D. Staff Analysis:
The property at 3920 Woodland Heights Road is zoned O-2 Office and Institutional District, with POD, O-3, R-2 zoning adjacent to the property.
The applicant is proposing to construct a new, approximately 2,600 square foot building addition on the west side of their property. The proposed structure is an addition and will be
located north of an existing structure. The existing structure has a side yard setback of 6.1 feet. The applicant’s proposal will bring the proposed addition more in-line with the existing
structure on the site.
Section 36-280(e)(1) states, “The front, side, and rear yard setbacks shall not be less than twenty-five (25) feet.” “Therefore, the applicant is requesting a variance to
allow a reduced side yard setback in the O-2 zoning district from twenty-five (25) feet to fourteen (14) feet. A setback reduction of eleven (11) feet.”
In Staff' s opinion, the proposed setback reduction will pose no negative effect upon the health, safety, or welfare of the public, and will not detract from the value or aesthetics
of the surrounding properties in the general area.
E. Staff Recommendation:
Staff recommends approval of the requested side yard setback reduction from twenty-five (25) feet to a minimum to fourteen (14) feet, as per the submitted survey / site plan sketch,
subject to the following condition:
1. Obtain a building permit prior to construction.
