AMENDMENT TO BILL OF ASSURANCE
KNOW ALL MEN BY THESE PRESENTS:
THAT, WHEREAS, Swan Harbor, LLC, an Arkansas limited liability company ("Swan
Harbor"), is the sole owner of the following described lands lying in the County of Pulaski, State of
Arkansas, to wit:
Tract RH-5, Riverdale Addition, Little Rock, Pulaski County, Arkansas, as recorded
in Plat Book F, page 997, in the records of Pulaski County, Arkansas (the
"Property").
WHEREAS, Marion Burton, Agent, made and recorded a certain Plat and Bill of Assurance,
recorded in the Pulaski County real property records as Instrument No. 2001007525 on January 30,
2001, with regards to the Property ("Original Bill of Assurance"), -
WHEREAS, Marion Burton, Agent, made and recorded a certain Corrected Plat and Bill of
Assurance, recorded in the Pulaski County real property records as Instrument No. 2003062101 on
June 20, 2003, covering the Property in order to correct the legal description on the Original Bill of
Assurance to match the legal description on the plat recorded in Plat Book F, page 997; and
WHEREAS, it is desirable that the Property be replatted.
NOW THEREFORE WITNESSETH:
THAT Swan Harbor, hereinafter termed grantor, has caused said tract of land to be surveyed

by Gregory T. Sullivan a Registered Professional Land Surveyor, and a plat thereof made which is
identified by the title Final Plat of Lot RH-5A and Lot RH-5B Riverdale Addition Little Rock
Arkansas and the date February 18, 2009, and by the signature of the Circuit Clerk and ex-officio
Recorder of Pulaski County, Arkansas, as Document No. 90 the grantor does hereby
make this Amendment to the Bill of Assurance.
The purpose of this amendment is to: divide the parent tract into two separate lots.
The land embraced in said plat shall be forever known as "Lot RH-5A and Lot RH-5B,
Riverdale Addition, Little Rock, Arkansas," and any and every deed of conveyance describing the
respective lots by the letter and number shown on said Plat shall always be deemed a sufficient
description thereof.
There are strips of ground shown and dimensioned on said plat marked "Utility & Drainage
Easement," reserved for the use of public utilities, subject at all times to the proper authorities and to
the easement herein reserved. The Owner of this replat shall take their title subject to the right of
public utilities and the public.
The filing of this Amendment to the Bill of Assurance and plat for record in The Office of the
Circuit Clerk and ex-officio Recorder of Pulaski County shall be a valid and complete delivery and
dedication of any easements and rights -of -way shown on the said plat not previously dedicated and
recorded.
Hereafter, conveyance and description of said lands by lot number as shown on said plat shall
be a proper and sufficient description thereof.
The lot in said subdivision shall be sold by the grantors and shall be purchased by the buyers
thereof, subject to the covenants, restrictions, and easements set forth in the parent document filed in

Plat Book F, Page 997 and as Document No. 2001007525, provided none of covenants, restrictions,
and easements set forth in the parent document or subsequent corrections or amendments have been
terminated, released, or abandoned.
The considerations set forth in the parent document are hereby approved by the City of Little
Rock Planning Commission. Any additional requirements, restrictions or statements are entered
without review or action by the Planning Commission, and shall not be considered part of the Little
Rock Planning Commission, and shall not be considered part of the Little Rock Planning
Commission's requirements for plat approval.
