3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO AN INTERGOVERNMENTAL POLICE SERVICES AGREEMENT
5 WITH THE UNITED STATES DEPARTMENT OF VETERANS AFFAIRS,
6 CENTRAL ARKANSAS VETERANS HEALTH CARE SYSTEM;AND FOR
7 OTHER PURPOSES.

9 WHEREAS,the City of Little Rock,Arkansas("Little Rock"), and the U.S.Department of Veterans
10 Affairs ("VA") Central Arkansas Veterans Healthcare System ("CAVHS") recognize that effective law
11 enforcement is not a solitary effort,but requires the cooperation and interaction of multiple agencies;
12 WHEREAS, effective law enforcement depends upon the immediate action to protect lives and
13 property and to preserve the peace without regard to jurisdictional limitations; and,
14 WHEREAS,to establish general working relationships between the CAVHS Police Service and Little
15 Rock Police Department as a means of reinforcing interagency coordination and responsibility concerning
16 law enforcement, emergency response, requests for assistance, and physical security and access control
17 operations at John L.McClellan VA Medical Center located at 4300 West 7th Street,Little Rock,Arkansas,
18 and Veterans Day Treatment Center located at 1000 South Main Street,Little Rock,Arkansas; and
19 WHEREAS, authority is granted for the provision of joint cooperative action among political
20 subdivisions pursuant to the Interlocal Cooperation Act, codified at Ark. Code Ann. § 25-20- 108, and as
21 otherwise provided by law;
22 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
23 OF LITTLE ROCK,ARKANSAS:
24 Section 1. The City Manager is authorized to execute the Mutual Aid Agreement for Law
25 Enforcement Services, attached hereto for reference as Exhibit A, which provides for the interchange of
26 Law Enforcement Services between the City of Little Rock and the U.S. Department of Veterans Affairs
27 Central Arkansas Veterans Healthcare System.
28 Section 2. Severabiliry. In the event any portion of this Resolution is declared or adjudged to be
29 invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this
30 Resolution,which shall remain in full force and effect as if the portion so declared or adjudged invalid or
31 unconstitutional was not originally a part of this Resolution.
32 Section 3. Repealer.All ordinances and resolutions,and parts thereof,which are in conflict with any
33 provision of this ordinance are hereby repealed to the extent of such conflict.

2 MEMORANDUM OF UNDERSTANDING BETWEEN
3 UNITED STATES DEPARTMENT OF VETERANS AFFAIRS,CENTRAL ARKANSAS
4 VETERANS HEALTHCARE SYSTEM AND
5 CITY OF LITTLE ROCK
6 This Memorandum of Understanding (MOU) is entered into between the U.S. Department of Veterans
7 Affairs (VA) Central Arkansas Veterans Healthcare System (CAVHS) and the City of Little Rock,
8 hereinafter referred to as "parties."
9 1. PURPOSE.
10 a. To establish general working relationships between the CAVHS Police Service and Little Rock
11 Police Department as a means of reinforcing interagency coordination and responsibility
12 concerning law enforcement, emergency response, requests for assistance, and physical security
13 and access control operations at John L.McClellan VA Medical Center located at 4300 West 7th
14 Street, Little Rock, Arkansas, and Veterans Day Treatment Center located at 1000 South Main
15 Street,Little Rock,Arkansas.

22 3.GENERAL.
23 a. CAVHS, also known as, John L. McClellan VA Medical Center and Veterans Day Treatment
24 Center is in the City of Little Rock. The Little Rock CAVHS provides primary, specialty, and
25 extended care to Veterans throughout Little Rock. The mission of the John L. McClellan VA
26 Medical Center and Veterans Day Treatment Center is to provide timely, efficient, ethical, safe,
27 compassionate,and quality health care to Veteran patients.

29 b. The Little Rock Police Department has concurrent jurisdiction with the Federal Government over
30 CAVHS properties. This jurisdiction grants local police agencies the authority to jointly enforce
31 Federal and state laws with VA Police on CAVHS properties.

33 4.RESPONSIBILITIES.
34 a. Central Arkansas Veterans Healthcare Systems(CAVHS)Police Service will:

1 (1) Maintain law and order and enforce Federal and state laws and VA regulations at the, including
2 the facility building and designated parking lots,for the protection of property owned or occupied
3 by the VA and persons on the property.

5 (2) Provide a primary initial response to any and all incidents or emergency situations at the John L.
6 McClellan VA Medical Center and Veterans Day Treatment Center.

8 b.Little Rock Police Department will:
9
10 (1) Respond to CAVHS Police Service's requests for assistance. Such assistance may include,but is
11 not limited to,the following situations:
12
13 (a) Armed hostage-taking situations that would require an armed response to assist VA
14 Police in containing the situation until appropriate Federal agencies(such as the Federal
15 Bureau of Investigation-FBI)can respond to assume control.
16
17 (b) Crimes involving armed robberies of funds, drugs, or properties where the individuals
18 committing the crimes leave VA police jurisdiction.
19
20 (c) Vehicle accident investigations, which may result in non-injuries, injuries, or death
21 involving the VA Police patrol vehicles.
22
23 (d) Any major incident that would require additional Officers for traffic control to allow
24 emergency vehicles clear access to the facility.
25
26 (2) Provide additional Officers when needed to assist with the physical arrest of a violent/disorderly
27 person(s)who poses a serious threat to VA patients,visitors,medical staff,or themselves.

29 (3) Provide assistance in the transportation of prisoner(s) arrested at the John L. McClellan VA
30 Medical Center and Veterans Day Treatment Center on occasions when there are only two VA
31 police officers on duty/unarmed Security Guards.

33 (4) Authorize access to and use of Little Rock police department central dispatch and patrol units
34 in the field for VA Police. The parties agree that the access and use of such information are

1 solely limited to official law enforcement purposes and that the process of reprogramming VA
2 radios would be at no cost to the City of Little Rock.

4 (5) Should any VA Police Officer be involved in a shooting,the FBI will be notified immediately.
5 If the FBI declines the investigation, or if the FBI response is delayed, Little Rock Police
6 Department may provide investigative assistance to CAVHS Police.This assistance may range
7 from establishing, preserving, and controlling the crime scene, to performing as the lead
8 investigative agency.

10 (6) COMPACT ACT Section 205 Police Crisis Intervention Training for VA Police requires that
11 each VA medical center police service develop a plan to enter into partnerships with local mental
12 health organizations and experts, Veteran community organizations, as well as local police
13 departments to share training resources on Crisis Intervention Teams(CIT).This assistance may
14 range from collaborated training and sharing law enforcement to coordinated intervention tactics
15 when there is an extreme crisis involving a veteran(s).

17 5.ACCEPTANCE&RATIFICATION.

19 a. The provisions of this MOU are effective upon signature and date as indicated below and will be
20 reviewed every 3 years or as required.
21
22 b. This agreement may be unilaterally suspended or canceled by either side upon giving at least 180
23 days'written notice to the other party.

25 c. This MOU does not create additional jurisdiction or limit or modify existing jurisdiction vested in
26 the parties. This MOU is intended exclusively to provide guidance and documents an agreement
27 for general support between the parties. Nothing contained herein creates or extends any right,
28 privilege,or benefit to any person or entity.

30 d. Other areas of mutual interest may arise where services and support from one party of this MOU
31 are required by the other party of this MOU. This MOU is not meant to limit those instances nor
32 prohibit cooperation outside the above-listed situations set forth and agreed upon.
