HomeMy WebLinkAboutS-0050-F Application4*_ ORDINANCE NO. 14,354 AN ORDINANCE ESTABLISHING PLEASANT RIDGE STREET, WATER, DRAINAGE & SEWER IMPROVEMENT DISTRICT NO. 636 OF LITTLE ROCK, ARKANSAS WHEREAS, parties claiming to be the owners of a majority in assessed value of the real property located within the territory hereinafter described have filed a petition praying that an improvement district be established for the purposes hereinafter set out; and WHEREAS, after due notice as required by law, the City Board of Directors of Little Rock, Frkansas, has heard all parties desiring to be heard and has ascertained that said petition was signed by a majority in assessed value of the owners of real property within said territory; now, therefore, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. There is hereby established an improvement district embracing the following property in the City of Little Rock, Arkansas, to -wit: In Section 21, T-2-N R-13-W: That part of the NW 1/4 lying South of Arkansas State Highway No. 10 less and except Lot 6, Pleasant Ridae Subdivision, Little Rock, Arkansas That part of the SW 1/4 NE 1/4 lying South of Arkansas State Highway No. 10 .and West of Lot C, Walton Heights The NW 1/4 SW 1/4, the NE 1/4 SE 1/4 SW 1/4, the E 1/2 SE 1/4 SE 1/4 SW 1/4 That part of the SW 1/4 SE 1/4 lying West of Rodney Parham Road except that "- portion owned by the Catholic Diocese of Little Rock, Andrew J. McDonald, Bishop Woodland Heights Subdivision The South 305 ft. of Plot 'J', the South 410 ft. of Plot 'I', Plot 'H' for the purpose of: (a) constructing curbs and gutters, drainage and paving for and otherwise constructing new streets or improving existing streets or roads within the District boundaries and to make connections outside the District boundaries where required; and, (b) enlarging, improving, extending, repairing and maintaining any existing water system within said District theretofore acquired or constructed in the City of Little Rock; and, (c) constructing, reconstructing, expanding, im- proving or otherwise providing appropriate drainage facili- ties within said District; and (d) constructing, improving, expanding, maintaining, or otherwise a sanitary sewer system to serve the property within said district and to be consolidated with any pre- existing sanitary sewer system and to make connections outside District boundaries where required, and for the purpose of acquiring by gift, purchase, or the exercise of its right of eminent domain by condemnation the necessary lands for rights -of -way and easements to accomplish the improvements as herein described; all in such manner and -2- with such materials as the commissioners to be elected for said improvement district shall deem to be for the best interest of said district, and that the cost thereof be assessed and charged upon the real property above described. SECTION 2. Said District shall be known as "Pleasant Ridge Street, Water, Drainage & Sewer Improvement District No. 636 of Little Rock, Arkansas," and Louis E. Schickel, Donna Galchus, and R. F. Toll are hereby named Commissioners, who shall compose the Board of Improvement for said District. SECTION 3. This ordinance shall take effect and be in force from and after its passage. MARTIN, CITY MANAGER FROM: NATHANIEL M. GRIFFIN, DIRECT OFFICE OF COMPREHENSIVE PLAN SUBJECT: PLEASANT RIDGE STREET IMPROVEMENT DISTRICT As a follow-up to the Board discussion last Tuesday night on the subject of a proposed Pleasant Ridge Street Improvement District, I would like to provide you with the viewpoint of the Office of Comprehensive Planning. There are a number of different issues involved and it would be appropriate to deal with each of them separately. 1. PRIVATE IMPROVEMENT DISTRICTS AS A MEANS OF CONSTRUCTING PUBLIC IMPROVEMENTS In the past the City of Little Rock has been supportive of private efforts to create improvement districts for the purpose of con- structing public streets and other improvements. This is one of the best ways we have of obtaining community infrastructure. Obviously, when private interests are prepared to build public improvements they assume a cost which might otherwise be born by the public. Pleasant Ridge Drive has been incorporated in the City's Master Street Plan with an alignment which corresponds to that now proposed for construction by the Schickel group. The improvements are needed to serve existing developed and zoned land. A significant amount of street construction, including part of Rodney Parham Road is involved. These circumstances suggest that there are numerous public benefits to be gained by allowing the district to proceed with its construction program. 2. EXPANDED COMMERCIAL DEVELOPMENT AT THE INTERSECTION OF HIGHWAY 10 AND PLEASANT RIDGE ROAD Mr. Schickel is certainly within his rights to seek to expand commercial zoning beyond its present extent in this area. We have not as yet, however, been formally notified of his intent to do so. The decision of whether or not to approve additional commercial zoning will ultimately rest with the Board of Directors. The Board, Team Four, and O.C.P. spent a great deal of time and effort to develop a land use and zoning plan for this area. Additional com- mercial expansion beyond what was agreed to would be incompatible with both that effort and the Suburban Development Plan. Rezoning would require an amendment to the Suburban Development Plan. Comprehensive Planning opposes any additional commercial zoning in the area. The City has made a very clear decision about the land use mix along Highway 10 and any significant changes would simply open the floodgates to other rezoning requests of all kinds. Zoning, therefore, should be recognized as a separate issue, and one to be dealt with on its merits or lack thereof: 3. A CUL-DE-SAC APPROACH TO WOODLAND HEIGHTS AND FAIRVIEW ROADS Board Resolution 6556 of April, 1981 endorsed "the concept of dead -ending Woodland Heights Road in some form of cul-de-sac" as determined by the Public Works Department. The mechanics of how this was to be accomplished were not spelled out. It would be entirely appropriate for the Board of Directors to condition formation of the district upon satisfactory resolu- tion of this question. The southern 300 ft. of Fairview Road lie within the boundaries of the proposed improvement district. The district could, therefore, vacate and abandon that right-of-way, thereby terminating Fairview Road in a manner satisfactory to the residents of Summit Road. The Woodland Heights Road alignment to the north of Christ the King Catholic Church poses a larger problem since it lies outside the boundaries of the district. Nevertheless, the City could, on its own initiative, vacate and baracade that portion of Woodland Heights Road, thereby severing it as a through street. Support of the Catholic Church,however, would have to be obtained. If these actions were accomplished, Summit Road would function as a loop street without any direct access to Pleasant Ridge. (See enclosure). It seems appropriate to resolve the cul-de-sac question as part of the broader issue of improvement district formation. Public Works agrees with this approach and is prepared to work out the technical details. suggest that the City proceed to accomplish that as outlined above. On balance, I think the interests of both the property owners seeking to create the improvement district and those seeking to protect the residential character of their neighborhood can be met. The proposed district is located south of Arkansas Highway No. 10 and encompasses part of the Pleasant Ridge Subdivision and part of the Woodland Heights Subdivision. A legal description of the proposed district is attached. Mr. Louis Schickel has been active in the planning for the proposed district. A petition for formation of the district has been circulated among property owners and has been signed by persons owning a majority of the assessed value of the property in the proposed district. The improvements proposed to be made include the following: (1) constructing new streets and improving existing streets including curbs, gutters, drain- age and paving (2) improving, extending and repairing the existing water system (3) constructing, as needed, appropriate drainage facilities (4) constructing, improving and expanding a sanitary sewer system to be consolidated with the existing system.
