of a
building permit. This site is located within the designated mature area of the city;
therefore, this amount can be reduced down to six foot nine inches if needed.
A small amount of building landscaping will be required.
A six foot high opaque screen, either a wooden fence with its face side directed
outward, a wall or dense evergreen planting, is also required along the northern
property line next to the residentially zoned property. The dense evergreen
plantings may suffice for screening, in that, it must screen year around.

1. Provide notification of abutting property owners complete with the certified abstract list, notice form
with affidavit executed and proof of mailing. The notice must be mailed no later than December 21,
2011. The Office of Planning and Development must receive the proof of notice no later than
December 30, 2011.
Response: This item is complete and our notification evidence has been sent to your office.
2. The property is zoned 0-2, Office and Institutional District. There is a setback variance proposed.
Within the area of the canopy a zero setback exists.
Response: Zero setback requested at area of the existing skywalks that connect buildings.

within a residual 60 foot wide utility and drainage easement.

Central Arkansas Water: Central Arkansas Water retains all water line easements as shown on the
replat. All Central Arkansas Water requirements in effect at the time of request for water service must
be met. Contact Central Arkansas Water regarding the size and location of the water meter. If there are
facilities that need to be adjusted and/or relocated, contact Central Arkansas Water. That work would
be done at the expense of the developer. Due to the nature of the facility, installation of an approved
reduced pressure zone backflow preventer assembly (RPZ) is required on the domestic water service.
This assembly must be installed prior to the first point of use. Central Arkansas Water requires that upon
installation of the RPZ assembly, successful tests of the assembly must be completed by a Certified
Assembly Tester licensed in the State of Arkansas and approved by Central Arkansas Water. The test
results must be sent to Central Arkansas Water's Cross Connection Section within ten days of installation
and annually thereafter. Contact the Cross Connection Section at 377-1226 if you would like to discuss
backflow prevention requirements for this project. The facilities on -site will be private.

been filed with the Department of Planning and Development. A public hearing to review a preliminary
plat for this property will be held by the Little Rock Planning Commission on January 5, 2012, at 4:00

THIS APPLICATION PROPOSES the replatting of three existing lots into three new lots to facilitate a
