B. DOUGLAS BRANDON, JR. and ELIZABETH R. BRANDON TO THE PUBLIC WHEREAS, B. DOUGLAS BRANDON, JR., and ELIZABETH R. BRANDON ("Grantor") are the owners of the following described land lying in the County of Pulaski, State of Arkansas, to wit: Part of Tract 32, Little Rock Industrial District, City of Little Rock, Pulaski County, Arkansas, being more particularly described as follows: A tract of land located _in the,NW'/a., SEI/,,Section 29, T-1-N, R- 12-W, Pulaski County, Arkansas, more particularly described as: Starting at the center of said Section 29; thence S°28'W along the North -South centerline of said Section 29, a distance of 30 ft. to a point on the South right-of-way line of West 65th Street; thence S89°18'-E along said South right-of-way line, 883.0 ft. to a point; thence SO°28'W, 782.2 ft. to the point of beginning; thence S89018'E, 400.0 ft. to a point on the West right-of-way line of Murray Street; thence SO°28'W along said West right-of-way line, 217.8 ft. to a point; thence N89 ° 18' W, 400.0 ft. to a point; thence NO°28'E, 217.8 ft. to the point of beginning containing 87,120 sq. ft. or 2.0000 Acres more or less. (hereinafter called "the Subdivision") NOW, THEREFORE, WITNESSETH: Grantor has caused the Subdivision to be surveyed by White-Daters and Associates, Inc., and a plat thereof made which is identified by the title Lot 1, Brandon House Addition to the City of Little Rock and by the signature of the said engineer and Grantor, bearing a Certificate of Final Approval executed by the Little Rock Planning Commission, and of record in the office of Circuit Clerk and ex-officio Recorder of Pulaski County, Arkansas, Plat Book Page (the "Plat"), and Grantor does hereby make this Bill of Assurance. -1- AND, Grantor hereby certifies that it has laid off, platted, and subdivided, and does hereby lay off, plat and subdivide the Subdivision in accordance with the Plat. The lands embraced in .the Plat shall be forever known as Lot 1, Brandon House Addition, being a Replat of a part of Tract 32, Little Rock Industrial District. Permanent easements for drainage, for laying and maintaining sewer pipes and mains, storm sewers, and for the installation and maintenance of utilities are created, excepted and reserved over, across and through the Subdivision as shown on the Plat; provided, however, that any governmental agency or private utility so installing or maintaining utilities shall restore, insofar as reasonably possible, the surface of the land in the same condition as existed prior to such installation or maintenance, including with limitation replanting and landscaping. The filing and recording of this Bill of Assurance and Plat for record shall be a valid and complete delivery and dedication of the easements shown on the Plat. Lot 1 and any interest therein shall be held, owned and conveyed subject to and in conformity with certain declarations, restrictions, and covenants set forth herein which shall be construed to be covenants running with the land and shall be binding upon all owners of Lot 1, as follows: A. Maintenance. Owners and occupants (including lessees) of any part of Lot 1 shall, jointly and severally, have the duty and responsibility, at their sole cost and expense, to maintain the part of Lot 1 so owned or occupied, including buildings, improvements and grounds in connection therewith, in a well -maintained, safe, clean and attractive condition at all times. B. Building Line. No building shall be erected, placed, located or permitted to remain on Lot 1 closer to the east boundary of Lot 1 than the building line as shown on the Plat. C. General Provisions. Each and all of the covenants and provisions set forth herein shall be binding as covenants on all owners, shall run with the land and may be enforced by any party that would be adversely affected by the breach thereof, but no party shall be liable for breaches committed except during its ownership. Any and all of the covenants set forth herein may be amended, modified, extended, changed or canceled in whole or in part from time to time by written instrument signed and acknowledged by the owner or owners of over 75 % in area of Brandon House Addition, City of Little Rock, Pulaski. County, Arkansas. -2- Invalidation of any restriction set forth herein or any part thereof by an order, judgment, or decree of any court or Board of Arbitration or otherwise shall not invalidate or affect any of the other restrictions or any part thereof as set forth herein but they shall remain in full force and effect. Those items above as required by the subdivision ordinance are hereby approved by the City of Little Rock Planning Commission. Any additional requirements, restrictions or statements are entered without review or action by the Planning Commission, and shall not be considered part of the Little Rock Planning Commission requirements for plat approval.
