NOTICE IS HEREBY GIVEN THAT an application for the subdivision of the property cited above has
been filed with the Department of Planning and Development. A public hearing to review a preliminary
plat for this property will be held by the Little Rock Planning Commission on January 5, 2012, at 4:00
P.M. in the Board of Directors Chamber, second floor, Little Rock City Hall, located at 500 W.
Markham Street.
THIS APPLICATION PROPOSES the replatting of three existing lots into three new lots to facilitate a
sale of part of the property. A building setback variance is requested between two of the existing
buildings at one of the proposed interior lot lines, due to the existing building separation. The variance is
not related to any new construction or reduction in other setbacks.
ALL PARTIES IN INTEREST MAY APPEAR and be heard at the above cited time and place, or any
party in interest may notify the Planning Commission of their views on this matter by letter. All persons
interested in this request are invited to call or visit the Department of Planning and Development,
located at 723 W. Markham St., phone, 371-4790, to review and discuss the application information
with the Planning staff. Correspondence to the Planning Commission may be addressed to the

Addition. The following items are provided:
1. Eighteen copies of the proposed preliminary plat drawing.

The majority of this property is not platted and has been shown as Tract H on prior surveys. There is
also one platted parcel which is Tract H-3A. Our proposal is to create three new tracts as shown in the
preliminary plat drawing.
In conjunction with this application, we have filed an application to abandon the existing Brookwood
Drive right-of-way, south of Cedar Hill Road. We have also filed applications to abandon two existing
utility and drainage easements that were recorded with Tract H-3A.
The purpose of this application is to subdivide the property for future development of parking facilities
that will support the main campus properties as well as other potential uses.

COVENANTS

Assurance to govern and control the land described in the Plat. This is a replat of the Property
and is intended to amend and restate all prior plats of the Property so that this Plat is the only plat
of the Property.
HEREAFTER, conveyances and descriptions of the property as shown on the Plat shall
be a proper and sufficient description thereof.

thereof, subject to the covenants contained herein and the Plat.
RIGHTS OF WAY: With the filing of this Bill of Assurance and Plat in the office of
the Circuit Clerk of Pulaski County, Arkansas, the rights -of -way
shown on said Plat (if any) are hereby dedicated to the City of
Little Rock. The utility easements shown thereon on dedicated to
the appropriate public utilities.
TERM/AMENDMENT: This Bill of Assurance shall be in full force and effect in perpetuity
subject to the following amendment and termination rights of the
owners of the Property. This Bill of Assurance may be amended
or terminated at any time from the date hereof by the unanimous
written agreement of the owners of Tract H-1, Tract H-2 and Tract
H-3. The parties are mindful of the decision in Rausch Coleman
Homes, LLC v. Brech, 2009 Ark. App. 225 (the "Decision") and do
not wish for the Decision to limit the ability of the parties to amend
this Bill of Assurance at any time and from time -to -time. The
parties intend that this Bill of Assurance may be amended at any
time from the date hereof throughout the term of this Bill of
Assurance and expressly intend and agree that this Bill of
Assurance may be amended prior to any expiration or termination
date set forth herein.
RESTRICTIONS: Grantors and all future grantees of the property described in this
Bill of Assurance and the Plat specifically agree all ordinances of
the City of Little Rock, subject to all permitted variances, shall be
strictly adhered to and followed and, should the Plat or this Bill of
Assurance be contrary, in any way, to the ordinances adopted by
the City of Little Rock, from time to time, such ordinances shall
have precedence.
All newly constructed buildings on said lots shall be constructed
no nearer the street than the building line shown on the Plat, and all
newly constructed buildings shall be constructed in conformance
with the Building Code and Zoning Ordinance of the City of Little
Rock, Arkansas.

Site plan must comply with the cities minimal landscape and buffer ordinance
requirements.
The zoning ordinance requires an average seventeen -foot (17') wide street buffer
along Markham Street, in front of the proposed restaurant. In no case can this
amount be less than nine foot (9') in width.
The zoning ordinance requires an average twenty-seven foot (27') wide street
buffer along the remainder of Markham Street, in front of the existing retail space.
In no case can this amount be less than thirteen foot (13') in width.
The landscape ordinance requires a minimum nine -foot (9') wide perimeter
landscape strip around the sites entirety. There are currently parking spaces,
driveways, backup areas, and perhaps dumpster pad areas within this area; revise.
These must be removed. A variance from this minimal city ordinance will
require a variance from the City Beautiful Commission prior to the issuance of a
building permit.
A small amount of building landscaping will be required.
The landscape ordinance requires a minimum of 8 % of the paved areas be
landscaped with interior islands of at least 7 % feet in width and 300 square feet in
area. Proposed plan does not currently reflect this minimum. Interior islands are
to be evenly distributed throughout the property.

Arkansas Water's material and construction
specifications and installation will be
inspected by an engineer, licensed to
