3 A RESOLUTION TO AUTHORIZE A CONTRACT WITH POSITIVE
4 RESULTS LAWN SERVICES, INC. IN AN AMOUNT NOT TO EXCEED
5 EIGHTY-EIGHT THOUSAND, NINE HUNDRED EIGHTY DOLLARS
6 AND 00/100 ($88,980.00), FOR CHERRYWOOD COURT DRAINAGE
7 IMPROVEMENT PROJECT; AND FOR OTHER PURPOSES

9 WHEREAS, it has been deemed appropriate and necessary to analyze and design drainage
10 improvements to replace a collapsed pipe;and,
11 WHEREAS, project improvements include construction of a junction box, headwall and velocity
12 dissipation devices;and,
13 WHEREAS,the project will reduce property damage caused by inadequate drainage facilities;and,
14 WHEREAS,pursuant to Bid Event No.2648,Positive Results Law Services,Inc.was the lowest most
15 responsive,responsible bidder meeting the requested bid requirements of the three(3)bids received;
16 WHEREAS, the total cost for this contract shall not exceed Eighty-Eight Thousand Nine Hundred
17 Eighty and 00/100 Dollars ($88,980.00) which is the base bid amount of Seventy Four Thousand One
18 Hundred Fifty and 00/100 Dollars($74,150.00)plus twenty percent(20%)contingencies,if needed;
19 WHEREAS, funding for the project is from the 2022 Capital Improvement Bonds as authorized by
20 Resolution 15,968(May 2,2023)with funds available from Account Activity B6D057D; and,
21 NOW,'THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
22 OF LITTLE ROCK,ARKANSAS:
23 Section 1. The City Manager is hereby authorized to execute an agreement with Positive Results Lawn
24 Service,Inc.in an amount not to exceed Eighty Eight Thousand,Nine Hundred Eighty and 00/100 Dollars
25 ($88,980.00), which is the base bid amount of Seventy Four Thousand, One Hundred Fifty and 00/100
26 Dollars($74,150.00)plus 20%contingencies.
27 Section 2. Funding for this project is from the 2022 Capital Improvement Bonds as authorized by
28 Resolution 15,968(May 2,2023). Account Activity B6D057D.
29 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
30 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
31 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
32 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
33 resolution.

1 Section 4. Repealer.All laws,ordinances,resolutions,or parts of the same,that are inconsistent with
2 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
