And, WHEREAS, it is deemed desirable that the above property be now subdivided as shown on the attached plat and that said property be held, owned and conveyed, as platted; NOW, THEREFORE, Marion Burton, Agent, for and in consideration of the benefits to accrue to him, which benefits he acknowledges to be of value, has caused to be made the Plat hereto a ched showin the survey ade the obi (g day of ,�QA , 2001, signed by �, , Professional Lan urveyor, bearing a Certificate of Approval executed by the Little Rock Planning Commission and showing the bounds and dimensions of the property now being platted. There are also shown on said plat certain easements which Marion Burton, Agent, hereby donates and dedicates to and for the use of public utilities, the same being, without limiting the generality of the foregoing, electric power, gas, telephone, water and sewer, with the right hereby granted to the persons, firms or corporations engaged in supplying such utility services, to use and occupy such easements and to have free ingress and egress therefrom for the installation, maintenance, repair and replacement of such utility services. The filing of this Plat and Bill of Assurance for record in the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, will be a valid ilo i9jiglete dedication of the aforesaid easements. • �+ r } •"4'"Ti W .r ��•. Grantor further retains an easement of access and ingress and egress over and across the Property for the purpose of providing access to the Riverdale Harbour Marina for the purpose of maintaining, repairing, and improving said marina at times deemed necessary or appropriate by the Grantor. Parking, streets or other improvements may be constructed within the area covered by said easement so long as such improvements will not restrict the access of the Grantor for the purposes aforesaid. The land embraced in said plat is also included within the boundaries of the Riverdale Harbour Municipal Property Owners Improvement District No. 1 of Little Rock, Arkansas, and is subject to the assessments of said District. The land embraced in said plat is also included within the Riverdale Levee Improvement District #134, created by the City of Little Rock, Arkansas by Ordinance No. 12, 932 of May 21, 1974, and is subject to the provisions thereof. The land embraced in said plat is further adjacent to the Riverdale Marina which may hereafter be subject to a Bill of Assurance with covenants and restrictions concerning the use thereof as a marina. The land embraced in said plat shall be forever known as "Tract RH-5, Riverdale Addition to the City of Little Rock, Arkansas," and any and every deed of conveyance describing the property by the letter and number shown on said Plat has always be deemed a sufficient description thereof. Iron pins have been set on the lines of the property being platted In the event of minor discrepancies between the dimensions or distances as shown on the attached plat and the actual dimensions or distances as disclosed by the established pins, the pins as set shall control. Said property herein platted and any interest therein, shall be held, owned, and conveyed subject to and in conformity with the covenants and restrictions contained in that certain "Declaration of Covenants and Restrictions," filed for record by Pleasant Valley, Inc., on the 16th day of August, 1974, in the office of the Circuit Clerk and Ex-officio Recorder of Pulaski County, Arkansas, and appearing of record in Book 1306, at page 389, in said office, as amended by an Amendment to Declaration of Covenants and Restrictions appearing of record in Book 1381, at Page 109, in said office, and as further amended by a Second Amendment to Declaration of Covenants and Restrictions appearing of record as Instrument No. 77-00808 in said office.
