HomeMy WebLinkAboutZ-9843 - SummaryZ-9843 2407 North Pierce Street Summary of events: Construction Documents submitted for construction permit with garage separated from primary residence with covered breezeway connection. April 13, 2023: Complaint was received by the code enforcement department regarding the separation of the garage from the primary residence. Code enforcement officer visited site and found enlarged roof structure connecting the garage structure to primary residence. The separation distance of the garage from the primary residence was found to have been reduced from the required six (6) feet to approximately 5’-2” to 5’-4”. A three (3) foot high wall structure was also within the breezeway. “Stop Work” Order was issued and left at the site. Staff determined the roof connection to the garage along with the reduced separation distance would no longer allow it to be considered an accessory structure. The garage was determined to be an extension of the primary residence and therefore did not meet the required rear yard setback. The contractor agreed to submit an application to the Board of Adjustment for a reduced rear yard setback as a remedy to meet the ordinance requirements. Staff recommended approval of the variance request and noted several other properties in the general vicinity that had similar conditions with approved variance requests,
